I've been given a parking "invoice" from a private company, despite the fact I paid for a ticket and wasn't late back to my car. This arrived two weeks after I'd parked there and astonishingly, 🙄 I had thrown the window sticker away in this time. I emailed them on their website disputing this fine and I don't have a copy of the email because it went through their site? They ignored me and two months later they've sent another "invoice" which has gone from £20 to £155 now. What can I do about this? It is so unfair 😢

If you decide to pay them. Go to the Bank and request for it all in change and send it them in a box... I had ParkingEye charge me an extortionate £100 for overstaying by two minutes. They then took it to court and ramped it up to £185.00, I payed them in change starting from 10p.

The only reason they even have an appeal is because it’s required in the practice set out by the B.P.A.
I’m guessing you have not received a letter from the Claims Court? Unless you do you don’t need to take any action.
These companies will taunt and attempt to intimidate you into paying them. Truthfully they don’t have any power and the most the can do is take you to the Claims Court and apply for the money then you will have a month to pay the fine before it goes on your record.

So the fact that since 2022 they are only legally allowed to charge £50 max but many of them still start at 100 and then ramp it up to 170, isn’t that itself proof that they are acting illegally? Isnt this in itself grounds for dismissal
Tbh many of us if we are faced with a 50 quid fine and a chance to pay 25/30 within a specified time will suck it up and pay, it is that their fines are so unfair and disproportionate that riles us up.

Reason 7 - Overstaying - is not quite as you say.
The 10 minute grace period 2015 act did not apply to private car parks. New legislation is now in place, but it is not as simple. The current BPA Code of Practice on grace periods takes the new law into account. Here's what they tell their members:
    "13 Consideration and Grace Periods
13.1 The driver must have the chance to consider the Terms and Conditions before entering into the ‘parking contract’ with you. If, having had that opportunity, the driver decides not to park but chooses to leave the car park, you must provide them with a reasonable consideration period to leave, before the driver can be bound by your parking contract. The amount of time in these instances will vary dependant on site size and type but it must be a
    minimum of 5 minutes.
13.2 The reference to a consideration period in 13.1 shall not apply where a parking event takes place.
13.3 Where a parking location is one where a limited period of parking is permitted, or where drivers contract to park for a defined period and pay for that service in advance (Pay & Display), this would be considered as a parking event
and a Grace Period of at least 10 minutes must be added to the end of a parking event before you issue a PCN.
13.4 Unauthorised motorists will not be entitled to the minimum time period of 5 minutes for a consideration period in
spaces designated for specific users e.g Blue Badge holders, pick up/drop off or where parking is prohibited such as
hatched areas in front of emergency exits, or on entry and exit ramps etc.
13.5 You must tell us the specific consideration/grace period at
a site if our compliance team or our agents ask what it is.
13.6 Neither a consideration period or a grace period are periods of free parking and there is no requirement for you to offer an additional allowance on top of a consideration or grace period."
SO IF YOU EXCEED THE CONSIDERATION PERIOD your parking period starts from when you arrived (not the end of the consideration period). THEN IF YOU OVERSTAY the parking period you can't just drive away during the 10 minute grace period and forget about it, you must pay for the extra time you have parked, although the Operator can't stick a ticket on your windscreen until the end of the grace period.
SO FOR ANPR car parks, which time your stay very accurately, there's no getting away with it - but NIL DESPERANDUM...
    TIPS FOR ANPR CAR PARKS
    1. Use an app to pay, so you can extend your stay remotely.
    2. Set a reminder on your phone and allow time to get back.
    3. If you get back late and can't pay for whatever reason, or suspect you might have overstayed, if pay by phone is operating SPEAK TO A HUMAN PAY BY PHONE OPERATOR ASAP. Be nice, explain that you acted in good faith, think you made a mistake and ask if you can still pay. I've done it, it works, even the day after. Think about it... the accounts are not reconciled with the Operator for a day or so, to allow all cars to leave and avoid mistaken issue of PCNs.
    I hope this helps someone.

It was the first letter i have received until now and wanting to ask if the letter should have been sent to me within the first 14 days of the parking date and do i have to pay the debt collector now? It is for £170 and probably it was by accident i parked in the location. Thanks

So Basically regent parking gave me a parking fine back in august and I only parked there for 15 minutes as there was no other place to park because I had to assist a disabled family member, I wrote all this in the appeal and they rejected it HOWEVER they didn’t even send me a letter saying they rejected it rather they just sent me a letter from an external debt collector saying I owe them £170?!?, after I went on this companies website I saw they rejected it but I never physically got this letter to independently appeal again and now it’s too late to independently appeal, this is unfair, what do I do?

You need to learn the Common Law- writing letters to the company as a Living Man saying you accept their charges conditionally but you require answers to questions like: Proof of contract between two parties and so on also ask them to proof you have consent to share your intelectual property, which is your legal fiction's name as well as your address and phone number or whatever they have shared with third party.

Hi. Im an uber eat driver. I got 2ticket already. Sign on the board was "loading goods only “ and there is a man on sign, carrying a push trolley.
On the ticket, it shows 1min (warden waiting time)
I appealed it but they came back to me, my vehicle are not registered as loading goods, and they said aslo, wardens don't have to wait certain minutes for your vehicle.
I really don't understand, sign says nothing about Registered vehicles only, or this vehicles are not allowed or any time limit.
When you wanna appeal it they give you lot of list about parking rules.
Also there was a another sign top of it, for disable parking time, which is I was OK. But there were not Road mark atall, (disabled and Loading) just the post signs and cut white lines. I really don't wanna pay anymore for the tickets. There is no place for me to park for pick up my customers food.

    • @josephedwards5154
      @josephedwards5154 2 ปีที่แล้ว

In Canada, only vehicles designated as commercial vehicles can use a loading zones. A 'commercial' vehicle and/or a vehicle insured for employment will have a unique alpha-numeric sequence on the licence plate that can be easily spotted by a warden at one hundred yards. The warden demonstrated courtesy by waiting one minute, in your case. Next time you receive a parking ticket, consider it a lesson and the fine you pay is your tuition fee. Don't forget to thank the warden next time for a job well done in preventing the expansion of urban chaos.

Just got a ticket from Horizon Parking, from when I parked on the Tesco car park in Swansea on my holidays. From what I can tell by looking online, it's two hours free and the photos and timestamps they sent me indicate I stayed there for 45 mins longer. It doesn't actually say what I did wrong, just says I breached the T&C's of parking on this private land. Have I got a leg to stand on? If a judge is appointed by the state, rather that voted in by the public, you have a fair chance of getting it dismissed but bring your proof to back up your testimony. I received a parking charge from a private company for parking in an empty car park outside nandos. I received a first letter for a charge of £60 I ignored this and 3 and a half weeks later received another letter saying I must now pay £100. What should I do, just ignore it?

Private parking companies do not have the power to do anything. Ignore ignore and ignore

Ignoring it will land you with a CCJ plus court costs.

@@antman5474 Why is it risky? Do you not think it’s risky for them too? You are simply speaking from assumption not experience. It is highly unlikely you will be taken to Court over ‘Parking’ and if you are you are given the opportunity to rectify it. Stop promoting your false assumptions, people have the right to stand up against these outright corrupt and extortionate organisations!
