Homeowners Association Tries to Ban Independent Website & Free Speech

- President's legal action to shut down resident run community website cost HOA $5,000 in legal fees to homeowners in this unsuccessful bid.
TheWoodlandsTamarac.com had been operating for 3 years providing news for the community in Tamarac Florida. It had several disclaimers on it that it was not affiliated with the HOA
At the May 2013 HOA Meeting after the HOA President hired an attorney to
serve a resident with a cease and desist notice to shut down her website, the President would not allow the homeowner's husband, an attorney, to speak on her behalf at the meeting,
Nor would she allow any other residents to speak.
Her contention was that our Association Meetings do not fall under FS 720 which allows residents to speak.
This is incorrect:
An HOA is a not-for-profit corporation created pursuant to Florida Statute Chapter 617 and regulated under Chapter 720 for, among other reasons, the purposes of owning, managing, maintaining, repairing and/or replacing common property of a HOA community.
From time-to-time over the years, Florida legislature has tried to resolve the differences and conflicts between 617 and 720. There are still a few conflicts but precedent is set that
'If there are any conflicts between the two, the language in Chapter 720 shall control.'
Therefore, forbidding homeowners to speak at our HOA meetings is in violation of FS 720.

How do you propose maintenance on condo's and townhomes without an HOA? Without collectively paying for repairs nobody would pony up cash and everyone would expect other people to foot the bill.
Any potential buyer of a home in an HOA community needs to attend at least one of their meetings before signing on the dotted line.
Yes. That is something I have seen with buyers lately. They are also going to any public sites to find postings and reviewing the News Letters and Websites for HOA or COAs.
Unfortunately, that usually doesn't happen. They are only required to have four meetings a year and then their Bylaws usually bar any non homeowners, renters or hired management companies from attending any meetings.

@@SuperHeroSewing I would say legal because a homeowner doesn't lose their Constitutional/Civil/Liberties and Rights just because they live in an HOA or COA. However use caution on how you develop your website. You will attract anarchists, trollers and spies working for your board. You may want to use a professional website developer who can plan and put in safeguards to protect your website and those who post on it. You will want to be able to post photos (A picture is worth a thousand words) and Photos or downloaded correspondence (Letters, News Letters, other documents) sent to posters by the board. I would also suggest that you investigate any negative reports about the HOA or COA attorney or management company hired by the board.

Another reason that I do not like Home Owners Boards, I do not want to be involved in anyone's business, what they do in their home and what I do in mine are each other's businesses.

My HOA is pretty good. It's full of laid back people who hate busy bodies. The HOA president is a retired Infantry sergeant who hates people and wants nothing to do with them. He likes me because I'm also a retired Infantry sergeant. We both hate people. Depends on the HOA. Upscale seems like a nightmare. Have one in working class neighborhood and it's purpose seems to be to prevent druggies from coming in.

A HOA cannot force you to shut down a website that is not hosted on their server. They have no legal standing. They can make your life unpleasant if you don't comply though...

True. This video taped meeting shows how the board demonizes residents and blocks their speech. The more the public sees this type of truthful bad behavior of the Directors on boards the more the laws will change to benefit the homeowners.
When you buy a house with a HOA you don't own it, you only paid to pay rent.
If you "buy" a home where you have to pay property taxes, you're only paying rent.

"The Woodlands Homeowners Association (WHOA) is not a homeowners association..."

He can sue the resident if he representing the HOA in a lawsuit against that resident . The attorney suing on their own would be conflict of interest.

@@justred5164 I was shocked and mortified to find out in an HOA Legal Seminar that the HOA Attorney is indeed hired to "protect" the HOA Board and its Directors. And does not represent the actual homeowners. However, a malicious HOA Attorney who encourages Directors and/or engages themselves in malfeasance acts is easy to sue and often is. (Looks like we have a troller...)

The first problem is the sheer number of people on that board. That's insane. I've served on boards with five rational members. We did not have near these kinds of issues. We also did not have blue-hairs walking around with clipboards looking for violations to write up.
