Hello, i want to ask. I am a green card holder who has applied i-130 for wife 2 years ago, still pending approval.
We are both doctors and will be taking USMLE exams and eventually start residency in usa. If i get in first, can my wife and son be given J2 visas so they can come with me? At the same time her i130 process continues at its normal pace?

    Hello, great video content!
My husband is going to the USA with a j1 visa and I'm going to try the j2 visa. My question is: I'm unemployed at the moment does this reduce my chances of being approved? I have money saved to cover the costs of the trip but I don't have a monthly income. Does this mean my chances are very low of being approved?
    Thank you so much!!

Hello Avery, my daughter is a J2 who attends Community College and has applied for premium processing of F1 visa before she ages out. USCIS responded and asked for the J1 2 year home waiver which has been applied for but not yet granted. USCIS has informed her that she has been denied change of status because she has not provided the evidence of the waiver in the stipulated time…does she have to reapply for a change in status when we are granted the waiver?

For example, if I legally stablish a postal address in the US, do I need to wait inside the country until my work permit is approved? Or I can be out of the country til having my work permit granted? Thank you so much for your reply.
My husband and I have been staying in California since the last five months. My husband has a J1 visa and I have a J2 visa. His visa will expire after 7 months and also my visa (J2) will expire as J2 is dependent on J1. We don't know if my husband will get the extension for next. I am looking for a postdoctoral position here and hopefully I will get it soon. Usually the university provides a J1 visa for postdoctoral applicants. If I get a postdoctoral position here I want to convert my J2 visa to J1 visa because I do not want to depend on my husband's J1 visa as there's always a risk factor to get extension of J1 visa for next, and I want to have my own J1 visa for my postdoc study here. Is it possible to change J2 visa to J1 visa? What are the criteria for that? I will be grateful if you provide me with detailed information about it.

Thanks for the support! J-2 dependents can only be legal spouses and unmarried children under the age of 21. If your husband is not listed on your daughter's birth certificate, you will need to provide your own marriage certificate and proof that your daughter is also under the care of your husband. A sponsor might ask for additional documentation as well. But yes, step children are permitted. Good luck!
