  • LAPSING OF THE BILLS :
    In the Indian parliamentary system, the lapsing of bills is a process where proposed legislation (bills) does not proceed to become law due to various reasons such as the dissolution of the House or the end of a session without the bill being passed. Here’s how lapsing of bills works in the Lok Sabha and the Rajya Sabha:
    1. Lapsing of Bills in Lok Sabha:
    - **Dissolution of Lok Sabha**: If the Lok Sabha is dissolved before a bill passed by it has been passed by the Rajya Sabha, the bill lapses regardless of its stage in the Rajya Sabha.
    - **Pending Bills**: Bills that are pending in the Lok Sabha lapse upon its dissolution.
    - **Money Bills**: Money bills cannot originate in the Rajya Sabha and thus lapse with the dissolution of the Lok Sabha if not yet passed.
    2. Lapsing of Bills in Rajya Sabha:
    - **Dissolution of Lok Sabha**: Bills originating in the Rajya Sabha but pending in the Lok Sabha at the time of its dissolution will lapse.
    - **Bills Passed by Both Houses**: If a bill has been passed by both Houses but has not received the assent of the President before the dissolution of the Lok Sabha, it will lapse.
    - **Bills Pending in Rajya Sabha**: Bills that are pending in the Rajya Sabha and have not been passed by the Lok Sabha do not lapse upon the dissolution of the Lok Sabha.
    Special Cases:
    - **Joint Sitting**: If a bill has been passed by one house and rejected by the other, or if amendments are not agreed upon, or if more than six months elapse without the bill being passed by the other house, the President may summon a joint session to resolve the deadlock. This scenario doesn’t directly cause lapsing but is related to the legislative process.
    - **Reintroduction of Bills**: A lapsed bill can be reintroduced in either house of Parliament in the next session or the new Lok Sabha after elections, starting the legislative process anew.
    Understanding these rules helps in grasping how legislative priorities can shift with changes in the political landscape, particularly after general elections when the composition of the Lok Sabha may change significantly.

    Naman sir, isn't ED used by state govts. as well, irrespective of whether it is opposition or in alliance with ruling govt. at centre? So associating it only with Modi is not fair. Yes BJP is also guilty of it, but selective reportage and media coverage cannot give you accurate picture of this issue. eg. DMK in tamilnadu has used many times on ADMK, TN-BJP etc. that too previous years.

    My advise to PM will be in this case, Lets introduce the bill to make ED independant body and i will make provision under act that ED decision can be reviewed by HC or SC. So, it will help to become more transparent in decisions.
    I will said to PM that it will show our commitment to fight against the Black money and courrption. So this move will widely appriciated by people.
    If the any party member come under investigation we can consider to suspend his membership untill investigation completed. It will give a strong and bold msg that our intention are real and it will help us in elections too..
    Opposition can do nothing here since gov will be more neutral here. Win Win situation. Also it will create PM image as a stronger leader..🎉

      Employment in this country can never be sorted. We have a population around 150 cr and most of them are willing to do only government jobs. Until there are fundamental changes in the education system and it has to be significantly integrated to Indian society which also need reforms. And even then it requires atleast 10-15 years of patience from middle class people.

      You must be stupid to assume that all MLAs or All IAS officers are extremely powerful/weak. Some of these IAS officers are very close to Powerful lobbies and pay them heavily to get their work done. Not a single MLA of UP is more influential than Suhel Seth, Rajiv Shukla or Dilip Cherian. MLA’s career does not last more than 10 years on usual, and then, even an SHO can go against him.

      Arre Bhai all the secretaries, joint secretaries and additional secretaries are IAS only. Their main work profile is policy formulation aur monitoring me help krna. Do you think the health/meity/mohua minister has enough expertise in their fields to take technical decisions? It's obviously formulated by experts and IAS officers under the guidelines of the ministry. MLAs look down upon DMs and SDMs which is a very primary/entry level post. That's what we call as a chain of command? That's what we call as civil servants are accountable to the elected people?

    No it won't lapse.
    Because now the bill has Passed by both of the Houses.
    Simple way to understand this -
    R.S. is a Non-dissolvable Body.
    So any bill which is introduced in RS
    ( pls remembered introduced not transferred to RS ) will not dissolve weather it transferred to LS or Not.

    no it will not lapsed, the president can sit on the bill forever, but if he return the bill to LS asking some changes and if the goverment send the bill again to president then he/she will have to pass it no matter what.

Make this bill lie on his table for the 100years as pocket veto and president not bind in a time limit to give his accent later .... Pm and com act that.....     The transfer of IAS,IPS officer should be in the hand of judiciary.. Judiciary had to assure that corrupt officer should not be in the important department..The secretary should be selected by CJI and minister..In central the pm and CJI of India should select the secretary of India and in state chief minister and cji of High court should select..CJI had to assure that the selection is done on the basis of merit and that person hadn't accused of corruption or other serious charge..

    Bill won't lapse as LS and RS has utilised its power to deliberate and decide upon the bill and the same has been passed by both the houses individually. So it has undergone legislative scrutiny of both the houses.
    Now, only the last step is required to make it a law.
    The concept is simple that the house responsible for a bill if it is dissolved the things attached with it will also lapse.
    Now RS is a permanent house but LS isn't.
    So any bill
    1) pending before LS (either originating or passed by RS)
    2) passed by LS
    Will lapse if LS is dissolved.
    But if the bill originates in RS and yet not passed by RS won't lapse in LS as it is yet not attached with the ship of LS :p ... Even if the whole house of LS undergoes change, they still would have the opportunity to debate and discuss the bill and hence no need to lapse the bill.

    If a bill has been passed by both the Lok Sabha and the Rajya Sabha and is pending the President's assent, it does not lapse upon the dissolution of the Lok Sabha. The bill remains pending and can still receive the President's assent even after the Lok Sabha has been dissolved. The dissolution of the Lok Sabha affects bills that are still in the process of being passed, but it does not impact bills that have already completed the legislative process in both houses and are awaiting the President's signature.

    A bill passed by both Houses but pending assent of the president does not lapse, so the bill will not lapse but what if the president passes the bill won't it be a "Lose" for the bjp govt "MODI JI" or will the president also be bribed??

    the hilarious thing about apparently inclusive, liberal, forward thinking people is that they are trapped in their own sense of self righteousness..focused only on 'what' was done and 'how' it was done without ever questioning themselves on the 'why'. yes, the 'why', the holy grail unfortunately which is way too complicated still for the common educated class in India to understand.     107. Provisions as to introduction and passing of Bills
    (1) Subject to the provisions of articles 109 and 117 with respect to Money Bills and other financial Bills, a Bill may originate in either House of Parliament.
    (2) Subject to the provisions of articles 108 and 109, a Bill shall not be deemed to have been passed by the Houses of Parliament unless it has been agreed to by both Houses, either without amendment or with such amendments only as are agreed by both Houses.
    (3) A Bill pending in Parliament shall not lapse by reason of the prorogation of the Houses.
    (4) A Bill pending in the Council of States which has not been passed by the House of the People shall not lapse on a dissolution of the House of the People.
    (5) A Bill which is pending in the House of the People, or which having been passed by the House of the People is pending in the Council of States, shall subject to the provisions of article 108, lapse on a dissolution of the House of the People.

    This is a pipe dream. Lokpal is independent, ECI is independent so are Information commission and Supreme Court and the Controller and Accountabt General to name a few. Fact is India there is nothing called autonomy and independence as no govt or system allows it.
