    What get's me is names like colours orange, green, pink, blue etc. are trademarked. I'm Australian and even Koala which is our national animal is trademarked but not by an Australian but by a American. Like who gives someone the right to say they can trademark such a name? And where does the money go that these people are paying to trademark such names like Koala.

      Because all words are made up, even the names we give animals.

    Can I or should I launch an original brand before registering trademark?

      I'm not sure what you mean by that? You don't need to be using your trademark in commerce to file an application. But a trademark lawyer can be helpful to make sure your name is actually available before you start using it.

      Legal fees + $350/class. Legal fees can vary depending on how easy or complicated your application is and what service you use. I do not recommend low cost trademark filing services - they send me a lot of clients when they mess up. 😂

    Thank you so much for this video. I was soooooo confused with trademarking and while I could easily trademark locally, I would very much prefer trademarking nationally since that supersedes the local trademark application. I'm a content creator and I am now dead set on hiring a lawyer to help me navigate the application process to make sure I am fully protected.

    • @jimhart
      @jimhart  3 หลายเดือนก่อน

      They would need to hire a US Attorney to assist with the filing, but yet.

      No, for example. It’s not delivery it is digornno. That is a registered trademark of Digorno even though it is a slogan, Badabappapa from McDonald’s is also trademarked too

    Use WIPO in Geneva. Much cheaper than any lawyer. Be aware of the wait. 18 months isn’t a long time! If you are asked to add a Disclaimer then America won’t let you deal with it without using an active expensive US Attorney. I’ve paid £5500 for 13 International Trademarks

    So if I wanted to use a phrase to put on bumper stickers, clothing, leather wallets, golf balls and mugs to be sold on a website this would be 1 application filing fee plus each nice categories 16, 25, 18, 28, 21 and a fee for each?

    Thank you, that was a lot of great information and a real eye opener. I was actually trying to run away from this because of the cost and process. Now I'm realizing that's not such a great idea lol.

    I have an intent to use trademark application pending and plan to switch to an "In Use" trademark application. How many sales do I need to satisfy the requirements to successfully obtain the trademark

    Great content Jim. I've been binge watching your videos. I'm currently a nurse and strongly considering starting a business with hopes to make it my full time and only job. Would you be able to make a video on utility patents (specifically utility clothing in my case) and if there are any protections on patent pending products? I'm trying to research as much as I can before I pull the trigger on my business. Thank you!
