    I work for an arborist. Our guys are professionally trained and certified . All trees should be trimmed according to their species. Palms are always tricky, but the number one rule is that they are never cut them from the bottom. Prayers for the family at this sad time.

      Pretty harsh comments. There probably should be standards both for the contractor (owner of the company) and even the homeowner making sure the tree is cared for consistently, not letting the palm tree prongs pile up like that. My condolences to the family.

    No judgement. A father and grandfather is now gone.. no matter what happened. Grief will have many stages to deal with. And anger and wanting answers is a stage.     During my training in Australia, I learned that when a harness is improperly strapped around the groin area, it can impede blood flow, leading to potential circulatory issues.       Those palm fronds can weigh a 100 pounds. He cut from the bottom when palm trees should be cut from the top. He asphyxiated from the weight.

    Careless reckless or over confident never ever cut palm fronds from below! I unfortunately live at a property with 6 huge palm trees and had to cut them myself with help of my contractor uncle! you have to be extremely careful each fronds can weight over 100lbs!

    Arborist did the unsafe route to trim the palm tree.
    He needed to shoot a line to the top of the palm tree.
    Then secure a line and use a harness, trim from the top thus making it safe.
    Sorry for the families loss.

      We have our palms trimmed every year and never let them get out of hand - minimizes the danger to the trimmers and us.

      Good point! Or he could have used a spider lift. But they can get expensive.
      A 'big shot' slingshot attaches to a pole-saw pole and can shoot a line up over 50 feet!
      There's no reason any arborist should be cutting frond clumps underneath.

    Unfortunately, a family member commented last week that his uncle always drank alcohol on the job🤷‍♀️. I’m not sure that comment will help his law suit.

      I walked into a little local market. A "tree company" employee was in there on his lunch break buying cold beer. They towed a big grinder on the back of their truck. I took down all the info, and used it.

    He worked for an UNREGISTERED BUSINESS. HE KNEW IT WAS UNREGISTERED. He made the decision to work for a contractor that allowed HIM to do things the way HE wanted to do them and sadly it got him killed. Now the family wants to SUE the HOMEOWNER and the BUSINESS. Greedy.

    Well watching the rescue live and wondering what might have gone wrong, i found a video on YT by the California Dept of Public Health - "Preventing Palm Tree Trimmer Fatalities" (4/21/14). It highlights how dangerous palm tree trimming is and features a family of a tree trimmer that lost a loved one. RIP Mr. Leiva and condolences to his family 🙏

      In the state law if the home owner hires a non licensed contractor the home owner is liable for the safety of the workers and can be sued

      there is some liability for the property owner or who ever enabled the accident to take place. If you hire some fool and send him up your tree to do your bidding YOU are responsible under the law for their safety , all this assumes ofc that this guy was a independent unlicensed under the table laborer which is the norm in these cases.

    Anyone trimming trees for decades knows not to cut mexican fan palm fronds from underneath. The dangers of this method are well documented. Fan palm fronds should only be trimmed from above as they at times free fall in a clump.

    Hiring the lowest bidder can become very costly. They have no liability insurance to cover damage to the property and no workman's comp to cover their workers' injuries, then if something bad happens, it may fall on the homeowner, who actually accepted the lowest bid. Hopefully, there was a contract with specifics.

      I guarantee you that woman has already called an attorney because you hear what she said. Home owners should hire a contractor obviously not their father. This is why I cut all my palm trees down they are not even native to most of the US. I'm in AZ million of them here this happens all the time. They provide little shade and require high risk maintenance. I hired a licensed tree contractor cut down 21 palm trees in my yard when I bought my house.

    So, this man worked for a fellow that was NOT licensed. The dead guy knew it. The dead guy’s family knew it. And NOW he dead guy’s is denouncing the dead guy’s employer for not having a license!
    I’ll bet that the dead guy and his employer worked for cash under the table and avoided paying any income tax- which the dead guy;s family would have known.
    But, now it is not the dead guy’s fault he is dead, it is someone else’s fault!

      Well the dead guys family is the ones on here blaming the company owner and it's probably bc yes their dad worked for cash and yes they knew it and knew along with that ment no workman's comp and no accident insurance. So now they don't get paid, so now it's a problem that their dad was working for tax-free cash. So now it's a problem, but it was a risk they took to work for cash. My cousin used to be a tree climber, and a lot of the tree companies he worked for were cash paying companies. But they were easier to get on with and more of them than legit companies. What happened here was a on the job accident, and it's a known hazard in trimming them. He knew the risk he took the risk and the risk caught him. Don't blame the company now that the risk bit them. The only thing that would have changed with the company being legit would be the families' payout. He would have still made the same mistake that killed himself.

    He was either not properly instructed on cutting palm fronds, or the deceased ignored or forgot instruction. There's really no other reason for him to be cutting the fronds while under them. Proving that the deceased wasnt properly instructed is going to be very difficult.

    I am so sorry this tree trimmer lost his life but nobody’s to blame but himself. He put himself in that dangerous situation. He should’ve known better than to trim that palm tree from the bottom.

    Why do people always blame everyone but the person doing the work? I work as a pipe welder and sometimes I have to make welds on live natural gas lines or up to 300 feet above ground level and it is up to me to inspect my safety equipment and make sure I am safe. If something isn’t up to standards I have it replaced before I put my butt on the line no amount of money can make me ignore safety if my employer doesn’t like it I can grab my stuff and leave and call osha so someone else doesn’t have to do it under dangerous conditions

    If he got knocked out and he was hanging in his harness, the harness cut off his marjor arteries in his legs and the blood can’t return flow to he heart. You have about 5 minutes to get out of the harness. They now have drop down leg straps. But they won’t work if he can’t get them released. Prayer for the family ❤🙏 and his loved ones

      Man made a fatal mistake. Though he was doing all he could to support his family, he risked his life and that risk ended him. I still feel bad for his family. Contractors should offer insurance and proper equipment for them to do the job correctly and safety. Instead its all about cutting corners and being cheap. You shouldn't mess around with dangerous jobs. Some people need money bad and will take chances to earn it. It's all very sad.

    I've been doing trees almost as long on 54 years old. Started when I was twe all in the industry. Know the inherent dangers of it. And if we do not take the proper and necessary precautions, things like this happen and I get it because I'm like that. I've been doing it a long time too. Sometimes you try to take a shortcut. Sometimes try to do a little differently. I feel deeply for this family. Sorry for your loss

    HE MADE THAT DECISION TO WORK FOR THEM. AND TO BE HONEST, THE FACT THAT HE HAD SO MUCH EXPERIENCE, IS PROBABLY WHAT GOT HIM KILLED. HE WAS COMPLACENT WITH CUTTING CORNERS AND FELT CONFIDENT IN DOING THAT. HE PROBABLY DID IT IN THE PAST AND IT CUT THE TIME IN HALF TO TRIM THE TREE. BUT THIS DAY, IT CAUGHT UP TO HIM. BUT TO SIT HERE AND SAY IT MAKES NO SENSE BECAUSE HE HAD YEARS OF EXPERIENCE OR TRYING TO PUT THE BLAME ON SOMEONE ELSE MAKES NO SENSE TO ME. MOST OF THESE ACCIDENTS HAPPEN TO PEOPLE WITH TON OF EXPERIENCE BECAUSE THEY GET COMPLACENT AND TRY TO CUT CORNERS TO GET THE JOB DONE FASTER THAN THE NEXT PERSON, COMPANY, ETC.

    This made me very sad. This randomly popped up on my algorithm the other day, and I saw the raw footage. Saw him, and felt awful for his family. Working hard to provide, set a decent example for his children, didn’t know he was a grandfather too. I’m so sorry for your loss, truly. 🙏🏽🇦🇺🌹

    RIP ... The 'contractor' seems to be in the wind. It sounds like from what the daughter said, the contractor wasn't licensed or insured, but apparently he was the low bidder. That homeowner is going to find out what a bad idea hiring this victim's boss was.

    Just trying to make a living ... it sounds like he was relying on his abilities and experience to outweigh the shortcomings of his (non-existent) safety equipment. Homeowners: is the cheapest bid worth the money?
    Employers: can you pay for a person's life, if you can't pay for the right equipment?
    Workers: alone, you are never as good as you think you are. Also, gravity is not your friend!
    Regulators: find a way to help businesses be safer, please! Stop legislating businesses into the shadow economy.

      I think that’s an exaggeration. Also, even if that were so, it would still be reasonable to hold employers accountable for employee safety. They aren’t saying they want charges on the employer even if he was proven to have been negligent.
      When you pay someone to do something, you take a measure of responsibility for the work they do and their safety while doing it. You are just as responsible for that employee working as the employee is.

    I remember seeing my grandpa cutting dry dead leafs off his own palm tree in the back yard. He was old and somehow able to do that work.

      I saw a news report on another local tv station and they interviewed Jonathan Drucker (PIO for Kern County FD) and he said the guy did have on professional gear such as special climbing shoes and a safety harness.

    Dang, that was one tall ass tree. Who the heck ever took that job then passed it on to dead guy is a POS. He knew it was dangerous. Too dangerous for anyone experienced or not. Too tall with too much weight.

    The family is looking to make some money off this accident. He knew what he was doing. When he climbed up in that tree. It is very unfortunate he died but mistakes of his own.

    You are protecting yourself as a homeowner by making sure you dont hire unlicensed contractors. Doesnt matter what for. Usually its not to deal with someone dying while working on your property but to protect you from being taken or having your property damaged. If the homeowner knowingly hired this crew unlicensed to save a few bucks then they may be able to be sued. Legal minds would need to weigh in on this one. BEyond my sad little paygrade unfortunately....lol

    I had my palm tree groomed twice a year. If you own them you have a responsibility to keep the dead fronds and fruit spears trimmed off. Those things are dangerous and can cause great harm to people and property on the ground. It is irresponsible to not have them trimmed at least annually!

    Alot of errors done all and culminated in a death. It’s cool if he climbed trees since a kid, but there are differences with recreational monkey’ing around and a Skilled, Qualified Climber. Awareness to safety regulations??? There are tons of regulations in place, from O.S.H.A to ISA, ANSI Standards, in fact there are SPECIAL standards for maintenance of Palms, all this in English and Spanish. Homeowners PLEASE Hire licensed qualified professionals, in this case Arborists certified by the ISA, ‘International Society of Arboriculture’. This is not a stab at ‘Chuck in a truck’ trying to make a living, this is about setting parameters and putting safety in the first place when it comes to who is performing the job. RIP to the Climber, Im sure if he had a Decent human being with a conscience for a Boss, he would still be with his family. Im sure the scumbag boss never cared for safety, nor continued education for his workers.

    A very unfortunate accident. I am not sure why they are going for a change of some kind of regulations though. It sounds like he knew his job and unfortunately, this happened. And Now, working for an Unlicensed contractor is On your Dad, and Hiring an unlicensed contractor for probably a cheaper price is on the Home owner. This is Not a common occurrence, hence, the industry must already have some good or decent regulations and procedures on how to get it done. RIP sir. Your Family Loved You.

    When I was in the tree service I watch a professional do that and it would take him about almost an hour to get to the top of the Palms crown . but he brought it down in 25mins. my deepest condolences go out to the family.

    If you have four decades or 40 years of experience with palms are cutting trees and he would have known better that a bucket or a lifter is what's needed to trim those type of palms. Being cheap on yourself or trying to make money for someone who doesn't want to pay is a big lesson as well. Don't go cheap on yourself while risking your life

    There are regulations and he knew them if he trimmed for 40 years and he knew the way he was trimming the palm from the bottom is dangerous and shouldn't be done. Very tragic but very preventable. Hope his family finds peace.

    There are regulations with contractors but a lot don’t force their workers to follow because the workers don’t seem to think the rules are important. I’ve argued with employees about safety concerns but they don’t care.
