I just got a judgement on my comp case and the judge approved the settlement. I know they have 30 to pay me my money but will they take the hole 30 days or dose insurance companys typically mail out settlement checks asap. I know there is no telling but im wondering if its a tipacol thing to have to wait the full 30 days or do they jump on it and get you your money asap. Anyone out there can tell me from experience or because they have saw or hurd about a case?
Usually they pay in one to two weeks. Technically they have 30 days, but usually the adjuster will get the check out ASAP so they don't risk being in a penalty situation. Also, some insurance companies actually have contractual rules in place for their defense attorneys that require settlement payment instructions to be transmitted to the adjuster within 24 hours of judicial approval. This is to ensure that checks are sent on time. Hope that answers your question.
In CA, the payment for the lawyers only comes into play if you are awarded a settlement via Stip or C & R. The amount comes from the award, never from your pocket.

Generally, a stipulation (open medical settlement) is an agreement to the permanent disability rating and permanent disability benefits are paid over time.
