I disagree with charging minors as adults. A minor should never be charged as an adult for any crime. The reason is because they are not adults. There’s a juvenile system for a reason and the juvenile system and courts can suffice. It’s hypocritical that the government gets to have it both ways and so far asminors are not old enough for adult rights or privileges but then all of a sudden old enough for adult punishment. Hypocrisy that I can’t stand. But in juvenile court, it should be.
@@tigernotwoods914 in most situations, I could agree with that, but not this one. If the girl is under 17, I'd be surprised. She more than old enough to know better than to do what she did, but she did it anyway, probably banking on her age to protect her from any serious consequences. Given all the facts presented as given, I would definitely treat her as an adult. She committed an adult crime, she should pay for it accordingly. In all likelihood, she's already at least 17 or 18 anyway, so she's not even a minor anymore to begin with.
@@VictorMartin-w3p I don’t care. No exceptions. If you want to charge 17-year-olds as adults for crimes, then lower the age of adulthood to 17. @@VictorMartin-w3p not only that but there’s no such thing as an adult crime. There’s just crime. @@VictorMartin-w3p what’s really interesting though is and I’m just playing devils advocate here, but you do have a legal right to defend your property and I wonder if a real lawyer could make the argument that the teacher committed assault by snatching the phone and then theft by taking the phone and then the first spray was self-defense now the second spray in the hallway could possibly be battery but then again she was still defending her property. I’m not making this argument. I’m just saying there’s an argument that could be made and it would be interesting to see how it plays out.
As a highschooler, I never understood the problem with teachers taking away kids’ phones. It’s not like they’re taking it away forever, so it shouldn’t even be considered theft as long as you get it back at the end of the day. But for a student to pepper spray their teacher over it??? Its not their property, and phones may have alot of stuff that teachers are not entitled to on them. Its also that students, in case of emergency. Teachers shouldnt resort to taking their stuff, but doesnt mean they should be powerless.
@@Elgallo1107 I agree, they shouldn't be using it in class outside of an emergency.
It’s not so much that I’m for or against it, but I just want a consistent line drawn in the sand.

@@VictorMartin-w3p not only that but there’s no such thing as an adult crime. There’s just crime. I never understood that argument because if we’re going to charge minors as adults for supposedly adult crimes then what would you consider a child crime and then by the same logic, if we follow it to its conclusion, should we charge adults as minors that commit so-called child crime?
I know it’s ridiculous but that’s why I’m saying it’s equally ridiculous to charge a minor as an adult when they don’t get adult rights
That’s assault. An offense. Telephones should not be allowed in classrooms!
They should be on their decks and off. In an emergency, I would want them to have them, and you don't know nowadays 😢
telephones?
As a highschooler, I never understood the problem with teachers taking away kids’ phones. It’s not like they’re taking it away forever, so it shouldn’t even be considered theft as long as you get it back at the end of the day.
But for a student to pepper spray their teacher over it??? Nobody taught this girl the difference between literal theft, and school policy.
Its not their property, and phones may have alot of stuff that teachers are not entitled to on them. Its also that students, in case of emergency. If a student is an issue, have them removed or sent to the office, or punished by automatic assignment failure. Teachers shouldnt resort to taking their stuff, but doesnt mean they should be powerless.
@@ickystarsick9403 so don’t use it in class or google test answers it’s very easy lmao
@@ickystarsick9403no accountability to the child? Interesting.
@@Elgallo1107 I agree, they shouldn't be using it in class outside of an emergency. Again there are other ways to go about discipline that doesn't include taking a students personal, potentially expensive piece of property. If they don't want to listen, there's plenty of methods for correction to choose from. Remove them from the class, give them detention/suspension, grade deduction, have the school call the parents to come get their disruptive child, etc. If they're decent parents they'll handle it, and if not ultimately there's expulsion.
@@Biggfissh did you not read my comment or are you talking about this child specifically? I'm not defending what she did. She was definitely in the wrong assaulting him like that, but doesn't make the teacher right for snatching her phone. Obviously there should be consequences for her actions, no short of expulsion imo, or severe reprimand/suspension/final warning if they wanted to be more merciful, as assaulting teachers is in no way ok for students and should be taken seriously. As for pressing charges, I suppose that's up to the teacher if they want to. Point is this all could have been avoided with proper disciplinary measures in place.

She needs to go to JAIL!!!
Right on,

Expelled and charged. This is definitely aggravated assault.

The teacher should not have taken her phone away but have taken her out of the classroom. It was childish to grab the phone like that. Committed battery, by pepper spraying the teacher. She should go to jail, not just be expelled. She could be sued as well, well, her parents anyway.
Parents are failing their kids by not teaching them to respect their elders, honoring those around them, and taking schooling seriously. This young woman needs a reality check.

I personally don’t give a damn about respecting my elders. Respect is something earned, not given. When my elders can earn that respect, they can have it. Just because they’re old doesn’t mean they need respect.
Parents also need to be held accountable for raising a child with no respect!!!
Sooooooo many it's disturbing
You but you butt they DO. BUT The real people who are the real slime balls are the parents. I would never allow one of my children to do that. @viniciorangel6223 I agree her reaction was over the top but times have changed. These teachers are just as much a stranger to that girl than a random guy walking down the street. If random guy snatches your phone, you have the right to spray em down. They can punish her all kinds of ways, failed the test, detention, suspension. I don't agree that teachers should be allowed to steal your property or put hands on you in any circumstance. Outside of school they'd be the one getting arrested.
@@StephenBarter-bj5rd you’re right, times have changed… corporal punishment is only practiced in 14 states now. Children carry tiny computers that give them dopamine with every notification they receive. Teachers get assaulted for doing the job they’re paid to do by attempting to educate their students effectively through removing their distracting addiction. Good or bad, a student - teacher relationship is incomparable to two strangers passing each other. All of the teachers information is accessible, making it easy to press charges for theft if need be but that’s certainly not the case here. The risk of losing their job also holds them far more accountable than a stranger. By no means, does this teachers actions call for self defense from the student.
