I have told this many times. I had an HOA advise me that they had voted my property into their HOA and that I had 30 days to come into compliance. I sent a response that I was not part of their HOA. 30 days later I started receiving violation notices in my mailbox. I sent a cease and desist letter. A month later, I received a notice of intent to seize my property if I was not in compliance in 10 days. Two weeks later I received notice of a scheduled hearing. At the courthouse, the attorney for the HOA recognized me and asked if I represented the homeowner, and I told him that I was the homeowner. I told him that I was not part of the HOA and they had been advised of that in writing several times. In court, the HOA president told how I had ignored all notices and refused to pay fines. When it was my turn, I asked her how long the property had been a part of the HOA, she gave the date they had voted my property in. I asked her if she had membership documents signed by me. She said "No, you refused so we voted you in" The judge, and their attorney both said HUH ? ? ? I then asked her about putting violation notices in my mailbox and she said that was the only way since I refused to install a notice box at my garage door. I asked her if she realized that putting main in a US mailbox was a federal crime. She said "not in a HOA" I saw their attorney shake his head. The judge asked her how she thought that the HOA could vote someone in without their consent, she said the annexed the property according to their by-laws. I asked the judge for a judgment as a matter of law, and consideration of my counter-claim. The judge said "granted to both, state your counter-claim" I outlined my compensatory damages, and then asked for putative damages in the amount of $5000 per violation notice, and an additional $10,000 for the frivolous case. The judge granted $350,000 in putative damages, and just over $50,000 in actual damages for time, and earnings lost responding and researching their claims. HOA woman said that the HOA could not pay the judgement. I told the judge that I would accept the vacant 20 Acres of association property adjoining my property with the release of HOA claims. The HOA voted the next week to release the property and remove Caren (Yes her name is Caren) as HOA president. I found out that she wanted my property as access to the additional acres the HOA had purchased to build additional homes to sell. Subsequently, the members of the HOA voted to dissolve the HOA as without the additional anticipated acreage income, they could not continue to fulfill the HOA obligations. The entire neighborhood (save a few) is much happier with the HOA gone.

They basically own your land in return for basically nothing…. I grew up and lived in my own HOAs and it was absolutely bonkers how much money they had laying around while milking us. One had over 75k and the roads were falling apart, no street lights hardly, vegetation was growing over shared spaces, and so on. The whole thing is such a racket it’s insane…. Private ownership and consumer rights must be established. The HOA is not entitled to land I purchased that was signed off to them over 2 decades ago

When and if you bought into the HOA you agreed to all their rules and regulations so if you paint your house a color that is not approved then you will change it or get fined and a lien on your home. Very simple concept. People voluntarily joined when they bought and again agreed to all the rules. Sounds like most people do not to their research then complain

All new residential developments have HOA, builders are required to establish HOA's as a requirement of the city or town approving their building permits. HOA management companies & HOA Lawyers who make millions off HOA fines and fees can steal money from homeowners. It's just a way they could still collect property tax from the homeowners, you can't escape from them unless you buy a house that wasn't made in the recent years. (Somewhere mid 90's?) Of course this differs with every state, but HOA should really not be a thing, it's just a guilty-free way of stealing money.

Not one state or county or city can legally require it. It is purely up to the developer at his discretion. Although most choose to because they think that is a selling point and people want to live in an HOA. There are good HOAs and bad HOAs depending on who is on the Board and who the management company is. I live in a wonderful HOA, I did my homework first...

Many HOAs still demand watered green grass lawns in drought-stricken areas (and do not miss a mowing lest you be fined!) and deny permission for EV outlets. Some demand that you leave your garage door open during the day. Seems like madness to me.

If you signed the HOA contract and don't pay, they could place a lien on your house and eventually force a sale or foreclosure. In any case, a lien would have to be paid if you wanted to sell. I've never seen an HOA contract, but having worked a long career as a paralegal, I bet the contracts are very long and include such provisions for nonpayment of fines.

They certainly do. At some point, you did sign something (especially if you closed with a title company/attorney). But even if you didn't the property is in the HOA covenants, regardless of who owns it.

Bought a house in a small development of 6 lots. Didn't know of the 20 pages of rules HOA. Couldn't have more than 2 pets or build a fence without a majority vote of owners. The house was on 2 lots so I bought a vacant one cheap because the guys house loan fell through. Then bought the one next to mine. That gave me 4 out of 6 votes so they can kiss my @#$%^. I do what I please.

Welp...if you can find a title company to close on the home when you sale, I guess you could technically sell without paying the fees you owe. But liens are usually found by title cos and attorneys, so will be tough. Good luck either way.

I just wanted to ask if it is normal for all HOA members/homeowners to be paying for HOA transfer fees under a developer led board. Administrative expenses for our HOA went up tremendously and according to our management company it is because of the new owner/resale set up fee. Our administrative expenses in February were $150 and went to $2500 in March. Doesn’t the seller or individual buyer pay HOA transfer fees?

Ummmm, you never get nothing... do you like roads, street signs, lights, fences, monument signs, landscaping...? Take the time to review the budget when it is distributed and look at what operating and reserve costs are budgeted. It will never be nothing.

Yeah theres a house on the corner thats dilapidated and the occasional loud party. But for the most part ita safe, secluded, only minutes to downtown on a BIKE and im free from hoa bs. Yeah no hoa means your gonna have a few eye sores but who cares????? No hoa karens measuring my grass to the cm anymore. I've never seen an HOA contract, but having worked a long career as a paralegal, I bet the contracts are very long and include such provisions for nonpayment of fines.
Find out who your local HOA board members are. Where they live and start ordering thousand pizza every day to their house. Use a bot that has a conceal phone number linking to their actual phone number to request pizza within their name.

H.O.A, na that’s just renting when you have to ask permission to modify your own home and they can kick you out with fees or in a couple of cases they sold the persons house after a person was super delinquent on fees. @@JustDaveslotsif your home is sold into an HOA (which often happens before you buy it so you have no control over it), you have no choice but to sign the HOA contract and pay the dues if you buy that house. Most neighborhoods have HOA’s now, so it’s almost completely unavoidable unless you want to pay hundreds of thousands of dollars more to buy a home outside of one.

HOA im living at its like having no HOA. Everything in have summitted has been approved. They only manage common areas and besides that they don't really bother you aa long as you arent painting your home hot pink. The fees are low too. $37 a month.

As the man (Gen 1:26-28) KJV, a husband (Gen 2:21-25) and a father (Gen 3:16), the minister of God (Rom 13), teacher (Eph 4) and one of the survivors who was bullied in school, I had never heard of HOA until recently and have read nothing but horror stories about it charging homeowners fees, turning everyone's place of peace into an absolute daytime nightmare. I personally would never purchase a house where I have to continuously deal with Freddy Krueger while I am awake. Man likes peace.

That's a great question. When you sell the house, that's when the lien is felt. You won't be able to sell the house free and clear until the lien is taken care of.

Developers don't own HOAs for the most part. HOAs are like businesses and can get bought...go to BuyBuySell and search for HOAs to buy to see what they look like financially.

Bought a house in a small development of 6 lots. Didn't know of the 20 pages of rules HOA. Couldn't have more than 2 pets or build a fence without a majority vote of owners. The house was on 2 lots so I bought a vacant one cheap because the guys house loan fell through. Then bought the one next to mine. That gave me 4 out of 6 votes so they can kiss my @#$%^. I do what I please.

Fraud does happen...in most places really. Now, what you can do is see the financials of the HOA. Those are typically on their website. Now how accurate are they? That's a different question...

Welp...if you can find a title company to close on the home when you sale, I guess you could technically sell without paying the fees you owe. But liens are usually found by title cos and attorneys, so will be tough. Good luck either way.

I just wanted to ask if it is normal for all HOA members/homeowners to be paying for HOA transfer fees under a developer led board. Administrative expenses for our HOA went up tremendously and according to our management company it is because of the new owner/resale set up fee. Our administrative expenses in February were $150 and went to $2500 in March. Doesn’t the seller or individual buyer pay HOA transfer fees?
Who pays the transfer fee is negotiable. So it can be the seller or buyer.

No, you don't really own your home, you buy the right to occupy it, sort of like owning an apartment.
Ummmm, you never get nothing... do you like roads, street signs, lights, fences, monument signs, landscaping...? Take the time to review the budget when it is distributed and look at what operating and reserve costs are budgeted. It will never be nothing.

Never ever buy a house in an hoa!! I bought in an older neighborhood just 6 blocks from downtown.NO HOA!!! Yes, there are some houses that are in terrible condition. But its gentryfiying and almost my whole street is brand new homes.My house is fenced in from front to back. Its my own private oasis that i can do whatever i please with. Yeah theres a house on the corner thats dilapidated and the occasional loud party. But for the most part ita safe, secluded, only minutes to downtown on a BIKE and im free from hoa bs. Yeah no hoa means your gonna have a few eye sores but who cares????? No hoa karens measuring my grass to the cm anymore. My husband can park his work truck in the driveway now and we have fenced ourselves in and have landscaped exactly how we want. We plan to build a casita in the backyard soon. I laugh at the suburbanites who have to deal with these absurd hoas!!!!
