    What if I didnt have workers compensation?
    I am being sue
    I have a small cleaning business
    Its just me and my wife so we dont qualify for workers comp, how ever we hire an employee and she is suen us
    Because I had only one employee, i didnt qualify either for workers comp
    She didnt show proof of ssn or work permit it was all cash
    What should I expect or do in this case?
    Please help

      Good afternoon, you are in a tricky situation. This is still a work injury claim and you may have defenses that you mentioned. You may want to reach out to a local attorney to discuss your defenses. There are several defense attorneys who will discuss your defenses but it sounds like you may have several. Good luck.     What happens when workers compensation insurance refuses to settle?

      This is a great question. For years we have seen this in cases where the employer was the state of Georgia. Both parties have to agree to settle. If the Employer refuses to settle, you will have to decide is there some form of work I can return to. If you are still receiving medical treatment that will certainly affect that decision. Remember if your claim is a non catastrophic you have 400 weeks of medical care and 400 weeks of income benefits as long as there is no change of condition for the better. Once that time period runs all benefits will stop.

      I’m in a reopened workers comp case.
      I received a small settlement 2016 but my shoulder ( rotator cuff tear) pain has gotten much worse( there is an MRI and x-rays to prove it. I have been doing therapy but it came to end where my doctor asked me if I wanted to do surgery but it’s not always 100% successful, so I said no I won’t risk it. In the meantime I was working part time. We try to settle, the insurance company made two offers we accepted the second offer and the day that the judge was going to call me so that he can ask me the questions about the settlement, my lawyer tells me there was a glitch from the insurance company and they don’t want to go forward. After that my lawyer tried to get in touch with the insurance company but they wouldn’t reply. He called the supervisor and the supervisor never returned the calls, etc..So we are now asking for a judge hearing, in the meantime I had an excruciating pain and went to the emergency. Next day I went to see my doctor who told me I can’t work and my arm is disabled. And he took me off work. He will again put me on therapy for six weeks And most probably after that he will write his report. in the meantime we’re waiting for a judge hearing.
      I’m so sorry for the long comment but I’m so confused about the whole thing. We were ready to settle and the workers comp insurance backed out the last moment.
      What happens when you go off work and your doctor tells you you can’t work and perform the tasks you were doing. I’m a house keeper. Do I go in workers comp disability? The doctor didn’t tell me and I forgot to ask.

      @@barblue3 I am very sorry to hear about your shoulder injury getting worse. I have to tell you, if you have an attorney, you should be speaking with them, they will know more details about your claim and be able to guide you as to the next steps. Based on what you are telling me, it sounds as if your attorney knows what they are doing and is moving in the right direction. I would encourage you to either schedule a telephone call with your attorney or schedule an in-person meeting. I hope you are able to find relief soon from your injury.
