What I find interesting about extortion is that it is dependent upon timing. For example, the following statements are made: 1. "If you don't give me money now, I will expose a crime you have committed." 2. "I will sue you to expose a crime you have committed, and I expect to win money from you." (1) is extortion because you demanded the money up front. (2) is probably not extortion because the demand for money came after a certain event. Each statement includes a certain amount of coercion, but (2) is less coercive and involves a different timing of events.
I would think the employer would be the target of simple exposure. Bad deeds of their attorney is only a reflection on the employer. The attorneys are not the ones who discriminated against the employee. I would hope our criminal justice system would handle the attorney. Just my two cents. My problwm is with NDAs . Espessially for medical claims. I understand that they allow claimaints to get a settlement they deserve. However, it does allow respondents to keep doing bad things. My peeference is for settlement NDAs to be not enforceable.
I agree that NDAs are a tool enableing injustice to continue in some cases. Employers have so many protections for their misdeeds. I believe the general public should be more informed about the dirty tricks some employers use to... oh wait, yep, Vincent has that covered like a Hippo on a butterfly. Hi Vincent, love your videos! I have reached a settlement with my employer thru mediation, now I am reviewing the agreement by signing. I do understand the agreement, but should I hire an attorney to review the agreement before signing? One condition of our agreement is I resign effective immediately and my settlement payout will be paid out following my regular bi-weekly pay schedule until paid in full. Should I have any concerns about this payment schedule compared to receiving a lump sum payment?
Hi! I’m here in NYC and I believe I was misclassified causing me to not be able to file for unemployment. Can I sue my ex employer for my unemployment with a misclassification or will I strictly have to deal with the DOL?
I have a question if you can answer it. I get paid salary. We have worked over time for the first 3 year this year it's slowed down but we don't get paid overtime or straight time after 40 hours. We run Chainsaws pick up debris from cutting run machines. Am I entitled to the last 3 year of overtime. Further more I have mentioned this to them 2 years ago I just got shut down. They also made a rule recently about sick days We have to use our vacation days for sick days ( all except the one guy) is that allowed? We don't get check stubs only get personal checks ( they say payroll on them) but we have to request them and it takes weeks up to months to get them. It's a small business it seems like they aren't following the law. Ps we only get lunch breaks and sometimes they cut it short. Can you give me some advice? Can you run a hypothetical case on this.
How do normal people like us follow the docket to check on our own cases? The federal clerk told me over phone that I could call her to ask for updates whenever I want too, that way I don’t pester my lawyer so much..
