I have a question about chapter 35. My ex husband is 100% DV. I know they get free college however, since i nor my boys have heard or seen from my ex in the last three years my current husband would like to adopt them. How will this affect their chapter 35? My ex is still claiming them on his VA disability, once the adoption goes through my husband would like to move them onto his disability (he is 60%).

I had a cmp exams in August and September but have not received letters how the dr said that I am suffering a tbi & hearing lost how long does it take for a result after a cmp exam

Hi Mr. Kimble, I just had an ACE exam for migraine, and the provider told me I had to talk to an adjudicator. Is this something we can do? She said that one of my evidence FMLA was blank and told me to get a physical exam so that she can put that my symptoms were worse in writing. I had to upload this information again. She asked if they were prostrating and I told her Yes and gave her the details. She said a CP exam might be done. I am so confused.

Hello Dewayne, Received my results from the CT Scan and it showed no significant sinusitis. however; my VA doctor says there is sinus swelling. CT exam found a small benign osteoma at the right ethmoid sinus. Is this covered by the PACT Act. I was in Kuwait in 2008.

What happens if your claim has been filed for the second time incorrectly? It was refiled as a disagreement, it was filed originally on the wrong form, as new condition instead of existing.

I gave the VA, on a claim for COPD, a list of everything I was exposed to in the Navy, including a chronology of when I was exposed, safety data sheets on what I was exposed to, copies of my orders to locations where I was exposed, and other items showing service connection. They came back with a rejection stating there was no evidence of service connection.

both the letter and my code sheet did not actually show me my real percentage… these documents only showed me my rounded percentage, … I had to go online to the VA website and use their calculator and plug in the percentages and the diagnostic codes and it came out and gave me my true total… also, I have called the 800 number several times and I have gotten good assistance overall. … don’t be afraid to call the number and ask questions. I have found that they are very helpful. They may not know everything and you have to be patient with them as well but if you are and you consider them and they’re being very busy, they actually will take the time to help you.

There isn't a Navy vet who served on a carrier that hasn't drank and showered in JP5 thanks to them never segregating the storage tanks that held potable water.

Their are veterans receiveing letters stating that their rating are being reduce veterans call veterans adminstation and no one can give them a answer why it was reduce.

The only thing I’m worried about. Will a dependency claim trigger a reevaluation.

My second C&Ps for RA were Dec 3 and Dec 12... I'm still on Step 3 but there is nothing else to gather. Can I somehow get to Step 4 faster?

The only thing i might say for mental health is that the rater has the latitude to upgrade or downgrade the evaluation that the DBQ provides based on addition evidence. Hospitalizations are a good objective bit of evidence to ask the rater on the claim form to consider the hospitalizations and within their discretion to provide a higher evaluation. When people talk to me in their submission and give context to how their mental health is impacting them (with evidence i can cite) i will often override the evaluation to the next higher.

Mr. Kimble. Thank you for the video and all you do. I have gotten a lot of quality nuggets. Dewayne, do you/or anyone have a good contact number or email for the following issue? I have recently filed for service related disability. Furthermore, I have completed my DBQ's, both psych and physical. Last month they requested some specific supporting documentation/information, and I submitted it before the final due date of December 27, 2024, but on my VA home page it says they have not received it, and it is overdue by 10+ days now. I have looked on the VA webpage for a way to contact them to correct this and make sure my claim is moving forward but have not found any phone number or email to specifically contact them to address this oversight. I have been getting help from the VA support at the Oklahoma Federal Building. They have helped me with the entire process, submit all my initial claim information, including the additional information in question. I have asked the VA rep at the Fed bld to check and make sure we submitted the doc in question, and they showed me the submission and the file stamp submitted, but on my VA home page and on my phone app it is still showing it has not been submitted, and I am concerned my claim is going nowhere. What do you suggest I do?

Dewayne, I just listened to CivDiv guy and he said that a DBQ from private physician is no longer going to be considered. Is there truth to this or am I misunderstanding something, OR is he flat out wrong??? I had planned on going this route for an appeal which my VSO suggested I follow up with, but if things have changed since LAST Friday….

Thanks for the information, my claim went from step 6 back to step 5 a week ago. Does that mean more evidence maybe needed?!!

Confirmed and continued 60% for Chronic Fatigue on a reexamination. I submitted a 100% DBQ which warranted it, a script for bed rest, and an EEG showing brain issues for cognitive impairment all rate 100%. I got cheated. The QTC was not filled out completely which makes it inadequate, and my evidence was listed on the decision letter so in my opinion reasonable doubt should’ve been in effect for positive and negative DQB’s submitted 4 days apart.

Desert Storm Vet here, been dealing with Asthma, Sinusitis, and some other issues that now are presumptive. I filed a Tinnitus claim in October which I won. Was still gathering evidence for the presumptives. I just filed online those claims Dec 31. I noticed there was no place to ensure my August ITF so I uploaded a copy of that into the supporting documents. As a former rater, would you use the August date for the other claims as well or only the Tinnitus claim and the other claims filed later with a December date?

Thanks for all you do for us vets. I just filed a new claim with 10 contingencies a variety of Mental health and physical claims. At first the VA ordered a C&P exam for the physical things then they cancelled it. They never attempted to schedule a MH C&P. Mental health claim is a direct connection and is a strong claim. I have an easily verifiable in- service event (9/11), current diagnosis, and have been treated by the VA. I provided them with an IMO, Nexus, personal, statement, buddy statements, Social Security work record (No gainful employment for over 20 years) A history of homelessness and several other pieces of evidence. I have also been placed on a 5150 hold at the VA, for S.I. My claim was tagged with a hardship flag. Now it's in PFD assigned to an RVSR and has temp jurisdiction. Should I be worried about not getting a C&P exam for my mental health claim?

Brother thank you for telling all these vets about the claims process. Because i had my first claims when i was Medically Retired from service which put me at 90%, which my peblo was a fellow vet, that I had served with. Plus She was a Friend of mine. She was expecting me to get 100% from jump, but i didn't. But i got everything. Well about 3 months later. I went to see a VSO who ran me off scared. By telling me that i didnt want to do a reevaluation cus they would reduce me. Also that o should be happy with what i got. Well lets put it like this, all my stuff is static anyways after 10 years i asked for increase and well im schedule 100%: 90% IU PT/SMC

I went into the hospital during active duty for a compressed spine in 1989. Once. They gave me some electronic treatments on my muscles, gave me some flexril, sent me on my way. I went back to work with a "light duty" form...my Flight Sgt, stuck me in a chair for the entire shift, the pain was excruciating and not able to lay down. I never went back to be seen for subsequent flare ups...didn't want that treatment again, suck it up buttercup. Years later, I found out (after spinal fusion surgery) that I was eligible for disability. Who knew? 30 years after discharge I was given a disability rating from that damage.

They denied claims multiple times saying that the program is for Veterans who are bedridden and on their way out of here. It’s so disheartening, honestly when you really are a Caregiver and it affects your ability to live your life, and work. Caregivers should be approved.

With the MH changes scheduled for April 2025 I will four visits. That will be enough of a paper trail for the first go around.

i was a 100%, i called the va in DC and they said i dont have any future exams scheduled or alerts for a future exam. so they switched it to p&t for that reason.

I just got denied for hearing and tinnitus. I think because they knew I worked in a factory after service

I am 100 percent P and T and I stay home with my wife and play video games. No interest in friends or going out. This is how we stay safe. Also I am paying 400 a month for my own private therapist and dentist. I am done with the VA.

I was fresh out of marine corps & a older gentleman said he could help me get 100% I thought it was out of kindness but he ended up wanting 50% of the back pay I would get just to file my claim 😂. I think not I did my research myself & ended up getting 70% the first time . I just submitted new claim now I’m shooting for 100% with secondary mental health claims.
