    My career began in a Defense activity's classified mail room. I handled classified material throughout my career as a Defense systems developer. Here's something that jumped out of the indictment that I haven't seen any other analyst comment on. The first 31 counts/charges each correspond to a specific document that Trump allegedly illegally retained. Thirteen of those documents have a classification that includes the modifier "ORCON". ORCON means two things:
    1. The document is the product of a foreign country's intelligence community, and
    2. The originating country retains classification authority for that document.
    The ORCON modifier will thwart the Trump defense that he somehow automagically declassified the documents before he left office, or that he declassified them psychically. The ORCON classification modifier means no one in the US government, including Trump, had the ability to declassify those documents.
    And here's my prediction: Trump's defense team will assert that he *did* declassify the documents somehow as he left the White House. The DOJ will counter that argument by asserting that Trump didn't have the authority to declassify nearly half the documents he's charged with taking: the ORCON-marked documents.

    • @maryballwashington4674
      @maryballwashington4674 11 หลายเดือนก่อน +12

      The Espionage Act doesn't even mention classified vs declassified, that point is moot. It's the willful retention of documents related to defense and security of the country that are in question, not the classification markers. Read the indictment.

    • @andhisband
      @andhisband 11 หลายเดือนก่อน +11

      @@maryballwashington4674 That the charges don't mention classification is true. Obviously, I *did* read the indictment; perhaps you should re-read my statement. While the charges don't hinge on the classifications of the documents, the defense will try to side-track the issue by downplaying the classifications or claiming they didn't exist, thus minimizing the sensitive nature of the documents. That's what Trump and his lackeys have been doing publicly for months. I'd be willing to bet that DOJ included charges for the 13 OPCON documents precisely because they wanted to thwart that tactic.

      @@elderlyandweak2056 The documents named in the indictment were sensitive national defense documents. The Espionage Act is written with that language because not all such documents are born with a classification, although they will eventually get one. In 2015 I started gathering information on DT to make an informed decision on who to vote for. When I'd gathered quite a bit of reports of his reputation in business as a cheat,not paying those he'd hire and not honoring contracts,my choice became clear. It became common knowledge he'd run the same game when sued which was delay . That's very expensive, retaining counsel for months even years. Then I watched rallies. Belittling of a handicapped man was the last straw. He has no respect for anyone. He's totally transactional and as the good doc said,feels entitled and above the law. Helsinki really undid me.
    He may win again but not if everyone who sees with clear eyes what he is votes for an independent or democrat,at least until real conservatives are back leading their party. It seems the House is being run by children and we need two parties who are serious about running the government for us,not their doners or act as DT's defense attorney .

The reason it's hilarious is because Jersey has two state highways, the New Jersey Turnpike and the Garden State Parkway that run the entire north/south length and they criss-cross each halfway through which means it is absolutely true that just about anyone who lives in the state does live close to one of the exits of either the Turnpike or the Parkway.

    I'm more interested in this case than the case in NY with the hush money payments. To be honest, most rich people, landlords, etc. in NY are crooks when it comes to documents, taxes, etc.-- so in that regard, his case is nothing special to me, and it doesn't stand out as "particularly" bad.
    This case feels more substantial because, while I believe that many politicans have improperly stored/kept classfied info, Donald Trump's obstinacy and belligerence when it came to giving the documents back or cooperating in any way stands out to me. I wonder what will happen, or if anything will come of this case

      @ultimatespinach As a NYer I'm talking about the fact that landlords regularly cheat and do things like SROs, basement apartments, have buildings that aren't up to code, etc. And most rich people here don't pay their fair share of taxes, misrepresent business dealings, etc. It's extremely commonplace. I'm not talking about con artists, Ponzi schemes, and people stealing from the average Joe. Trump wasn't charged by the NY DA for anything like what you're talking about, there are levels to white collar crime and I'm not saying that any should be permissible, however the DA looks the other way on all kinds of stuff so what Trump did doesn't stand out at all. I'd rather the DA go after slum lords and people who do things like what you mentioned and willfully lie and steal from average people

      Ironically, NY probably has a much better case against Trump for tax fraud, but prosecuting him for tax crimes could correctly be seen as politically motivated unless they go after every one who has committed the same crime, which I understand is a common one among the upper class. White collar criminals get away with it because they’re politically active and donate huge sums to political campaigns.

He talks about the liberal media but fails to talk about the right-wing media like Fox News, oan, and Newsmax which lie consistently. The reason why the media is highly critical of Donald Trump is because he has given us quite a lot to be critical about. He would probably dislike me as I am from New York and not out west 🤣 but we know Trump here. I actually have a childhood friend whose father worked for him, said it is true that he cheated contractors out of pay. It's quite handy to have attorney's to handle pesky little lawsuits like failure to pay a fee. Anyway, the whole 4 years of trump's horrific presidency from his deletion of an entire library on the government's website of scientific research to planning a violent coup steal an election has been a nightmare for many fair-minded conscientious folks. Unlike Trump, Biden didn’t know he had the documents as the office they were stored in was unused. Once this was discovered, Biden’s lawyers immediately contacted the NA to return the documents.
      Trump not only knowingly hid the documents, he lied about their location to the feds and his own lawyers, refusing to return the documents after several requests. I’m just mad that they didn’t go and get the documents back in 2021, they waited so long and gave trump way too many chances to return the documents and be honest instead of hiding them and lying.
      Trump deserves everything he’s getting now, as it’s the result of his own actions.

      @Mike Hawkins: If you check the facts, you'll find that the documents Biden has had "for fifteen years" are documents from his time as a Senator that are now on display in his "library". You can't trust anything Trump or Fox News Reports. If you want the truth, you have to check out the facts yourself.

      Yeah, lot of people who don't know half the details on the Biden situation.
      I really loathe the hasty generalizations. People assume that it's so how unprecedented for a former president/executive to keep old work documents around even though I'm almost certain every single president has done that to some extent. like everyone assuming that the Biden scandals are from right now and not previous administrations or even that most people (including myself and everyone else) even know what they are talking about.
      Anyways, it's Rough times.
      I hope you ha e a good one :)

    This takes me back to the days when a republican and a democrat could talk about politics over coffee. Now, they end up throwing coffee at each other. 🥺😢😥😨😤😠🤬💔

    The media pointed out all of the disastrous, criminal and incompetence of Trump, so it doesn't mean they were being mean to him 😅. On the contrary, to show non-bias, they don't give Biden enough time or credit for his achievements, or basically not being an insane, narcissist! 😮 Good analysis, though 👏.
