  • Private sales and transfers are legal for the most part with the exception of a few states and districts. There is no national gun registry, and a few states require certain or all firearms within their state be registered. But does a gun need to be registered under your name and is it required?

    I usually go to Office Depot or Office max and print out a firearm bill of sale and give one to the seller and I keep one for me just for my own records of buying the firearm/firearms

    When you buy a gun from a gun dealer, you have to fill out a background form which goes to the government so I feel there is already a gun registry.

      The forms do not go to anyone for a number of years. 2, 3, 30 years. Then the vast majority are not reviewed. And even the ones reviewed, the firearms listed may not even belong to the original buyer. And there is no registry.

      @@thewrenchmaster122 a trace. Yes. But the trace ends at the last person who bought the firearm from the FFL dealer unless everyone after maintained a record. There are millions of gadgets out there that no one will ever know where they are or where they went.

    I have a double-digit number of firearms in my home and not one of them were purchased with my identification, a 4473 or any identifiers whatsoever.. if I can be found through any one of these weapons I would willingly give them up to any investigative body that found them. Some aspects of the transaction I will not discuss but there is no way for them to find my legal name attached with the serial number of any of my weaponry

    I purchased a 9mm from this gun years ago. Wrote on a piece of paper his DL# , address , where he purchased it from and serial number. We signed it also.

    My dad, who lived in Texas at the time, purchased a gun from a friend. He now resides in California and I would like to take ownership of it. It is an off roster pistol here in CA, but not in Texas. Would I be able to legally purchase it from him? If so, how would I go about it?

      To help track/trace the firearm. To keep an eye on manufacturing as well.
      Owners cannot report it as lost without identifying markings.
      When reported as lost or stolen, the serial number, make, model, caliber is entered into NCIC database. When an officer nationwide encounters it, the firearm will show stolen or lost.
      Without it being in NCIC or another similar database, an officer can run the firearm and it will not come back to anything. No name, no caliber, no make. Nada.

      As an FFL, and a criminal investigator who has found guns in crime scenes, guns are not under peoples names.

    What about the buying and selling long guns to a person from another state. Example if i bought a rifle(not a handgun) in private from someone in Kentucky could I take it back to my home state or is that a felony?

      My understanding is that is OK. You can't travel to their state to sell it. But they can buy the long arm and take it back.

    Guns should be the same as selling a car, dealer, private party, in any state of the union, shouldn't matter. What about interstate commerce laws ?

    Hypothetically if someone went out of state to buy banned firearms could state know if you bought it before ban? (Illinois banned new sales of "assault" rifles)

      If they requested a trace from the ATF, and it shows that it was manufactured, transferred to a distributor, transferred to a dealer, or transferred to a buyer from a dealer after the ban, then they will know that you acquired it from somewhere sometime after the ban was put in place.
      If that makes sense.

    Let’s say I sell my handgun to a coworker and I believe he’s not a felon and have no reason to believe he’s one. I proceeded with the transaction and he signs a statement saying he isn’t prohibited from owning a gun on the bill of sale. Next thing he’s arrested because he is a felon and can’t own a gun, will I be in trouble even though I didn’t know he had a felony? (Texas)

      You shouldn't be. But you can always get hassled and accused that you knew.
      The burden of proof lies on the state though. Innocent until proven guilty.

      @@lancecochrane9302 that is always a possibility. Even if you did no wrong. As someone who investigates and arrests people for a living, there needs to be probable cause to arrest. For that it must meet the elements of an offense. "Knowingly" selling a firearm to a prohibited person is unlawful. "Unknowingly" is not a culpable mental state.

      Receipt if you would like one. FFL dealer is required to at least keep track. Unless he purchased in a private transaction.

      There should not be. Once sold legally, you have no control over what the new owner does with it. Your obligation or responsibility for the item is over.

      All of chapter 46 of the penal code is about weapons. The laws just say what is illegal.
      They do not mention what is legal.

    Let’s say I traded guns and we both sign a paper for the trade can I carry the gun legally? I bought guns from pawn shops before but when I traded ppl told me to put it in my name but there is no registration in Georgia so will police run the serial numbers to see a name or how does it work? I have been harassed by police before eventually giving my guns back but this gun wasn’t bought at a shop it was a private sale could I get arrested?

      I don't know Georgia state laws, but in Texas that is legal. Federally that is legal. It may be legal in GA. That is why i commonly say, "even if it's legal, you can always be given a hard time".

      Firearms are not registered to a name.
      There is always liability in everything we do.
      As long as you do not violate the law, there isn't much to worry about. I suggest a bill of sale.

    Robyn broke no laws at the time and no charges were pressed against her.

      I do not know all the details surrounding the transaction. And I do not know what laws were in effect at that time.
      The criminal mental state is an element to a crime. Was there mal intent when the transaction was committed?
      Even if there was a culpable criminal mental state, prosecutors have discretionary powers. Meaning they don't have to prosecute anyone even if the evidence exists.

      I am curious though. If someone were to gift a minor a gun or guns, is that legal or regulated in any way?

      @@sarahshanahan2222 depends on what you consider as a minor. Fed law prohibits the possession of a pistol under 18.
      Texas law prohibits the possession of a firearm by a person under 17 without adult supervision.
      State law prohibits the transfer of a firearm to a 17 year old without guardians consent.
      You can't transfer it to someone you know is prohibited, intoxicated, or planning to commit a crime with it.
      You cannot purchase from a FFL dealer with the purpose of transferring it to someone else.

      Pawn shops are good. Some sell new stuff. Some don't know what they are selling. Know what to look for when making a purchase. Don't want to buy something broken.

    Can one use a shot gun that is lets say one purchased from another that was a private deal can one use that shot gun legally as home defense with out any knowledge of that guns past. Would it be ideal or not a good idea would it be a bad idea since theres no history of that guns past. Any info would be greatly appreciated

      It's all the same. Unless you know it was stolen.
      Best to keep a record of who you bought it from and when. But as long as you had no knowledge of it being stolen, you are good to go.

      If they are intoxicated, you know they intend to break the law with it, or you know that they are a felon or other prohibited person.
      If you don't know you don't know. You can ask.
      Ultimately it's your call. But if you know, you can find yourself in trouble.

    what if i get gifted a firearm, and i haven’t finished my 3 year wait period after my withhold of adjudication probation? i finished everything thought, probation and my community service, my case is over.. can i legaly carry? but not purchase from a gun dealer?

      What was the conviction for?
      And if it's for one of the misdemeanors that prohibit you from carrying in public for the three years, you can still buy, if you pass the background, you can still carry in your home or vehicle. Gun must remain "out of plain sight". Private sales are still good to go.

      It Was A Felony, I Wasnt Convicted, I Did 1 Year Probation And 75 Community Service Hours, With 4 Months Of Counciling Classes, I Finished Maybe A Year Ago Probation, I Got Denied For My Firearm And They Told Me I Have To Wait 3 Years, I Understand That, But Is That To Legaly Buy At The Store From A Dealer?     You are absolutely wrong, and if you truly believe that you need to do some research. I have been approached by LEO's from an adjoining county about a firearm I sold legally, thru an FFL in my county, that turned up in a drug bust in their county. The Detective working the case showed up at MY front door wanting to know if I'd lost a gun or given a gun to someone. After questioning him about what gun it was I realized it was one I'd legally sold. How did he come to me ? He read the system wrong as to ownership. ! HE READ THE SYSTEM WRONG AS TO OWNERSHIP !... Gun sales ARE in a system, which qualifies as a registry...

      I've back tracked guns found at crime scenes. I'm a criminal investigator in the state of Texas. There is no system. Not in Texas.

      LE /FBI can ask the manufacturer (Smith &Wesson) about a gun sold with serial number xxxxxxxxx. The manufacturer then says this was sold to FFL xxxxxxxx. They then ask the FFL about that serial number and the FFL then says we sold that gun with serial number xxxxxxxx to John Doe in Pudunck Texas. Then Law Enforcement comes to John Doe and asks about the gun. There is some paper trail and investigation first , then they find the end user.
      Always a good thing to report your gun stolen if in fact it is stolen so when it is used in a crime you have proof that it was stolen and reported.

    This is where I get confused. So there is no Gun registry. Ok good. "BUT" let's take ur scenario if a gun is left at a crime scene. And some agent comes and asks " where is this gun that u purchased at XY gun shop? ". So wouldn't that be considered a registry? A gun purchased by you under ur name? Isn't that the same thing??

      If they run it in the NCIC database it will only have a return if it is stolen.

    Wait so how about in California ? If someone purchases at a gun store are you saying unless they subpoena the bill of sale they can’t confirm if you actually own a gun or not ..? That seems like keeping tabs would be like the next thing after getting doj cleared. So if police come to your home asking to turn in weapons theirs a strong chance they are just fishing for you to surrender. !? Wow any literature specifically in California would be outstanding and totally appreciated !! Thank you, and now off to the Internet to start researching this…

      I'm not sure what the specific firearm transaction process in California is, but the ATF can go ask for FFL records.
      Under the 4th amendment, law enforcement can ask a private party for whatever tangible property they want, to include private documents like a bill of sale. A private party is not compelled to provide the property. Except in a few cases where you are suspected of committing a crime and you are required to identify yourself. The 5th amendment also protects you from being required to say anything when being questioned for a crime.
      If they ever go ask you for your guns, by then they may have already gone to every FFL that has run your info to see if you purchased a gun.
      Then they can ask for the corresponding form 4473 firearm transaction record from the FFL.
      Are private sales legal in California?

      @@PrimalDefenseCo so how about when law enforcement finds a firearm or they seize one as its part of a crime investigation, are they not able to track the registered owner of the firearm by running the serial number? To me It seems strange to think there isn’t a gun registry. It’s probably another one of the narratives they want us to buy into. Unless there’s been some court cases that has prevented the govt overreach I can’t see them just voluntarily handing over control. There’s more than we know.

      @@JD-zl2ec they can trace them back to whoever purchased it from the dealer the manufacturer sent it to. For instance they go from:
      Maker, Remington for example to the Distributor who buys from Remington to the dealer who buys from distributor to the customer who bought from dealer.
      But if the customer sold it in a private sale they need to go find that person now. Thay may never find that person.
      The Government does not have a database where they can plug a serial number in and know who bought it/sold it. There is no name associated with a serial #. Unless it was entered as stolen on behalf of the owner.
      I mean can they find out, sure. Will they always, no. Is there a database, no.
      If that makes sense.

      @@PrimalDefenseCo it does but leaves the question who has access to this “data” my uncle had a situation and the police had come to his house asking for his firearms. They said they “knew” he owned firearms but they had no warrant and he didn’t respond to any of their demands. It made me begin to start questioning first does local law enforcement have some sort of firearm database and if so who else has access, or was that just a tactic to try to get him to either surrender or give them pc or enuff for a judge to get them a warrant. It just got me thinking. Apparently in 2016 the A , T , F had began storing firearm info that was subsequently later “destroyed” per congress direction but these days there’s no telling as the info once made digital it’s nearly imposible to truly confirm permanent deletion.

      How are you selling it? In person?
      Private sales of long arms are legal in this state. Including to folks who live outside of the state. As long as you are not purposefully selling it to someone who cannot legally posses a firearm.
      You just can't ship it without an FFL.
      The sale of handguns are limited to state residents.

      @@MeekaL Federally you are good as long as you are not violating Georgia state Law. Generally, private transfers are legal in Georgia as long as you are not intentionally selling it to someone you shouldn't sell to.

      In Texas, no registration. And you can carry it. The gun is not under anyone's name.

    So isn't that a problem that if i could sell my gun like a TV to anyone, than someone who may not be allowed to own a firearm or someone who has ill intents can skip the whole background check system and get a firearm.
    Just as a personal privacy issue, who is letting someone from a private sell photo copy their ID or any personal information?

      That's where the individual can decide who to sell it to. Or choose not to sell it.
      Same thing applies with ID. If they don't want to show it, you don't have to sell it. They have to show it to a dealer. They either want the gun or they don't.

      There's gotta be something we can implement to make our communities safe than ignore flaws in our current systems and pray for the honor system.

      Police find it, they can prosecute. The problem is courts, prosecutors, and or law enforcement agencies refuse to follow through sometimes.
      Changing the way we vote is a start.

      @@kage2907 well, as long as people lie on the 4473 form, there will always be a loophole.
      I think the first step would be to enforce the laws we have.
      There is no punishment in some instances. And probation for aggravated robbery is not punishment enough.
      We need to stop letting people walk.
      There are issues surrounding firearms. And the solution starts at home.
      Followed by no nonsense punishment for serious gun related crimes.

      Only a long arm. Unless you have the firearm transferred to an FFL dealer in Texas who then transfers to your relative.
      Under the law, we are not to transfer handguns to residents outside of the state that you are in.

      You are good. No paperwork needed. I would make note of it at least. Name, Date, time of transaction.
      At least you are good to go in Texas. Some states may have laws against that.

      That's a tricky question. Yes and no. You can purchase a handgun as a gift. But you cannot purchase a handgun for the purpose of transferring it to someone who cannot purchase one. You cannot buy it for someone else.
      You can legally possess, but as an 18 year old, you cannot purchase from a licensed dealer.
      I would not think to hard on it. I would go about my business as my dad and I see fit.
      You and your pops will have to come to reasonable conclusion on how to go about it.
      People under 21 who work for federal Law Enforcement get personal handguns somehow.

      Being convicted of certain offenses are lifelong sentences. And in some instances the punishment is not nearly harsh enough. Such is the case with child predators.
      Felony convictions and domestic violence convictions sentence you to a life of not being able to possess a firearm.
