Hey Pace, need some help with a Sub2 issue I’ve been facing recently. I’ve done about 5 Sub2 but the last two I have worked on structuring fell through. Both sellers had an fha loan and wanted to sell and move into a bigger more expensive home using another fha loan or a special builder loan program. The problem came down to the loan officer who did not approve of the transaction. This was due to the debt to income ratio. I tried to also take the angle of “leasing the property” as well as explaining that we would be using a third party servicer to conduct payments. Neither would suffice and I’m not sure how else to get past these loan officers. Any advice or suggestions would be appreciated.

I recently structured a subto deal with a VA home owner, she brought the contract to her lawyer who then accused me of trying to defraud the VA and killed the deal. Would you mind sharing where it says that you can sell via an agreement of sale?
I'm a lender. VA allows for an assumption. If assumed by a vet, the eligibility CAN be restored if assumed by a vet with eligibility. VA does NOT address sub2, at all, and never has. That is a myth. The servicing aspect is not of any help with an underwriter. It's just not. The guides are clear on what lets an underwriter omit/off-set the mortgage debt, also. **VA home loan documents do not spell out that a homeowner, who currently has a va home loan, can sell on a agreement for sale or a land trust. He is conflating two things i.e. a seller's ability to sell on an agreement/land trust and a buyer's ability to purchase a home using an agreement for sale/land trust. In fact, the va guides don't even use that language, at all. Instead, the guides, which do not refer to the current owner, and instead refer to a buyer, use the language of land sale contract and option contract. Best to speak with a lender who is familiar with va guidelines.
