    If you have a workers comp injury and during rest and treatment the pain goes away as long as you don’t over use it, is that considered a zero rating ? and can you still receive a payout settlement? my issue is that my symptoms come and go and most of the time when I go to my doctor, I have milder symptoms, but a couple days later I will be in excruciating pain. It’s so annoying.

    I worked for my primary job for 7 years got hurt at my secondary job ptp said i was allowed to work with Restrictions but do to my injury i wasn't able to do both job primary job made Accommodations Second job wasn't able to accommodate at first then offered work months later do to the injury i wasn't able to do both job its going on 2 years was i Entitled to something i live in california

    I don’t know if you still check the comments here but… My husband had a fall at work and is being told he’s going to get compensation for pain and suffering. He broke his elbow ( diagnosis was missed and found 6 weeks after injury) he worked for 6 weeks and drove 100 miles to work each way with a broken elbow. Finally got into an orthopedic who ordered an MEI for his right hand and found another broken bone (scaphoid) also has multiple tears in 3 ligaments. He had surgery on his right wrist for Tcff tear and to repair the scaphoid. He still shows tears in both arms left with neuropathy in both wrist. He obviously had limitations that sucked for those 6 weeks having to buy tools to wipe after using the bathroom and at times needed assistance. I am wondering how the $ amount is calculated and what that should look like. He is in construction and it’s been 15 months since the injury and he is still not being released to go back to work

    The best advice in this video is educate yourself as to the workings of your states workman's comp system .Your attorney works for you and not you for them.The injured worker is the ultimate decision maker in many aspects of the entire process.

    Thanks for your professional advice on QME and AME. It was very helpful since I have one coming up in Nov. I was wondering if you would discuss EMPLOYERs which can't or don't have work accommodation limits which have been placed by the insurance doctor. My employer told me they could give work accommodation however that's not been the case, and has me sitting around for 8 hours in a day. Sometimes I may work on a project and finish before my eight hours and my Supervisor will tell me I can leave if I want too. What would you advise?

    My provider just told me to request assistance for my case. I am receiving in good faith permanent payment at 580 every other week. But they are denying any more medical services including an evaluation with a spine specialist. I have multiple issues on my cervical and back area. My doctor is suggesting social security permanente disability. How can I talk to you

    Have an antalgic gait since knee injury let W.C. Dr know walking with bent knee is hurting hip back in 2018 now back hurts hips hurt other knee hurts .Now radiculopathy in both legs and hands epidural didn't work in lower back facet injections caused testicles pain then had injections in testicles nerves, walking with cane has caused shoulder pain now shoulder needs surgery 😢 what a nightmare, why couldn't they take me off work 2019 after failed arthroscopic.

    When it wakes you at night, its time to take notice. The surgeon tells you "back to work in 2 weeks". DON'T DO IT. It'll still be too painful to use in 6 months, twelve months may be less painful, but try acupuncture instead. Avoid the knife at all costs. Ask me how I know. 😖

    I've never ever imagined having to go through WC - listening to you guys - I had no idea people were going through the kinds of hardships discussed here - I'm so glad that I got with Michael Burgis and Associates when I did. Nothing has taken long - I had no idea - I'm going to express my gratitude to them in the morning. For sure.

    I retained Michael Burgis and Associates - I believe my going with them sped up this process quite a bit - every thing jumped off almost right away. I was out of it - they went to work - I started receiving temp disability payments about 2-3 weeks later. I'm currently going through it - I don't mind the 15%-18%

    I'm in CA. I was injured at work. I had a law firm for WC the person who represented me for my depo. spoke with the lawyer from my employer before the depo, then my representative told me if I would like to settle before moving forward with the depo. I was also told this would settle for about $10,000. Since I had previously injured the same body parts. which was a few yrs ago. The previous injuries where not with the same employer but in the same work capacity. However, this jury I will need surgery for a partial tear to my rotor cuff. I was not happy to when my representative was so ready for me to settle. I decided to find another law firm. Now with the New law firm things are going very slow I had 3 depos and my injury has still the same. I feel as I'm just getting nowhere, help!!!

    Thank you for the video. Couple of things the employer at least with my company which is a very large company Will give incentives to the employees every quarter. So not only do you have your boss getting mad at you because it affects their bonus and their bottom line. For example, corporate will hit their bottom line by $10, 000 which will affect the matrix and they'll just miss the mark. Then your co-workers get mad because maybe that quarter they were going to give out company jackets so they make it appear that it's your fault by posting in the break room or by the time clock that the last accident reported on such and such date cause us to not get our jackets this quarter. So yes they do make it feel like it's your fault even though they're not straight out saying that.

    If you get a 13 percent loss of a finger that you have had 2 surgeries on and not working can your attorney fight for you to get a descent settlement even if the QME is minimizing your loss!!??
