- In this video we have discussed about the 127th Amendment bill, which is now the 105th Amendment Act of the Indian Constitution.
This is also referred to as the OBC bill which has been passed by the Parliament recently. The video tries to explain the provisions that are inserted by the 105th Amendment Act. How an Amendment Bill is different from an Amendment Act?. How will this amendment benefit the Socially and Educationally Backward Classes or as we know them OBCs? This will also explain the relation between the Maratha reservation case with respect to 102nd and 105th amendment to the Indian Constitution.

1:06 : you are WRONG . Political reservations for Scs & Sts was for 10 years initially and it is provided that if found necessary it can be extended by another 10 years and so on. It was not fixed for 70 years. There is no such periodic limitation in respect of reservations in jobs n education…

The initial reservation were only for sc &st article 15(4) and article 16(4). OBCs were included in the ambit of reservation in 1991 article 15(5)
Exactly obc was implented in support of BJP by VP singh govt and EWS was provide by Modi govt also OBC consist of 27%, it should be removed only reservation for SC ST ie 14% & 7% should be kept and 80% seats open for all

They're still backwards socially and educationally despite the reservation being there since 1991. And if the reservation for OBC should be removed then so should be done for SC ST. Dekha jaye toh they have been provided reservation for too long and hence don't need it anymore like OBCs

It was in 1951 by the Virtue of 1st Constitutional Amendment Act, 1951 which amended the article 15(4) and 16(4) to enable the state and central government to reserve the seats for SC and ST in the government jobs and educational institutions.

No ist ammendment act talks about genral advancement of socially and educationally backward classes. It's actally 93rd ammendment act which catagorically talks about reservation in educational institutions.
@@mother.95 you r right , actually this ammendment was made to nullify the decision of sup.court in champakkam dorairajan vs. state of Madras in which sc declared the law made by Madras govt in which they reserved seats in med and engineering colleges on the basis of religion ,race and caste. Sup.court declared the law to be void as it discriminates on the ground of caste etc and it's voilation of Art.15 . . Here backward includes sc and st . And other backward classes also, in both the clause 15(4 & 5)For sc and st there is a reservation since the commencement of constitution but obc had given recognition only after mandal commission .

Guys should our government really do the caste based census ? See my intension is not to hurt anyone thinking but my opinion is that if we talk about equality and all thing then why caste based census ? If the gov. not really - private jobs are free of reservations and will likely stay that way for some time ... or migrate to places like uttrakhand where UC's have high population and will keep a tab on limit of reservations.
plus government jobs are less than 1% of all the jobs in the country - it doesn't make any difference - even for the sc st obc's if they get all the seats - why ?
because if for the past 70 yrs nothing has changed - it'll not change in the coming years , the creamy layer of sc st will keep getting benefits , rest will be deprived.

You should study history of indian and polity, may be that will change your mind. Yeah the reservation system should change with time, for example shey should also add economical status of the reservation holder as a criteria for issuing the certificate.
By placing such extensive discussion on topic of "Reservation" the main subject of "Social Advancement of the Poorest Sections of Society" gets lost in the details and deliberations.

I would say EWS is the most justified reservation so far in India. It ensures the general unreserved people from bigotry who are financially weak
10% for EWS category is for economically weaker sections in general category whereas 50% is for SC, ST, OBC so this 10% has nothing to do with 50%. It is not included in 50%.

It's high time to use latest census data for reservation and re evaluate whether 50% reservation is necessary or not. Reseravation is the only barrier for indian to become developed nation..

Reservation is not stopping India to becoming developed nation. If that was so,then what is stopping India to win medal in Olympic, there is no reservations there.
It's government policy which is hindering it. India spend less than 3% of GDP in education. Education was never in a priority list to any of our government.

Shahu Maharaj was the first to implement caste-based reservation in the modern era of India. He declared 50% reservations from which only four castes were excluded: 1) Brahmin 2) Shenvi 3) Prabhu and 4) Parsi. All other castes except these were declared as constituting the Bahujan Samaj.
Then the EWS reservation also exceeds the 50% (indra sahani statement)

Reservation for first time was added by KAKA KELKAR COMMISSION. It was the first commission for granting and prividing for reservation to SC/ST in Independent India.

In light of Champakam Dorairajan judgement of Supreme Court of 1950, the Parliament (under Mr. Nehru's Prime Ministership) utilizing its constituent power under Article 368 made first constitutional amendment by addition of subclause (4) in Art 15 and Article 16 that provided reservation to SCs, STs and SEBCs in educational institutions and public employment respectively.

SECC Caste survey was conducted in 2011 by ministry of rural development and Urban development for rural and urban areas respectively but was never made public.
Correction: SECC. Also, Caste survey was under administrative control of Home ministry. But was never made public because it didn't come under '48 Census Act hence voluntary but not a mandatory.

Ews reservation is given within the general category.
The 50% mark can be relaxed in rare cases. EWS was the need of the hour. Hence it was relaxed.
Yes Govt has pointed that the aim behind was to benefit the economically weaker ones within the general category who were left out of reservation benefits due to non-eligibility and 50% mark can be overlooked with proper data and evidences for the exceptional cases. T.Nadu has 69% reservations. Ample cases are there of the breach of 50% mark.
The time has come when all types of reservations based on caste creed religion etc should be ended. The only Reservation left should be based on economic conditions and women.... The country should not demotivate deserving candidates in the name of Reservations . Vote bank politics is the main hurdle... Great political will is required to remove this evil..

@@Viraj_2305 i don't believe that's a utopian idea of providing reservation on the basis of economic condition of the citizens as we are already doing so ( EWS - 10%) we only need to identify the loopholes in the EWS portion, the criteria is set for 8 lakh per annum which covers a good amount of population! Apart from that census taken based on caste and creed itself provides for caste based distinction and the benefits of reservation often don't even reach the needy. So the correct way of implementation of reservation is actually economic based census and provisions that matches the socio- economic conditions.

@@Viraj_2305 yes i know that reservation is not a poverty alleviation programme, still does not justifies it efficiency after years of its implementation i believe now we can look forward for better methods to mainstreaming the downtrodden rather than just affecting the administrative efficiency. And why economic reservation should be provided is because they actually need the reservation to catch up into mainstream . Reservation right now is like a painkiller tablet which is just numbing the pain and not doing much for the disease. Reservation was very good policy when it was implemented but in current scenario it's a stagnant policy with very less relevance. And for the part where we want all sections to be equally representative ... we need this in parliament and legislative bodies so that they can be representative in policy formulation and not in jobs and colleges ! 49.5%(sc/st/obc). Additional 10%ews is not violating the 50%ceiling. Right??
This 10% for EWS is for general category and not included in this 50% ceiling. 50% ceiling is only for SC's, ST's and oBC's (non- creamy layer)
@CEO of Secularism 50% is not reserved for general that is unreserved it means any one can compete be it sc st or obc with general caste and can take that seats..
@CEO of Secularism that is how system works right ? If every seat will be reserved what will be the merit ? If you analyse in previous year job allotment most from obc background got selected from unreserved category !! What do you want general people should not get job or you don't want to study ?

@CEO of Secularism First of all you told that 50 % is reserved general category then you are contradicting your own statement that is there any reservations for unreserved category !! If it is unreserved it has right of everyone to compete you are unable to get anything from reserved category itself that is why you are moaning !! If not then work hard get a seat of unreserved and your reserved seat will be given to your community people !!!

Then don't take your reservation for SC/ST
EWS reservation is out of that 50% which is for general candidate..
If you leave your OBC quota and you are poor enough in front of govt. Then you can also get EWS reservation.
It is for everyone who is poor. And is not enjoying any reservation.
