    So if I use a local doctor that is not a VBA approved because I can see them quicker than QTC, because my job has me moving to many locations worldwide for different amounts of time, I am good to go as long as it was done in person. I spend a lot of time traveling as you said but try to utilize my local doctor and VA when I'm home.
    I do not have the flexibility to arrive at their beckon call for C&P. I just filed for an increase with my local doctor and I'm back on the road

      According to the information the VA has provided. Keep in mind there are many employees at the VA and each may look at a regulation and policy different. The feedback I've been receiving from veterans on this issue (going in person to a private exam in another state) has been different but most of the time it's positive. It's knowing what your options are if it is not used as long as it is sufficient for rating purposes.

    Hey Dewayne I looking through my c-file and noticed several visits in service for allergy/ sinus infection throat issues it definitely shows a pattern that continues to this day.
    Anything rateable for sinus as a direct a direct connection?
    Random Example VBA decision in 2015 this veteran got a large backpay
    ORDER A 30 percent disability rating for sinusitis with allergic rhinitis from June 11, 2002, is granted, subject to the law and regulations governing the payment of monetary VA benefits.

    Hi Mr Kimble. Question: if you are 100% P&T, to include 100% for PTSD and SMC s, can you still work part time? Thanks!

      If it is outside of TDIU, yes you can still work (full time, part time etc.). If it's TDIU, you can still work but it can't be more than where you fall within the poverty threshold.

      Sir did you notice the mentioned 100 for ptsd? The cfr 38 4130 at 100% with a mh issue dictates a TOTAL AND SOCIAL EMPAIRMENT for which employment may present the veteran an issue at review. P&t are in fact being reviewed. I am assisting two veterans now with reduction proposals. Best to you.

      @@captainhargrove113 If total and social impairment is checked depending on the number and type of symptoms that are noted will determine if the condition is 100 percent (I've seen in VBMS-R, that total and social is checked and only certain systems are noted and it generated a 70 percent). Also, for the proposal's, did the veterans go in for an increase and their percentage for the mental condition was not protected by the 5 year rule and did they have one exam under five years show improvement or 2 exams after 5 years of the percentage?       @@DewayneKimble I received my VA rating today for a complete histerectomy and it was 0%: is that accurate if they removed uterus, cervix, corpus, and fallopian tubes? Also, I developed pulmonary embolisms in both lungs which put me in the hospital twice along with DVT's in both calves. I mentioned it during my C&P exam. What should I do?

    I checked my DBQ date it was valid well within the expiration date. My Doctor completed my DBQ exam in his office. When I went to my C&P exam last week the examiner said that I definitely have DC 7522 and had multiple priapism, he concluded that he was not a Urologist that he would refer the VA to my Urologists diagnosis which is DC 7522 secondary to adverse side effects to injectable medications, my compensation is pending.

      Sir, that was my question I even wrote the EIC and asked them why my DBQ was not warranted I didn’t get an answer. When I saw the C&P examiner he was looking at his phone and following the Presidential election results, he told me that he didn’t think a physical exam was necessary that he wasn’t a Urologist and that my conditions are exactly what was described by my private Urologists, he then asked me other questions to add to his report of medical conditions I never told him about which he said was the results of DC 7522 as secondaries.

      Just a FYI on DBQ’s submitted by vets, M21-1 MR III.iv.3.D.2.e. Discontinuance of Publicly Available DBQs. The VA discontinued use of making DBQ’s available to the general public due to potential fraud by some of our fellow veterans (i.e. doctor shopping). This has ruined it for the rest of the honest veterans out there. Generally speaking, when a veteran submits a private DBQ the VA will consider it as evidence. But “consider” doesn’t mean a RVSR has to rate on the the DBQ submitted, and many WON’T. Think trust but verify, but will still order you a VA exam to verify what your “private” DBQ indicates. And if you think you are being slick by refusing to attend the exam the VA schedules for you and you tell the VA “rate on the evidence of record,” don’t be surprised when your current evaluation is C&C’d (confirmed & continued). A few bad apples doctor shopping and/or filled out the DBQ themselves because they looked up a doctor’s name and NPI number on the internet and didn’t think the VA wouldn’t check it ruined it for everyone else. Don’t shoot the messenger here, but without doxing myself I know what I’m talking about regarding this subject.

      @@TheATXpatriotThanks for the feedback. I know veterans that RVSR's have used DBQ's and rated and other RVSR's tried to request exams. There is inconsistency between them (RVSR's). There is an IG report that notes what you are saying about DBQs and why they were removed from the VA's website but some RVSR's are sill using them to rate as long as the DBQ is sufficient for rating purposes.

      @@DewayneKimble agreed!!! The problem is with QR and there really isn’t any “official” guidelines that has been put out other than the MR change. Any another thing is just about every Private DBQ can be deemed insufficient for rating purposes as ALL musculoskeletal and ALL mental DBQ’s have to have a Claims folder review marked off in order for the DBQ to be deemed bare minimum “sufficient” for rating purposes. And with private doctors not having access to VBMS to review the claims folder it’s near impossible for a Private DBQ to be sufficient for rating purposes. That was why Private DBQs are “considered” as part of the evidence but rarely are ratable for VA purposes. And RVSR’s who are rating off Private DBQs are setting themselves up for an error based on M21-1 MR III.iv.3.A.8.b Examinations Requiring Claims Folder Review. Almost every type of exam is covered under this MR. And the MR doesn’t differentiate between new claims for the condition requiring a file review or an increased evaluation. Therefore it’s better to avoid a potential error and just order the exam and move on. I know it’s been a couple years since you rated claims but this useful information veterans need to know. Especially since there are reps who charge vets a fee based on an increase they are “promising” the vet they can get them through private DBQs and nexus letters. Review that MR and give me your thoughts!

    what if you send in a DBQ with your claim and its not expired but while the claim is sitting for some time the DBQ becomes expired what will happened? example: claimed turn in 2019 and DBQ expired may 2021. BVA Claim, completed by veteran Doctor.

      @@DewayneKimble thanks for your response. My claim is still waiting to be decided. If they do not give me a response by next year May the DBQ will expire. As you said I don’t see why they would not look at it, if It was send it in with my claim way before the expired date.

    My VA Psychologist said he is not allowed to complete a DBQ. My PCP said she submitted a DBQ for me electronically for multiple conditions.Is that possible? Would I still have a C&P?

      Most say that but don't provide a regulation or policy stating that they can't. I've heard some will complete it and some will not.

    If a veteran been rated 10% for tinnitus and 0% for hearing loss for 5 yrs and they later get a hearing aid can they file for an increase?

    If expired take the data and put it in the nexus letter even if you are presumptive and DSC.
    Simple.

      In the M21 and 38 CFR explains evidence. Please review those regulations and policies and it will give you a better understanding of evidence. The VA may bring back all DBQs that have been expired and update the ones that have not expired.

    No more DBQs.
    Instead they are sending out nearly blank paper for you to fill out for the C&P exam.
    You might want to whittle it down to a page as you organize.
    Then I assume the C&P examiner makes notes and sends.
    Let see if it works for my retirement soon.
    I can be of assistance for how the VA rates (the funny math) that I used as a senior naval officer in DC when I assisted in ratings.
    Just let them know.

      You still can submit DBQ's that have not expired. I know veteran's that have done this and have been successful. The DBQ's have to be sufficient for rating purposes. Are you willing to complete DBQs for veterans in the DC area??

Assuming its to stop people from filling them out at home and submitting them on their own. If so it makes since..GOMAB
