      29 January 2024 - The Court of Arbitration for Sport (CAS) has issued its decision in the appeal arbitration procedures _CAS 2023/A/9451 Association Russian Anti-Doping Agency (RUSADA) v. Kamila Valieva, CAS 2023/A/9455 International Skating Union (ISU) v. Kamila Valieva, Association Russian Anti-Doping Agency (RUSADA), and CAS 2023/A/9456 World Anti-Doping Agency (WADA) v. Association Russian Anti-Doping Agency (RUSADA) & Kamila Valieva)_
      • The decision taken by the Disciplinary Anti-Doping Committee of the Russian Anti-Doping Agency No. 9/2023 on 24 January 2023 in relation to Ms Kamila Valieva is set aside.
      • Ms Valieva is found to have committed an Anti-Doping Rule Violation (ADRV) under Clause 4.1 of the All-Russian Anti-Doping Rules of 24 June 2021 (the Russian ADR).
      • A period of four (4) years ineligibility is imposed on Ms Valieva, starting on 25 December 2021.
      • All competitive results of Ms Valieva from 25 December 2021 are disqualified, with all the resulting consequences (including forfeiture of any titles, awards, medals, profits, prizes, and appearance money).
      According to Clause 4.1 of the Russian ADR, athletes are responsible for any Prohibited Substance found to be present in their samples and the presence of any prohibited substance amounts to an ADRV. In this matter, a prohibited substance, Trimetazidine (TMZ), was found to be present in the sample collected from Ms Valieva on 25 December 2021 during the Russian National Championships in St Petersburg, Ms Valieva did not contest liability in that she accepted that, by reason of the presence of a TMZ in her sample, she had committed an ADRV under Clause 4.1 of the Russian ADR
      It was therefore a matter for the CAS Panel to consider what sanctions, if any, should be imposed on Ms Valieva pursuant to the Russian ADR, bearing in mind that, in the absence of grounds for elimination, reduction or suspension, the Russian ADR provide for a four-year period of ineligibility. In order to benefit from a reduced period of ineligibility, Ms Valieva needed to prove, by a balance of probabilities that she had not intentionally committed the ADRV by engaging in conduct which she knew constituted an ADRV or in conduct where she knew that there was a significant risk that said conduct might constitute or result in an ADRV and had manifestly disregarded that risk. Having carefully considered all the evidence put before it, the CAS Panel concluded that Ms Valieva was not able to establish, on the balance of probabilities and on the basis of the evidence before the Panel, that she had not committed the
      ADRV intentionally (within the meaning of the Russian ADR).
      The CAS Panel stressed that the test with respect to intention under Clause 12.2 of the Russian ADR is one and the same whether the athlete is an adult or a Protected Person. It means that if a Protected Person fails to discharge the burden (which under the Russian ADR is borne by the athlete) that he or she did not commit ADRV intentionally, there is no basis under the rules to treat them any differently from an adult athlete. Accordingly, since it was determined that there was no scope for the exercise of discretion to reduce the period of ineligibility, a four-year period of ineligibility was imposed by the Panel.
      The period of ineligibility starts on 25 December 2021 and any period of provisional suspension served by Ms Valieva is to be credited against that period of ineligibility. The CAS Panel also ordered the disqualification all competitive results achieved by Ms Valieva from 25 December 2021, with all the resulting consequences (including forfeiture of any titles, awards, medals, profits, prizes, and appearance money).
      The consequences linked to the retroactive disqualification of Ms Valieva from past events, including from the Olympic Winter Games Beijing 2022, were not within the scope of this arbitration procedure and will have to be examined by the sports organisations concerned.
      The Arbitral Award issued by the CAS Panel is currently subject to a confidentiality review meaning that the parties might request that the Arbitral Award, or certain information contained in it, remain confidential. For this reason, the Arbitral Award will not be published immediately on the CAS website. The CAS Panel’s decision is final and binding, with the exception of the parties’ right to file an appeal to the Swiss Federal Tribunal within 30 days on limited grounds.

      @@divinearia1601 kamilla coaching team is known abusive team who will do anything to get a gold it is reconised that kamilla did not taking it knowling in her case also thare was many outrages in russia and internationly so i dont see how u never seen it please look into her team they maylook postive but inside is just abuse. At the time of olympics she was only 15 where would a 15 year old get the nesserosy medicein to dope (sorry english is not my first lanaguge)

      Yet the ISU are still rewarding cheaters as the Russians are still getting a Bronze Medal in the Figure Skating Team event as opposed to its rightful owners, Canada.
      In other sports with relay or team elements, if one athlete on their national team tests positive for a doping infraction, then all members are disqualified.
      However, Russia still gets special treatment as they walk away with a Bronze Medal, not a clean team like Canada.
      ISU has always been corrupt, and their actions today proves it.

    The Russian athlete has never taken doping, not a single commission has proven this. The decision was not based on facts, but on theory... these are fantasies... on the basis of which honestly earned awards were specially selected. Political games.
    And now the United States will sit with other people’s medals, look at them and understand that it will never deserve these!!! That these are other people's medals!!!
    Is this a sport in the USA where you get awards by taking them away from other athletes? Ugh, how shameful this is!

      She admitted it but claimed she wasn’t aware of it or took it knowingly. I can def see that being 15, but both a and b sample were positive and the Rusada admitted it too and stripped her national title as only Russia could do.

    Ha. I guess the way I truly feel was DELETED by "somebody".
    But, I'm American, I don't want medals won by default.
    I LOVED seeing Kamila skate - she is MESMERIZING and DESERVES THE MEDAL.
    HOWEVER unfair it is to HER...the ADULTS AROUND HER THAT GAVE HER THE BANNED SUBSTANCES should be sent to the RUSSIAN FRONT! 😉

    Yet the International Skating Union just proved to the world that they are not truly promoting clean sport as the Russians will still have a Bronze Medal in the Figure Skating team event, and not an all out disqualification.
    In short, Canada is being robbed again as they competed clean in the Team Figure Skating event but remain in 4th place while Russia cheated and still get a Bronze Medal.
    If an athlete tests positive in other sports with team events, such as Athletics, Swimming, or Speed Skating, all members of that team are stripped of their medals, so why should Figure Skating get special treatment?
    If there was any justice at all, all members from the Russian team would be stripped of their result and Canada would get a Bronze Medal.

      The team event in Olympic figure skating is a points-based system. The Court of Arbitration for Sport disqualified only Kamila Valieva, not the entire team. Therefore the total team points drops down to 54 which is still one point ahead of the Canadian team.
      Valieva will also be disqualified from her fourth-place ranking in the Beijing 2022 Women's single event. Her two other teammates retain their rankings. Valieva will also be disqualified from her first-palace ranking in the ISU European FIgure Skating Championships 2022.

      Oh my god, since when these international sports organisations were about promoting clean sport? One must be absolutely naive or simply dumb not to see that this decision has nothing to do with the sports at all and it’s all about politics! Kamila Valieva is the world’s best female scater and they want to get her out of their way, as she’s Russian!

      By this logic, most of American athletes should not have any medals, cause they all take certain medications. And how about Norway Olympic team taking asthma drug? They are all suddenly suffering from asthma?
