Been binging your channel tonight as my roommates and I are discussing putting together a bunch of our art(okay, mostly their art, they keep me around because I'm good at ideas) into lower content style books like notebooks and whatnot for the heck of it(our rent is getting raised in January, so we're trying stuff). Just wanted to thank you for the tons of information you've got up on TH-cam.
I was able to get my account reinstated after it was terminated, but mine might be a bit of a different story. I do all of my homework on trademarked terms and copyrights before I use anything in the title, metadata data, images, etc and make sure I have the rights to use whatever I am using for the purposes I am using them for. I also make sure to document I have those rights, or that no trademark exists in the terms I am using. And I document this by taking screenshots, saving documents, etc. ok I know that sounds like a lot of tedious and time consuming work, but it helped me out in a massive way and here is my story. On Tuesday night my account was terminated for a trademark violation, but because I had done all that tedious work I was able to submit proof that no such trademark existed. My account was reinstated Friday morning and today I got my royalties reinstated, and acknowledgement from Amazon that my account was closed in error, and automatically published the title in question. Again I know my situation might be a different one to many that are out there, but it does help in a lot of ways to do your homework ahead of time to ensure you are not violating trademarks or copyrights (and if you are unsure, don’t use them, I have not published things before because I wasn’t entirely sure). If you do have the rights to images, etc, be sure you document it and have it ready just incase you need to prove it. And also stay on top of your catalog and constantly check that you are not in violation of trademarks or copyrights. Just because a phrase you use today isn’t trademarked or copyrighted today doesn’t mean it could be in the future and could put you in trouble of violation! Sorry that was a long winded explanation of my situation, but I thought it was worth sharing. Yeah my method might seem excessive, but it saved me from losing my account entirely.

Hi Paul. Great videos and learning so much. Having just started I do find the categories problematic. Not sure why KDP doesn't have a stationery option?
I literally just had my account terminated today! I opened my email to find my account was terminated. I was doing a lot of low content books, planners, and gratitude journals. I have put in an appeal with a deeper explanation other than "misleading title".
One more thing we see in the KDP forums everyday is "keyword stuffing" the titles. KDP is getting heavy-handed with titles like "The Ultimate Coloring Book for Boys & Girls - Thing 1 Thing 2 Thing 3 Thing 4: Fantasy for Children Ages 4 5 6 7 8 9 10 - large format - over 100 pages (Ultimate Books Series)." KDP will give you a warning that you have to reply to after fixing the title, or they ban your account. A more review-friendly title would be "Coloring Book: Thing 1 Thing 2 Thing 3 Thing 4." That's it. Put the rest in the description. Also, if you do get your account closed, don't create a second one. That results in a permanent ban. If your account gets closed, you have to respond to their emails (check your junk folder) and sort out the issue. Hope this helps. Good luck.

In it will be period adverts, road tests and buyers guides previously published, but we curate those and add expanded and educational insight into that content by producing written commentary on that content, with forewords and introductions from marque experts etc. etc. We do not wish to contravene KDP policy and will not be using 'Alfa Romeo' logo's (save for design evolution and commentary of same) and we will have a disclaimer pointing out this is 'not an endorsed Alfa Romeo product' etc. Are there any resources that will help us 'do the right thing' here and avoid trouble?
and is it true that you can't add books with titles that are already available on amazon but are generic phrases like Christmas Activity Book for Kids Ages 3-5. Does every title we launch on Amazon have to be unique?
I received account closed. It may because of using Winnie the Pooh images from EH Shepard and all characters released in late 2021 into the public domain. I’ve experienced messages and communications from customer reps who seem to have problems with grammar and contextual use of English. I do feel there can be a disconnect in discussion of issues. Or i send a response and then someone sends a response saying they are still waiting for my response. Discouraged and looking for other means or platforms for publishing my work.
I'm sorry to hear you've had your account closed. I know other people who publish on Ingramspark which may be something to look at. I hope you manage to reolve the issue with KDP, I know it can be a very frustrating process.

Mine got shut down, reason number 1 not my fault and reason #2 still not my fault, every reason was for published book that was published more than 6 months ago.

Hi Paul, thank you for this information! I just created a ton of low content books. They are children’s write and draw story book paper. I have a multiple books, they all have different covers but the same interior. And on Amazon I have an image of the books cover and the interior. Is this something that amazon would terminate my account for? also, i saw something about trademarks. i have a registered business name and a logo i created. If it's the same story then that may casue an issue. If a customer bought one of your books and then bought another thinking it would be different then that is where the issue would be. Yes, you;re allowed to put your logo on the book.

Hi, sorry to hear you had your account terminated. If used in written content I'm sure it's fine. It would also depend in what context. The issue is targetting a trademarked phrase to make sales i.e. in the tilte, subtitle, description and keywords. You would be marketing, branding a book based on another entity's intellectual property. I'm not a trademark lawyer but that's how I interpret it.
It depends on the cartoon. If it is someone else's creation then it would be trademark and copyright infringement. You would be making money of someone else's intellectual property.
I have 2 word phrase that I want to use in one of the keyword boxes. These words are just part of the English language. One of the words has been used as a company name. The two word phrase does not come up as copyrighted. The one word is used in many different company names. I want to put the 2 word phrase in one of the keyword boxes. Will that caused me a problem?
It depends on exactly what the words were. For instance, if the company name you're thinking about is Disney, for example, then no, I would advise against it. If the two word phrase is not trademarked and neither word is a well known brand name then it would probably be ok but without knowing the specifics it's impossible to say.

They're not going to sell you the world, at most they couldn't give you the rights to use that word in one specific application, given that you're already selling hundreds of thousands of copies every month in a similar niche.

I'm afraid I'm not a trademark lawyer so the question about deriviative content I can't really answer. I think it would depend on how much the image has been changed. With regards AI, using a paid for MidJourney account gives you commerical rights. Then there is the issue of trademark, so if you create an Ai version of Spiderman for example it is still going to be breach of trademark. As for copyright there have been no legal rulings, as far as I'm aware, that any images breach copyright. However, these are really early days and who knows what rulings will be made in the future.

Hi. I recently created a workbook on anxiety - a version for men and then a version for women. The content is the same inside except I changed any gender pronouns. The covers are different. Would this cause an issue? It's also not low content.

That's unusual, not come across that recommendation before. You could do it by opening the interior in the free version of Canva and adding the page numbers.
Thanks Paul! I have 2 medium content books /same interior one in color one in BW Different covers of course. I should be okay if I lost in the description BW or Color interior so people know their the same ?
I would avoid doing that. If someone buys both books thinking they are different or have different interiors then it will just lead to a complaint. Amazon may also detect them as being duplicates which can cause a problem.
Hey Paul thanks for the advise, only wish I'd come across this sooner. I recently had my account suspended for reasons unknown, still waiting to hear back from KDP. I'm new to all this and have been very careful with my content I'm assuming the Categories are wrong.... categories seem to be problematic and a bit confusing at times. Paul, I have a question: Would it be wise to make 1 book in the niche but in different lenguague? For example in Spanish and German besides english? Because my mother lenguagues are spanish and German.

If I do a book of prompts to be used by a child in a no/low content book and the child writes his thoughts following the prompt to give to a mother or father, could I get my account deactivated for duplicate content since the prompts (created by me) would be the same for a book to mother and a book to father?
That would be possible. The reason is that if you imagine someone buying a book for a child and one for a parent, if I understand correctly that's what you're doing, and find they both contain the same prompts then they would probably complain to Amazon and that's when the problem arises.

I see a lot of non official pokemon and legend of zelda books making a lot of money, i don't know what's happening there since Nintendo is extremely protective of their brands, so it seems some people get a pass on copyright infringement. I almost got banned for making a little red riding hood vintage from public domain, but using pokemon is fine 🤔.
Yeah the amazon bots on there are ridiculous. I think it may be a date thing. If uploaded before a particular date it may not have gone through a bot. But anything uploaded after a certain date the bot shuts down your account straight away. Or maybe they have not used detectable keywords.

If a single word is listed in the trademark search, can I use it? I searched a word and there are multiple live trademarks of the same word so Im not sure I understand how that is possible. They are all different companies.
It depends on the word and what goods and services it is classified in. You see multiple listings because they are trademarked in different categories of goods and services

No, there isn't an option for that in KDP unfortunately.
Not an option for sale on the same page but if you use A+ content you can show the variations.

The one I mainly use is Affinity Designer. If you learn one you can very easily then use all the others.

The two word phrase does not come up as copyrighted. The one word is used in many different company names. I want to put the 2 word phrase in one of the keyword boxes. Will that caused me a problem?
It depends on exactly what the words were. For instance, if the company name you're thinking about is Disney, for example, then no, I would advise against it. If the two word phrase is not trademarked and neither word is a well known brand name then it would probably be ok but without knowing the specifics it's impossible to say.

They're not going to sell you the world, at most they couldn't give you the rights to use that word in one specific application, given that you're already selling hundreds of thousands of copies every month in a similar niche.
A company may provide a license for you to use their intellectual property.

I'm afraid I'm not a trademark lawyer so the question about deriviative content I can't really answer. I think it would depend on how much the image has been changed. With regards AI, using a paid for MidJourney account gives you commerical rights. Then there is the issue of trademark, so if you create an Ai version of Spiderman for example it is still going to be breach of trademark. As for copyright there have been no legal rulings, as far as I'm aware, that any images breach copyright. However, these are really early days and who knows what rulings will be made in the future.

Hi. I recently created a workbook on anxiety - a version for men and then a version for women. The content is the same inside except I changed any gender pronouns. The covers are different. Would this cause an issue? It's also not low content.

That's unusual, not come across that recommendation before. You could do it by opening the interior in the free version of Canva and adding the page numbers.

I would avoid doing that. If someone buys both books thinking they are different or have different interiors then it will just lead to a complaint. Amazon may also detect them as being duplicates which can cause a problem.

I'm new to all this and have been very careful with my content I'm assuming the Categories are wrong.... categories seem to be problematic and a bit confusing at times. If I do a book of prompts to be used by a child in a no/low content book and the child writes his thoughts following the prompt to give to a mother or father, could I get my account deactivated for duplicate content since the prompts (created by me) would be the same for a book to mother and a book to father?
That would be possible. The reason is that if you imagine someone buying a book for a child and one for a parent, if I understand correctly that's what you're doing, and find they both contain the same prompts then they would probably complain to Amazon and that's when the problem arises.

I see a lot of non official pokemon and legend of zelda books making a lot of money, i don't know what's happening there since Nintendo is extremely protective of their brands, so it seems some people get a pass on copyright infringement.
I almost got banned for making a little red riding hood vintage from public domain, but using pokemon is fine 🤔.
Yeah the amazon bots on there are ridiculous. I think it may be a date thing. If uploaded before a particular date it may not have gone through a bot. But anything uploaded after a certain date the bot shuts down your account straight away. Or maybe they have not used detectable keywords.
