There is literally written in U.S. copyright/TM law a function that if a company does NOT protect and pursue infringement that they can and will LOSE that copyright/TM. Nike has to go after him even if they didn’t want to or they would lose those copyrights.

The thing is the Shoe Surgeon is making them from scratch and selling them this is the exact problem of the situation. Now if Shoe Surgeon bought all his Nike shoes from Nike and then modified them and sold them Nike would have no standing in court to stop him from doing so. This would be no different then opening a resale store and stocking it with preowned products and selling them. Shoe Surgeon could easily get around any legalities if he did it this way. The main thing he did wrong is he created the Nike from scratch and cut out Nike completely. The Honda example is misleading also. A custom shop could buy 100 Honda and modify them and then turn around and sell them as their own customized Honda and nothing would be wrong about it because Honda has already gotten their profit and the product is now the property of the buyer. As long as the person buying and modifying the product is not trying to represent it as an official sponsored product of say Nike/Honda then there would be no issues.

There was a similar lawsuit against a wallet maker that use Louis Vuitton bag and cut them up and made wallets show the LV logo. Louis Vuitton lost because he marked all of them with a small maker’s mark in the in side the wallet. Nike is powerful, the way cases like this are supposed to looked at is would a avg person would think its that brand. A recent supreme court case were Jack Daniel’s were a dog toys company copied the Jack bottle but changed the name to Bad Spaniels. The court rules that no one thought Jack was making these dog toys. The point is it depends on what the judge thinks is right. There is a chance Nike will lose. I think stands in a very good place because if you don’t know shoes well an avg person would think that they are Nikes
Thanks for the comment bro - there are a few cases where upcyclers have also settled with brands like LV - I spoke about LV vs Sandra Ling - and you’re right - it hinges on whether or not the products made are likely to cause confusion and I think Nike have a strong case - plus it’s not just the counterfeiting it’s also the digital assets aswell as the running of these courses that have enabled more of these violations to occur - even if one or two of the counts get dropped there’s still plenty of evidence to settle in Nikes favour unless they want to take it to trial which I’d doubt

Nike is too big of a company to reach out to other brands such as Gucci and Louis. Because the negotiations over the price and emblems would be outrageous. They allowed a third party to take the 2 brands and do it of free. Will this only helped Nike by bringing more attention If Gucci and Nike, was to collab on there own? Who would be featured? Who would be the owner? These are discussions that these big companies don't. Have time to pay. However, the whole operation was stopped by one of YE's people by calling the police. He has been involved in numerous incidents this year, including the Goyard and Nike lawsuit. In my eyes, he has a lot of dirt on his hands and is trying to make money by any means necessary, at any cost.

@@sneakernomics5547 sounds like Nikes legal department and collaboration department aren’t on the same page, it just sends mixed signals when you sue someone you’ve worked with as soon as last year if you new they where profiting off your trademark, I believe the classes to customize shoes was a good way to make money, but have students sign a waiver stating they do not intend to use the knowledge gained to steal trademarks, etc… and he should’ve never sold templates
Personally from an art stand point and as someone that was heavily into customizing shoes since the early 2000's, but also a major sneaker head that despised fakes, especially during 2003'ish to 2007'ish when Fake Jordans were REALLY bad and everywhere. I don't see his or anyone else's work as fakes/reps. To me a rep is attempting to be a 1 to 1 carbon copy of a original released shoe. You know, to the point where people have to get "legit checks" because they cant tell if they are holding a legit shoe or not. He's not making his own rubber soles from scratch that look like Jordan 1 soles, and he's not trying to replicate lets say a Jordan 1 Chicago down to near perfect materials as Nike uses. He's buying legit pairs, ripping off the original uppers and then remaking the shoe in lets say all gator material but LOOKs like a Chicago 1 colorway(just for example) and gluing and stitching the original legit sole back on. Is there a line to be drawn when it comes to custom shoes? What percentage of the original material needs to be retained for you to think otherwise? For The Shoe Surgeon and MANY others like him hes trashing everything but the sole and using all new materials of his liking. What about people that rip off the original swoosh then stitch on a new swoosh from another material? Or those that paint a shoe to look like a different color way? There's plenty of people taking legit Jordan 1's then painting them to look like bred 1's, theres tons of videos of that here on YT, are they making reps? or is it a custom shoe?

Shoe surgeon definitely pushed it too far by doing retail sales. Saying that Nike never should have worked with him in the first place because it gave him some legitimacy.
I don’t care about the shoe surgeon himself, I think most of his customs are just tacky and hypebeast anyways but I am concerned about what this means for custom shoes in general as a customizer myself. I like to express my creativity through sneakers and I learned how to make nike custom reconstructions myself and I was told that it was legal because it was not a fake product due to the use of a real nike outsole that was taken from a real nike shoe that must be purchased. I don’t know about what the shoe surgeon does but I only make the uppers from scratch and then use a real nike outsole which is considered to be a big enough part of the shoe for it to be considered a completely legal custom reconstruction.
This is going to be a strange case because he got hired by them because of his ability to upscale and customize them. I've made some cool sneakers on Nike ID. I don't hear them calling me up for collaborations. I think his academy is whats causing the problem.
Theres a brand RUF that modifies Porsches so hard that they're registered as a separate automaker. They've been around for a while and they virtually look like Porsches but they're legally registered as Rufs because the amount of bespoke parts qualify it to be not from Posche. Same with Singer and they do these things by purchasing used Porsches. None of those people get sued and are in fact embraced by the company because they're not really squabbling over petty stuff, they're innovating and growing instead. Nike makes a lot of money but they're on some real petty stuff, maybe do something new with tech fleece that isnt trash or make a new air max that actually hits.
Thats not the same thing, did you bother watching the video? Those RUF Porsches started out as stock Porsches bought from Porsche, not built from the ground up. The Shoe Surgeon is creating Nikes from scratch and selling them and teaching people how to also create them from scratch. Creating Nikes from scratch isn't the same thing as customizing an existing pair. The former is the same thing as counterfeiting since Nike didn't not give him permission to make them from scratch and sell them.

It’s a difficult one for sure, this will definitely hurt Nike as well because I doubt he will want to do commissioned pieces using their products anymore after this which will take alot of eyes off Nike products given the people he was doing the customs for. He definitely is in the wrong with a bulk of it and is cooked but neither party is going to come out smelling of roses afterwards.
He only did 3 commissioned projects over the years and so it’s not like he’s someone Nike rely on regularly - athletes and celebs will still want to rock with Nike but for SS he will have to make something new and use his talents to innovate

Love the video and appreciate the updates as always. In the case of Nike vs Anyone (insert all the groups they’ve sued)! I give zero F’s! They are doing what is within the law for their brand. Does all this matter, to me no because I wasn’t shopping on the shoe surgeons site for over priced BS! The reason people are making crazy and sideways comments, is because Nike has made a lot of customers salty. From their crappy Sneakers App, lack of innovation, over pricing shoes, lack of quality control, excessive back dooring (that’s has happened from within on more than one occasion), and over reliance on retros! So then people are making comments based on emotion and not rational thought. I don’t care who they sue or go after (JDI). But while they are at it focus on how to improve the brand! ✌🏽

No doubt what SS has done is a breach of copyright. It's no different to what a lot of Chinese automakers did in copying a number of European makes to which they got sued for.
Most folks don’t fully understand Nike’s motive and it’s quite simple- protect the brand. A lot of idiots out there quickly assume Nike just needs money with their current stock performance.

Honestly i agree and disagree, as far as the car analogy goes, not a good one, here in the states they do that exact thing, and the car companies welcome it, even selling base models to these companies at fleet prices, shoes will never be the same…

@@sneakernomics5547 sounds like Nikes legal department and collaboration department aren’t on the same page, it just sends mixed signals when you sue someone you’ve worked with as soon as last year if you new they where profiting off your trademark, I believe the classes to customize shoes was a good way to make money, but have students sign a waiver stating they do not intend to use the knowledge gained to steal trademarks, etc… and he should’ve never sold templates

Personally from an art stand point and as someone that was heavily into customizing shoes since the early 2000's, but also a major sneaker head that despised fakes, especially during 2003'ish to 2007'ish when Fake Jordans were REALLY bad and everywhere. I don't see his or anyone else's work as fakes/reps. To me a rep is attempting to be a 1 to 1 carbon copy of a original released shoe. You know, to the point where people have to get "legit checks" because they cant tell if they are holding a legit shoe or not.
He's not making his own rubber soles from scratch that look like Jordan 1 soles, and he's not trying to replicate lets say a Jordan 1 Chicago down to near perfect materials as Nike uses. He's buying legit pairs, ripping off the original uppers and then remaking the shoe in lets say all gator material but LOOKs like a Chicago 1 colorway(just for example) and gluing and stitching the original legit sole back on.
Is there a line to be drawn when it comes to custom shoes? What percentage of the original material needs to be retained for you to think otherwise? For The Shoe Surgeon and MANY others like him hes trashing everything but the sole and using all new materials of his liking. What about people that rip off the original swoosh then stitch on a new swoosh from another material? Or those that paint a shoe to look like a different color way? There's plenty of people taking legit Jordan 1's then painting them to look like bred 1's, theres tons of videos of that here on YT, are they making reps? or is it a custom shoe?

Shoe surgeon definitely pushed it too far by doing retail sales. Saying that Nike never should have worked with him in the first place because it gave him some legitimacy.

I don’t care about the shoe surgeon himself, I think most of his customs are just tacky and hypebeast anyways but I am concerned about what this means for custom shoes in general as a customizer myself. I like to express my creativity through sneakers and I learned how to make nike custom reconstructions myself and I was told that it was legal because it was not a fake product due to the use of a real nike outsole that was taken from a real nike shoe that must be purchased. I don’t know about what the shoe surgeon does but I only make the uppers from scratch and then use a real nike outsole which is considered to be a big enough part of the shoe for it to be considered a completely legal custom reconstruction.

This is going to be a strange case because he got hired by them because of his ability to upscale and customize them. I've made some cool sneakers on Nike ID. I don't hear them calling me up for collaborations. I think his academy is whats causing the problem.

Theres a brand RUF that modifies Porsches so hard that they're registered as a separate automaker. They've been around for a while and they virtually look like Porsches but they're legally registered as Rufs because the amount of bespoke parts qualify it to be not from Posche. Same with Singer and they do these things by purchasing used Porsches. None of those people get sued and are in fact embraced by the company because they're not really squabbling over petty stuff, they're innovating and growing instead. Nike makes a lot of money but they're on some real petty stuff, maybe do something new with tech fleece that isnt trash or make a new air max that actually hits.
Thats not the same thing, did you bother watching the video? Those RUF Porsches started out as stock Porsches bought from Porsche, not built from the ground up. The Shoe Surgeon is creating Nikes from scratch and selling them and teaching people how to also create them from scratch. Creating Nikes from scratch isn't the same thing as customizing an existing pair. The former is the same thing as counterfeiting since Nike didn't not give him permission to make them from scratch and sell them.

It’s a difficult one for sure, this will definitely hurt Nike as well because I doubt he will want to do commissioned pieces using their products anymore after this which will take alot of eyes off Nike products given the people he was doing the customs for. He definitely is in the wrong with a bulk of it and is cooked but neither party is going to come out smelling of roses afterwards.
He only did 3 commissioned projects over the years and so it’s not like he’s someone Nike rely on regularly - athletes and celebs will still want to rock with Nike but for SS he will have to make something new and use his talents to innovate
@@sneakernomics5547 but that might be where it hurts them, if he isn’t willing to do the Nike/Jordan based customs for celebrities they will either go elsewhere or just rock something different, as much as i personally am not a fan of Jake Paul, the boxing shoes he had SS make up for sure brought a lot of attention.
