  • There are three general categories of intellectual property that can be protected under U.S. law: #Trademarks, #Copyrights, and #Patents.Trademarks protect a business' name, logo, or slogan from use by other businesses. Patents protect a discovery, invention, or idea. Copyrights protect original works of authorship such as writings, photos, music, movies, software, and architecture. In this episode of Learn About Law, Kevin O'flaherty we discuss copyrights and the requirements to register them.

    A copyright attorney explains the benefits of registering a copyright with the U.S. Copyright office. Just because your work of authorship is published on a tangible medium, doesn't allow you can sue for damages and receive legal fees. In fact, you can't even file a suit until your copyright is registered.

      Good morning! Thanks for reaching out with your question. Regarding registration, although copyright exists from the moment of creation, registering your works with the U.S. Copyright Office provides several benefits. These include the ability to bring a lawsuit for infringement and the potential to receive statutory damages and attorney's fees in successful litigation. Registration also creates a public record of your copyright claim.
      To answer your specific question about group registration: the Copyright Office allows for the registration of multiple unpublished works on a single application, provided they meet certain conditions. For written works like stories and poems, they can be registered as a collection if they have not been previously published and are owned by the same copyright claimant. You would submit them together under one title to represent the entire collection, but you should list the individual titles in the application.
      If the works have been published, they must generally be registered individually or in groups based on how and when they were published. For example, poems published together in a single book can often be registered as a single work.
      Given this information, the next steps would be:
      Evaluate whether the works have been published and determine the appropriate grouping for registration.
      Complete and submit the registration application, including payment of the required fee.
      Consider seeking professional advice to ensure that the registration process is handled correctly and that all works are adequately protected.

      Copyright protection exists at the point of fixation but you can only sue if you register it. This is federal law, also states have common law jurisdiction

      Yes. If you’re selling or licensing your works on US selling platforms or directly to US clients, and to have the strongest copyright protection against US-based infringers, you’re *ENCOURAGEd* to *QUICKLY* register your creative works with the US Copyright Office (USCO).
      As a general rule, works not quickly registered with the USCO are, too often, NOT enforceable for money damages.

      No; copyright protects creative works, like photographs, songs, artwork, books, movies, blogs, and other artistic works.

      Roberto 264 I have the same question I’m trying to make my own Indy game and I’m going to release a first part for free with the rest of the parts being purchasable but there’s so many characters in there and really don’t know if I can just copy write the brand name and what it’s about and then all characters that are featured in it and originate from it will be safe under my name so I don’t really know but I’ve got the same problem

      Your registered cartoon show would protect its individual characters, as long as those works are creative/expressive and copyrightable.
      When I write a book, my registered copyright will protect all copyrightable expressions in the book, including characters, plots, etc., unless the characters are not fully defined or are common place, like Santa Clause, a police man, a student, etc. Including *LOTS* of creativity to your characters can provide you with a STRONG copyright claim.

    Does state common law jurisdiction protect moral rights? I believe USA signed the Berne convention so federal law protects moral rights. If someone copied your work and infringed your moral rights of attribution, i would say it is fraud

      As of March 2024: Assuming there are NO errors or issues with your on-line copyright registration application and/or your uploaded “deposit” (aka, the work you’re registering) and you’ve included the correct filing fee, it can take, *on average,* 1.4 months to process your application (the processing range runs from about one-month to approx. 2.7-months). And it may take another week or so to receive your copyright “Certificate of Registration” in the mail. If the Copyright Office contacts you via email with questions and you don’t quickly reply, your registration approval can be significantly delayed.
