The defendant is a nightmare, guaranteed this is how he talks to customers as well. Always saying things ambiguously and avoiding direct answers to give himself multiple avenues to escape responsibility. Literally a nightmare, it makes my head hurt.

I had an issue with a warranty. They said they were going to give it to me free. I read the documents and they charged me $3,500. I called the warranty company and canceled it. I already had a warranty through my insurance.
Watch moving companies, they do this, too. Two separate companies both did this, years apart.

My father in law was a used car salesman for his entire career. Owned his own lot. The judgexsaid there are different types software used car salesman. He was one of the good ones with a great reputation as an honest man. But you do have to watch out. Be vigilant.

Sometimes I find that JM is inconsiderate of the litigants and their financial backgrounds or limitations. I was greatly appreciative that this plaintiff spoke up and made it clear to the judge that the reason she ended up spending so much money on the car rental was because she simply did not have enough money to pay for all the repairs at once. She got paid weekly and that was all she could afford.
If you have 1300 for car rental, you can come up with 1900 for the repair. If you dont have the cash, they have financing specifically for these situations that anyone will be approved for. No excuse.
I actually agree with your point. However, every Car repair shop doesn't offer the option to finance directly through them or an outside third party. Also if the argument is she could have went somewhere that would finance the repair , its not guaranteed they would even do it for the same price or even towing the car there is something she could afford in the moment. @@c420yr

Exactly. Having $1900 as a lump sum vs spending $1300 over the course of several weeks are two distinctly different things. I think it was a tremendous oversight on behalf of the judge, or maybe she had to pseudo-chastise the plaintiff in order to make the verdict render appear to be fair. Either way it made the judge appear insensitive and painted the plaintiff as a fiscally irresponsible individual as opposed to be a responsible young single woman enduring a tremendous sacrifice in order to remain employed. I don’t like the way the judge spoke to her 👎🏽

Oh man, my mom would recount EXACTLY what was said & EXACTLY what the warranty covered. She just did all this with my daughter last year. Lol I mean she co-signed for her so she would want to know everything that she’s signing for but still she would know exactly everything that was said in detail 😆

Exactly. I’m a pharmaceutical chemist and we make mistakes in penmanship all the time. It’s totally not the end of the world and there’s a protocol in place outlining the process of correcting mistakes and always must have your initials next to it. But this is standard practice so most people don’t go out of their way to intentionally not initial a mistake they made on a legal document. I’m calling bs on the defendant as well 👎🏽
I had something similar happen to me. I purchased a used car with a small warranty. Within the time my transmission messed up. The dealer failed to send in the warranty paperwork and payment to the company. I then sued him in court and WON for the cost to fix my car.
I nag my kids, nieces, nephews, kids friends…NAG them to build credit, protect credit. You would be surprised what can get for $200 from a car dealership, If Your credit is good.

Don't know why the judge didn't understand how she could afford weekly rental payments, but not a lump sum. It's the same reason that poor people can buy four pairs of crappy shoes in one year, but not afford one pair of good shoes that would last years. The affidavits actually hurt her case, as there's no way her family would remember her warranty in great detail. Nearly everything else helped her case though.

She wasn't going to rule against the plaintiff, she was just asking questions to verify who made what mistake, although for drama's sake, she made it look 'iffy'.

When I was younger, I bought a used pickup truck from a dealer. The salesman talked my stupid young self into purchasing a warranty. A month later,when the truck needed a new camshaft, I found out that the warranty that I purchased for $1000 only covered $750 in repairs. Be careful what you sign.

I love cases like this. Each side was very neck and neck, there was both evidence and inconsistencies on both sides, but Milian's logical thought process grants one side just a little more weight than the other for a victory. Very cool
Just love the fact that she won. I know that not all used car dealers are shady but there are a lot of them. They use the fact that you can’t afford to go buy a new car against you. Along with sales pressure that if you stop to think about it for a day or two you will lose out on a good deal or promise things they don’t deliver to take advantage of people who can least afford it.
Just a reminder. When buying a used car on credit. ALWAYS buy the extended warranty. You WILL need it and it will definitely pay for itself
Car warranties are designed by the warranty company, so that the cost of the warranty exceeds what it will likely pay out in the event of a breakdown, otherwise those companies couldn’t make a profit. In other words, you are paying, with a mark up, for a potential, future breakdown at the time of a sale. Not worth it.

I see what he did: he accidentally gave her the PG3, but he even said the difference between PG1 1 year & PG3 3 months is like $20, so he just gave her the PG1 for 1 year as “included” or “free” to counteract the accidental PG3 contract. But his mistake was giving her the PG3 paperwork instead of getting rid of it & writing up the right contract.
It was actually $140 difference but the time difference makes it way more expensive. I think he told her she would be getting the PG3 for one year as an incentive to buy and tried to bs her paper work so he can lie and say he didn’t write in 1 year. You gotta remember she said it was really high miles so it’s much more of a risk on her part.
This is one of thee Best examples of " judging" in a very complicated case. Probably the best one ever seen!! Great job!

Y’all don’t understand. Her friend sells “hoopties”. Nobody but the desperate would buy them. A neighbor used to buy them to do his paper route because he just junked them when they died. Usually paid a few hundred bucks for them. He didn’t want to use his newer cars on the route because it’s a lot of wear and tear on the car.
Ford trucks can be expensive. It had high miles and probably issues bringing down the price.

This was a good episode. Enjoyable when she says "this is not my first rodeo" or " One of you is lying and it is my job to determine which one" . Her handwriting reading skills clobbered him. He agreed something he wrote with a backwards E is his, but then the 1 Year with a backwards E he could not admit was his. Nice work Judge.
