Session #1: Tier A MS4 Tree Removal/Replacement Model Ordinance: What is it?
Session Objectives: This 1.5 hour session will provide an overview of the NJDEP’s 2023 Tier A MS4 permit renewal requirement for permittees to, at a minimum, adopt and enforce a community-wide ordinance to control tree removal and replacement for all types of properties where the municipality has jurisdiction. The tree ordinance requirement is meant to be enforced community-wide to control tree removal and replacement to reduce stormwater runoff and pollutants, and to promote infiltration of rainwater into the soil.
This session will review the model ordinance template developed by the DEP that may be adapted, in whole or in part, to fit a municipality’s individual needs, making sure that the changes do not prevent the ordinance from meeting the permit minimum standard of addressing both tree removal and replacement on public and private property within the municipality’s jurisdiction.
