How to Trademark a Phrase

  • In this video, Josh discusses how to trademark a phrase so that you can get the most value out of your slogan or tagline.
    Contrary to popular belief, there’s more to a company’s identity than just a name and logo.
    When you think of some of the biggest brands out there, they almost always use some kind of phrase to supplement and summarize their identity - a slogan, tagline, catchphrase, or company motto.
    Done effectively, these phrases can contribute as much to the perception and selection of a particular business as the name, logo, or product or service itself.
    Because phrases can acquire value and play such a major role in your success, it’s important to protect them against infringement by registering them with the USPTO. Once you do so, you’re safeguarded nationwide from any other similar businesses that might impede your success by using a similar phrase to sell their offerings.
    Here are four steps to successfully trademark a phrase:
    1. Conduct a full trademark search.
    2. File your trademark application.
    3. The trademark goes for a 30-day opposition period.
    4. Receive your registration.
    The trademark registration process can take about six to eight months total, so it’s important to start the process as soon as possible.
    You’re in a much better position to defend against a claim of infringement than to make a claim yourself against a party that may be infringing upon you, should your phrase become a lucrative commodity sooner than you expect.
    By proactively safeguarding yourself, you can prevent even more lengthy legal entanglement and potential lost business down the line.

    Thank you so much for this info. It was very helpful. I do have a lingering question though; in the event that the trademark office were to inform an applicant that there trademark was already in use and/or a similar one was already in use, do they also inform the applicant of when/where/and by whom said trademark had been filed? My paranoid mind needs to know! 😂 Thank you for this video as well as any additional info you may be able to to provide!

    Is there such a concept as this: Trademark protection begins when you conceive of the mark, as long as you can prove when you conceived of it. I can't remember where I heard this. If false, what might I be confusing this with? Can you tell me any cases where a dispute like this was made?

I just pasted the 30 days of opposition so next i will have to show that I made money from my business. Did want to ask how would they like me to show that i made money from my business if you don’t mind me asking??

      Go to the US copyright office website. That is the legit way.
      I will try for sure to get some copyrights going.
      I have a pretty powerful logo in mind and phrases for stalking survivors I know will resonate very strongly for stalking victims.

    Let’s say my brandname is “Fat Boys” for my cross fitness label, and I’d like to register the three words “Fat, Skinny, Lean” as three words associated with my label. If I have “Fat, Skinny, Lean” on certain products, or my personal product line......will anyone be able to use “Fat, Skinny, Lean” on their products legally? How do I make “Fat, Skinny, Lean” my very own slogan associated with my label? Without any brandname legally using these three words?
