In Episode #97 of the Work Comp Talk podcast, host Carmen and co-host Bilal Kassem tackle critical workers’ compensation issues faced by seasonal workers, especially during the holiday hiring surge.
They break down the differences between seasonal, part-time, and full-time workers and clarify what workers’ comp benefits seasonal employees are entitled to if injured on the job.
The discussion dives into common injuries in the shipping and transportation industries, including overuse injuries, slips and falls, and even dog bites, while explaining the nuances between temporary and permanent disability benefits. They also explore the complexities of settlements, such as the reversionary interest in future medical care settlements highlighted by UPS as an example.
Carmen and Bilal emphasize the importance of reporting injuries promptly, seeking medical evaluations, and understanding that seasonal workers have the same rights to workers’ comp benefits as any other employees-regardless of how long they’ve been employed. Point is were human trust into a whirlwind with absolutely no experience and hurting to boot we ain't looking for a Jackpot or a lotto wind fall for becoming a American With Disabilities............................... We want our abilities back fuck a dollar cause workers comp shortly is not the thought process believe me we'd rather stand on the lotto line in Pain no meds and no chance of winning than to deal with workers comp the insurance company and they're lawyers!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! So You, To try to hold us in higher regard you, know hard working People who were very unfortunate to have to Deal with Workers comp !!!!!!!!!!!!!!!!!!!! Happy new years!!!!
So you two, your Young. And theirs not a one of us on the Planet especially myself who has not said something's in talking, fore that's what to much talking does one finally shows up as a asswhole with the Proof he/she is a asswhole by the hurt feelings of others and I Put me on the top of the list who's been an offender of others with words and then I did a miraculous thing I actually reflected on my conversations self analysis and stated in all honesty realized some if not most of what I said didn't even make sense. Arrogance talking cause I had lips and ass you, can see I haven't lost my touch 😢😢😢😢
While listening to the dialogue one thing Pricked my spirit as one who's been denied and still fighting to get medical treatment paid by the company I worked for, as well as medication and weekly payments my thoughts went to Indignation because shortly anyone who, taken a dip in pay having to go back and forth to see God knows how many specialist this syc this appointment, that appointment to be in chronic pain for months and in some cases years lose the job because of injury while life screwed!!!!!!! Turned upside down the on top of that have to deal with a crappy insurance company and their lawyer Certainly Were Not thinking were gonna hit a Jackpot and get rich money is the last thing on our mind!!!!!!!!!!!!!!!!!!!!!!!!!! After dealing with all those horrible individuals I'll tell you, what's on our mind and it ain't Money Cause the horrible people I'm talking about is the people on the job supervisor who's the first line of the companys defense to see to it that one doesn't get any next up is the insurance company and their lawyer all make it know we're here to stand in the way of one receiving anything,or semblance of human treatment like medical care so if they don't have your health welfare, sychological we'll being in one best interest in mind, and by the first 21 days weve been made well aware of that fact I'm saying to myself how in the world could you, sit and think in any conscionable way that money is even a thought in our minds!!!!!!!!!!!!!!!! Ump after interactions with the above mentioned demons named by what thier actions uphold I'll tell you, what's on our mind ( God ) Please take the Pain away!!!!!!!!!!! Then it goes to God, can I have one day of No Pain!!!!!!!!!!!!!!!!!!!!! Just one day of full total no Pain!!!!!!!!!!! Then it goes to now in my 30,40,50,60s and up I'm Piping f pills all day what a blow on the ego and embarrassing, traveling let's not forget traveling to and from sometimes with and sometimes without a loved one and not getting treatment cause you, have no one to take you, home I'm damn near crying right now at 2:37 am Yea they reached the corners of my eyes.and just the whole idea of travel it takes me 2.hours.and then your hit with the denied for what ever reason ump Your Talking about jack posts lotto shit who gives a shit about lotto and jackpot naw the first thing we want is all of y'all outta our face for life don't ever wanna see none of you, as long as we live cause You've become horrible People!!!!!!!!!!!!!!!!!!!!!!!!!!! Now we love all the loving Dr.s who find a way to help take care of us in spite of the red tape them and their staff we love and they become our extended family!!!!!!!!!!!!!!!!!!! And we Thank God Fore them,!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! So this is the order of things insurance companies defense lawyers for the company outta our, face their more painful to look at them The pain we experience!!! Wake up one day soon like today and wala pain gone!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
So in my state you cannot sue your employer in the workmans comp case? Even though part of the initial injury for example is due to a broken brake system idk in a fork lift ab c d .I'm just so confused. Massachusetts is insane the stigma around this situation is horrible to live through. Taking advice applications
Not only are they cheap, in consistent with 700 claims per 1 person. I had to wait 3+ months just to receive my first payment. Id rather my entire foot fall off while injured on the job then to ever apply for workmen's comp again. They could careless if you become homeless starving and stressed. They'll get to your claim when they feel like it. My insurance claimer stated it takes them at least 4 years to learn the system with 700! Cases per insurer
After 45 days imelts
Where can I find the full video? Thanks.
Thanks
Hi guys. Good info I live in New Jersey How do I know if an attorney has good experience and is licensed in workers' compensation? The future of a person( workers) who has been injured is in the hands of a good or inexperienced lawyer. Thanks Happy New Year . I saws almost. all your podcasts.
Very interesting that you mentioned a person that fell from three stories. I fell from 10 ft. When I first saw the doctor he had no problem. Now we're 9 months into it and he's trying to tell me it's my age. The reason I'm feeling the pain they've done absolutely nothing for me except PT. I keep asking for pain management. It finally got approved but doctors being really mean about it and saying it's not going to help me. Anyways I just need to get back to work like if I didn't fall from that high
Last week my hand from my thumb pointer finger and my arm go numb. This information is great because my grandpa said if I got surgery I would have to take off 30 days of work which financially I cant so this is great information.
Long story short, I was made a settlement offer at 20% loss, I wanted to get a final evaluation for peace of mind and a better overview of my injury, the evaluation came back at a lower percentage, then the adjuster said I rejected the offer and came back with a much lower offer. Lesson learned and I'm still fighting it.
It would be great if you were servicing San Bernardino County. I'm currently searching for legal representation but alot of the callbacks I receive seem to have no idea about petitioning for penalties or ANYTHING. Workmans comp and civil lawyer needed! If you know of any competent lawyers you can recommend, I would appreciate it!
How can we get mold exposure physicians on the MPN list ?
I’m dealing with it now severe car accident. 3 injury wc
👏🏼👏🏼👏🏼
Same! 3 years 2 back surgeries and now needing a major lumbar fusion and they're trying to offer 32,000 settlement! Bahahaha! I'm not giving up nor is my attorney
10 yrs on work Comp ask for a knee replacement in 2017 now getting it in 2024 and IME said nothing wrong with my back mild L1-2 bulging mild L2-3 facet injury L4-L5 minor degenerative changes what's with this minor/mild BS no sex and pain all the time after falling downstairs WORK COMP hates me!!!
I’ve been on my Workmen’s Comp. case for almost 4 years and I’m not giving up. I refuse to let them beat me.
What do they cover than if no wages. Mosy of it it gets lost fro. Waiting
I would not hire this guy.
Would you hire this guy as your attorney? Iron Maiden t-shirt is not giving me warm fuzzies...
Please do a video: police officer heart work comp case moved to the east coast. Cannot find a doctor I like. Upset I cannot just use my original medicare and choose any doctor. How about switching to a medicare advantage plan and not have to deal with worker's Comp.
Thats abit dumb? If you cant afford a surgery how are you gonna afford an attorney to help with workerscomp
Is he little drunk?
So for instance you guys brought up going to the gym. My doctor has given me no no restrictions but I am totally and temporarily disabled but he is telling me I should go to the gym and exercise that I need to build my strength back up so that I can go back to work. That's a problem if that's what he's telling me to do cuz it's not in writing he just tells me
It seems as though you guys never get back. I respond to questions we ask so we like your videos. They're very helpful but then we have questions and nobody answers them. Sometimes we answer each other, but we want to hear the perspective of the law firm. It would be really nice
If only someone invented a telephone or a phone number to call for inquiries
@@GDOG951-p4mYou know what David is saying. You having a point does not mean he doesn’t
@@commentbeast3985 I think we should be more appreciative than demanding. We should be thankful they are posting on here giving us free insight to FAQs we may have. I think wanting them to be chronic TH-camrs is too much to ask for lol If you have questions on a LEGAL matters you should give them a call and not expect a consultation through a social media application
Please do a video on work comp and federal employees 🙏🏻
For instance I'm on workers comp. I've been on workers comp for 7 months. I fell from 10 ft high. I have PTSD from the fall. My workers comp doctor keeps requesting behavioral health and they keep denying it. I need help. So I finally went to my own doctor and he's authorizing behavioral health. I got to get help. It's serious and they're not taking it serious
This needs to change! I'm currently dealing with a WC insurance company that didn't pay me for a month, denied surgery at 1st, then denied physical therapy at 1st and is now withholding my check for no apparent reason. These pukes need to be held accountable!
Instructions unclear. The attorney got me
Even if you don't actually need an attorney, get an attorney.
Even if you don't actually need an attorney, get an attorney.
Bilal you soooo smart is like you being a lawyer for 50 years
What happens if I accepted a new job offer online and signed the job contract online, but I have not physically started working yet? Does this count against me in my workers' compensation case? I’m under pressure because I have no other source of income, no EDD assistance from the government, and most of my savings are gone. On top of that, the workers' compensation insurance carrier denied my case, and I’m still waiting for the state-appointed QME doctor to evaluate me.
you guys are full of shit
What are the reasons I might need a re evaluation? N is it a good idea to proceed with the revaluation?
Nightmare in California, don't get hurt.
This guy is soooo smart iam spechlessss
Am I the only one loving the fact she is using swear words? I love her genuine questions and approach to this educational video.
Okay so I was recently denied treatment for psych therapy. I recently got the letters in the mail for what they did approve which was today and I'm looking for the denial and I do not see it but yet I know they denied it cuz they emailed it to me. I told my attorney they denied it. She said they need to be notified. Do I need to request this form?
Okay so I got a question. I was recently denied psych treatment from my injury from falling from 10 ft high which I'm suffering from PSD which the doctor understands and ordered. I should be getting this form along with my attorney or what happens next? Or should I request this form cuz I want to appeal it. This is a real thing that I'm suffering with. I can't even drive. I'm scared of driving over the mountain cuz I think I'm going to fall again
15%? More like 40%
You need a lawyer cause you ain’t no lawyer. You need a lawyer.
100% you need a lawyer to help you navigate the workers' comp system.
"let's go to Starbucks. Don't worry, you don't need a lawyer"
Thank you for you comment, thought everyone might find happiness at Starbuck, you can't find the right help for you workers' comp claim. :)
Of course a car salesman says you need a new car. Duh! It's not like DEFENDING YOURSELF not an option...
Believe it or not, people will not realize that they are being played by other parties in the workers' comp system. Thanks for your comment.
Does this include being injured by a patient, especially if you kept warning the company you worked for that that patient was threatening employees?

To add to this say you have a bariatric patient on faulty equipment.... you hurt yourself due to improper equipment you had reported issues with for 3 days i na row.... ugh sos
Thank you for sharing. Would you have a conversation to share about Workman Compensation and Long Covid.
Hi, thank you for the comment. I will definitely add this topic in our upcoming episodes.
Tell Carmen I said hello 👋
hiiiiiiii! :)
Hi , I’ve had two surgeries elbow and rotator cuff the same time.I’ve collected Workmen’s Comp. checks for a little more than a year I had my final doctors visit and all I am working without restriction it’s been six months will they offer me a settlement
Have you seen a QME yet? Normally your Primary Doctor (PTP) will say that you are MMI at some point. This means that you have leveled off medically. Given what you describe it doesn't seem like you would be discharged from care without future medical. When you are MMI, you are typically assessed permanent disability for functional limitations. You can have permanent disability and return to work without restrictions. Once you have leveled off, the adjuster may offer a settlement based on your PTP, but usually you can do better with the right Qualified Medical Evaluation (QME). Sometimes the PTP will write a good report for you, but we can't tell without seeing it. We would be happy to take a look at your case and give you a better answer with specifics. You can schedule a call at a time that works best for you, here is the link pacificworkers.co/book-your-appointment. You can also call the team at 800 606 6999.
