After 3+ years, finally had an MRI and found out that I was right and they (workers' compensation Doctors) are wrong. Since had a history of gout right away stated that it was gout (crystal) blocking my knee to stretch in a normal/ resting position. Off work/ losing wage + have to drive a couple of miles just to receive a bs comment about my work injury + denied unemployment because I received WP's free medical bill only for a whole year. Sigh.
My attorney said that the insurance company didn’t act in bad faith by delaying my care for 7 or 9 months. And that the denial was reasonable under the coming and going clause ………I was a traveling technician, and they knew that.

I’m worker compensation through work, but not getting paid for lost wages. My hours just reduced on 12/4/2023. What can I do to get pay for lost wages?
So I have been paid on Edd Temp.Disab and I got email saying My disability has run out and I should apply for Social Security Disability. I’ve been on No pay since then n ss takes forever to their part. But I got restrictions n did my QME with Mmi but still on work comp n not been able to work yet, should I apply for unemployment?
04:10 In Texas that is different (I'm sure it varies by state). In texas after MMI they give you a "Impairment rating" which is how much the injury impaired your ability to do the job. The rating is given a percentage and based on that percentage you get paid 3 weeks for every percentage point of impairment based off the same rate as workmans comp. IE if they rate you as 10% impaired then you get 30 weeks of the workmans comp rate of pay.
I’m assuming nothing in your analysis would change if you plan on disputing that final admission of liability letter at the same time you file for unemployment as long as it’s within that 30 day window correct? Fantastic and extremely helpful video. Thank you
I would still file for UE within thirty days of the FAL. It really depends on what you want to dispute. If you dispute MMI and the DIME says you are not at MMI and you are entitled to TTD then they would take a credit for UE. (Sorry for the acronyms!)

What if they suspended your worker's compensation due to new injuries that have risen. Let's say a hip injury that wasn't reported initially. You then find out that you have a piece of your hip chipped off and it's in review. So they cut suspend your worker's compensation benefits because they insurance company said there needs to be a hearing. Is it okay to apply for unemployment at that time? I have no income coming in and I do have a lawyer and paralegal that I retained however, when I spoke to the insurance agent she told me that reason for my wages being suspended were because my doctors hadn't reported any injuries to them as of yet

I had a PPD from a previous vaccine injury. I was mandated to get the Covid vaccine and it was given at my job to keep my job (nurse). I got vaccine injured and was out of work without pay on FMLA from my jab injury (I never applied to Worker's Comp because, nor my doctor knew how long I would be disabled from my brain, heart, lung and vision injuries... I kept hoping any day I would be better. My job then fired me because I "took too long" while out on FMLA. They never called to tell me I was terminated and I didn't find out until I brought my Return to Work paper to work. Is this legal?

Hi, I fire my attorney so I'm not seeing a Dr. Can I apply for unemployment. Right now I'm in the process with M.S.C @130pm. I have no attorney 😢and I'm doing this by myself. I'm a stroke survivor at the age 28 too young to have a stroke but then God gave me a second chance to live and I took that as granted. 14 years take me to walk and move my arms again I am at 85% I believe. This is what I'm going to tell the judge, you honor with all your respect I'm a stroke survivor at age 28 I am 44 right now. It took me 14 years trippy will walk and move my arms. Depending on where you were injured you might be able to reopen your work injury claim.
