100 percent right Randy, here in Pa. They can't stop you in any water way that's navigational. We actually had a person who bought the land on both sides of the swatara creek and put a fence across the creek to stop people from using it. He was taken to court and lost. Thank God for that. He had to remove it from both ends of his property.

On this note, one could argue that bass fisherman have ruined bank fishing. When I've been bank fishing,, I couldn't count the number of times I've had bass guys troll right over my lines and baits instead of swinging out wide or avoiding me altogether. The same with guys coming or going full more leaving huge wakes where people are bank fishing. How about a video on boater etiquette towards bank fishermen?

I would agree... Too many times, us 'Poor Folk' without boats are relegated to bank fishing, and you guys in your $60,000.00 Bass Boats just act like we are INVISIBLE!!! I am a fairly accurate caster, and I have some damned heavy sinkers in my box. How about I clock one of these entitled Boaters in the side of the head with a 4 ounce pyramid sinker? Sounds like a plan to me. Truth statement, and you made it... "Some of these people with money..." SAME WAY WITH BOATS!!!

hello, I am a life long resident of Southern California. I often fish the San Diego harbor. And somehow this public water system has been over built with many marinas. Anytime I try to fish around or in the marina a security guard will come out and ask us to leave. And I have made a very similar comment that you are making in the video here. As a LANsurveyor I would think I would know a few things about property rights including the problem of our local government selling water rights that extend into the harbor. Unfortunately there’s not enough people specifically enough fishermen that care about the problem to do anything about it. And I do not have any idea where the money goes towards

I’m a lifelong (60 yr) fisherman and a 11 year lake house and dock owner. So I can give perspective on both sides.
For many many years I fished near and under docks and rarely had a dock owner complain or say anything negative. But I was always respectful and did not fish a dock if they were on the dock.
As the dock owner I’ve had countless bad experiences. While fishing from my dock I’ve had fishermen tell me to move because they want to fish under and around the dock. I’ve had countless lures hooked into boat upholstery, covers and line wrapped around my boats prop (boat is on a lift).
So some behavior you see from dock owners might well be influenced by a few bad experiences with unsportsmanlike fisherman.

I have run into a bunch of these types. When I was a kid we would access our lake. Wade up to our chest. That was the first time I got told that they own the lake bottom. I have been told how many holes I can drill ice fishing. Now a neighborhood says no one can enter a channel. I really question that it's legal. What I do now is ask people to show me the law in writing. They never do. Then I ask if I need to call the police. That usually shuts them up.

It doesn’t stop them from trying and cursing you out and I am guilty of explaining the law and using explanative language. We have that problem here in West Virginia on Summersville lake . The US ARMY CORP OF ENGINEERS has leased the marina and two coves to the Marina operator and blocked fishing on the entire area . There is only one dock approximately 20 ft long by 4 ft wide that is public to tie your boat up when launching or retrieving. The marina operator will threaten to have you arrested if you are not a paying slip customer and step one foot on his docks . Get this … now under the Summersville Lake Master Plan they are going to give him the entire parking lot for his exclusive use that was paid for with our tax dollars . This parking lot holds approx 100 vehicles . Even after public comments , letters written and phone calls made the Corp has still not changed their position .the local Bass Federations need to get more involved in fighting this mess as power in numbers ( votes) is all we have

  • @TomKirkman1

It is possible to own a dock, but you do not own the water around the dock. The only exception I would note is that if you are fishing around a municipal, state wildlife, etc., ramp or dock, you must cede right of way to boaters who are using the docks to launch or recover their boats. I had a situation a couple years ago where I was attempting to dock my boat and a fisherman got mad and told me I should wait until he had finished fishing it before I attempted to to dock my boat. I docked my boat - that's what that municipal dock was built for. Private docks on municipal or state waters is a different issue - no one can own the water. It is held in trust for the public. Fish it as you please.

I had a dock owner walk out of his house with a high power rifle and scope and come and sit on his dock as I approached. No words were exchanged between us. The man and his rifle just stared at me. I trolled at a distance around and away from his dock and fished the next dock. He watched me as I fished the cove until I went around the point. A little unnerving but I held my ground.
I try to be positive with dock owners. I usually have good success. I comment on the nice weather, their nice home and landscaping. I usually have nice conversations. Usually college football conversations come up.
If I see a family having a picnic or party or reunion or even fishing poles out, i give them wide berth and troll around and let them enjoy their day on the water. There are hundreds of docks to fish.

In Tennessee, if a land owner has river/stream frontage, and posts it, you can’t fish his half of the river. If he owns both sides, he can literally stop all fishing/boating in his section. I’ve never had a problem, but it HAS become a problem getting access. 20 years ago, you could park your truck, unload a canoe, and nobody said nothing. Now, most are roped off. Course, the problem started when people started coming to these places by the 10’s, popping up tents for the weekend, shooting off guns, drinking, leaving their trash, and generally raising hell. People got tired of it. I don’t blame them.

This is if you are on foot. If you are not touching the land for example in a kayak, boat or other floatation device nothing can be said until you touch the bottom. I went down this road with someone where I had fished a creek my whole life. I called the warden he came out and told him that as long as I'm floating and not touching the land he can't do anything. This guy owned the land on both sides of the creek. Twra and the state of TN owns the water.

I am sure it goes on down here in Florida quite often,,but fortunately I have never had a run in with anyone. We all just need to come to an understanding of sorts..we as fishermen are for the most part the front line conservation fund providers thru taxes on nearly every piece of equipment we use and those dollars at least here in Florida support all sorts of projects as land purchases, boat ramps, stocking programs and advertising, so we are entitled to have a voice at the table because without us none of this happens, When confronted by these landowners...best to just move on and contact you local officials and get it sorted out. After all it all belongs to us all as stewards does it not?

I have a boat dock with a boat lift for my bass boat and I get to go fishing almost every day if the weather is nice because I’m retired. Any yes you can fish all around and under my dock anytime. But what if I decide to fish off my dock instead of going in my bass boat? How close would you fish to another bass boat that is actively fishing in the lake? What if I’m cat fishing and have 6 rods in rod holders cast out in the lake or have little kids bream fishing from the dock? Think about that. Oh, and how close would you run your boat on plane next to a boat fishing in the lake? Don’t the folks fishing from the dock deserve the same courtesy and consideration as folks fishing from a boat? Sure, you can fish a dock, but I wouldn’t do it if someone was already fishing from it, or at least ask first. Remember, if you’re close enough for me to “accidentally” bounce a little George off your head, well then, that’s too close.

There are two sides to this discussion and you usually acknowledge that. That aspect of the problem stems from fisherman who do NOT respect the private property of others (the land and dock owners). You wind up with dings in the gel coat or paint on your boat because of fishermen who get too aggressive with their casts. Sometimes guys will tie off and fish from the dock, leaving behind a mess on occasion. It's always the few who make things worse for the majority and that is true on both sides of the discussion. My guess is 99% of the docks you have fished around in your life you never had any issues, but just one jerk is all it takes to make a terrible impression. The last thing I'll mention is that some lakes are public bodies of water and some are private. They should be fished accordingly.

And that same law that ALLOWS adjoining property owners to put docks on lakes ALLOWS us to fish those docks. And to walk on those docks if we so choose. And to hell with their "damage' claims. Their dock damaged my boat.

Well in Georgia if it is a public lake, they have no right to say anything at all. They still try at least some of them do. If it's a private late that's another matter. The one thing to point out in our state, is that any public body of water be it a creek a stream a river or a lake, the state of Georgia owns all of the land from the edge of the water to 3 ft back. On the other hand I also see videos from the Alabama Bass council, about people have to have pool noodles on their cable, a light on their dock and feeders on their dock. Or the council will confiscate their docks. Speaking only for myself I don't know where the Alabama Bass council guess it's authority, but nobody is stealing my private property.

Even worse than this here in Austin, TX (Lake Austin) the rich homeowners complained about the hydrilla and of course used their money and influence to released invasive grass carp into the lake which ate all of the vegetation. Now the lake is dirty as hell and the shoreline is eroding and the bass habitat is severely impacted but at least the rich folks don’t have to feel any grass on their legs when they are wakeboarding now 🤯

This goes both ways. Yes, there are some dock owners who are jerks, but there are also some fishermen who are jerks. I'm both a dock owner and a fisherman. I get lots of guys fishing around my dock and in most cases it's all good. Most guys are polite and fun to talk to. But there are others that give all fishermen a bad name. I've found line wrapped around my boat prop and lures snagged in boat covers. There needs to be some respect for my personal property -- at least clean up your mess if you snag something on my dock. I've even had a guy complain to me about making noise on my dock when he was fishing -- seriously??? I've also talked to guys who said they pulled 100 crappie off my dock over a few days. I don't mind folks fishing around brush piles I spend a lot of time and effort maintaining, but the guys that come in and completely clean out an area that I maintain for my kids and family to enjoy really tick me off.
I'd also argue that dock owners provide a benefit to bass fishermen. The lake I live on is a large southern reservoir without a ton of natural cover, so boat docks provide a huge percentage of good cover for bass. These things can cost $50000 or more in some places these days so are not a trivial investment. Like I said, most guys fishing around my dock are great and there are no issues. But the few bad apples (both dock owners and fishermen) really do give a bad image to everyone unfortunately.

Shoreline management is typically the responsibility of the entity that constructed the dam which created the impoundment. For Table Rock Lake, it is the Army Corp of Engineers (ACE). For other dams it is typically an electric utility, and in some cases the federal government (e.g., TVA dams). Lot owners on the impoundment are almost always required to apply to the shoreline manager for a permit to erect any structure, including docks, that extend past the shoreline. Table Rock's Shoreline Management Plan is accessible from the ACE website. On Page 13, under *PUBLIC'S RIGHT OF ACCESS AND USE, it reads: "The issuance of a Shoreline Use Permit *does not convey any real estate or personal property rights or exclusive use rights to the permit holder. The public’s right of access and use of the permit area must be maintained and preserved.** Owners of permitted facilities may take necessary precautions to protect their property from theft, vandalism or trespass, but may *in no way preclude the public right of pedestrian or vessel access to the water surface or public land adjacent to the facility.** Consequently, the dock owner may not restrict access to the surface water upon which their dock or marina is situated. That property does not belong to them. The same is true in every state I've checked. The water with the REAL ISSUE is non-navigable streams, creeks, and rivers as explained in the post below.

Here’s one for ya’ happening in Georgia….. you are fishing navigable creek/river in your John boat and come across a “Posted, No Fishing” sign…. Can you fish as long as you are in your boat? In the majority of the cases, the answer is NO!! If the landowner owns both sides of land adjacent to the creek/river and the creek/river is not a “navigable” waterway. Here’s the catch, GA law defines “navigable” waterway as any that routinely handles freight for commerce. Hell, that covers 99.9% of the streams/rivers we have.
This was brought to my attention in a recent article of Georgia Outdoor News magazine. Seems some trout guide(s) are leasing land on the upper reaches of the Chattahoochee River (above Lake Lanier) and attempting to have sections of the river as their own personnel “honey hole”. Completely legal.

More and more of the lakes I have fish in the Northeast, are engaged in Eurasian Milfoil "management" (eradication is more accurate). When this primary habitat is destroyed, the first place baitfish - and the gamefish that rely on them for food - go is to boat docks. Many lakeside homeowners in favor of this type of "scorched earth" weed control think the fishing improves after the weeds are gone because they are now catching bass right off their docks (which only lasts a season or two at best). Will somebody please tell me where I'm supposed to fish for bass when their habitat is destroyed? The obvious answer is docks, but the same people catching bass from their docks don't want you to. They want it all. No weeds and no fishermen by their docks. They don't want to live on a lake and all that goes with it. They want a HUGE swimming pool that looks like a lake. Sorry, you can't buy a house on a lake - a complex living ecosystem - remove vital fish habitat that if available would have me fishing elsewhere, AND then yell at me when I fish by your dock.

In Ohio if you own a dock on a Public waterway or a watershed. You have no right to the water, you can't stop people from fishing around your dock. I've educated many homeowners and police over the years after many confrontations. Because even the officers would threaten me until I would tell them to look up the Ohio department of natural resources laws on public waterways. And then after they would, all of a sudden the cops would be nice and the homeowners would act like children who didn't get their way.

I think only a couple states have it right as far as rules on marinas. Basically up there if a dock or marina is on the main lake or the over a creek arm or part of the lake that was either natural or formed when the dam was built, it's fair game to fish, no matter how many signs or other are posted, their conservation officers will not make you leave.
However, if when the marina was built, the marina owners perchased property on the lake and then dug away that property to make a new cove or section of water and then built the marina on that new water.....that is their property and they can make it private and no fishing.
Sometimes I fish marinas regardless of weather it says no fishing or not and if someone says anything I will have a discussion with them and explain the water is public and managed by the state or federal government which I pay for with my taxes, so I'm going to fish that water... with all due respect, I really don't care what you say. If you don't like it, call fish and wildlife or DNR or whatever the entity is that patrols the waterways. then if they keep going on about it, i just ignore them completely, or sometimes if they are real rude and nasty, I will start recording them and I tell them to come out here and make me move then.
My favorite is the little private dock owners who really have zero say as to weather someone fishes their docks. I will often quote state water statutes when they come out and start hollering about me fishing their docks. They simply have a platform over public water.......sure, they own their dock, but they do not own the water under it and they have no rights at all to say anything about fishing under their dock. I love the Karens and Chads that try to say their docks and the water they cover are private property and they pay all this money to live in their live in their gated communities and they pay money to whomever manages the waterways and to their property and homeowners associations to have the right to the private docks, water and beaches. those people I intentionally mess with cuz they have no rights to the water. I dont usually run gopros but I will act like im running one and start acting like im streaming live to facebook and laughing about what they are saying. sometimes you gotta egg these people on and get them to call the cops so that the cops come out and get mad at them for wasting their time.
when you find a dock owner like this that acts like a complete karen and acts like they own the lake, you gotta put a facebook event out and put a map point on their dock for a gathering of anglers. Like the guy did for the karen that shot him with a waterhose. there was like 30 boats fishing this ladys dock the next weekend and she actually got charged for harassing an angler. we all need to do more stuff like this. when you find a nasty private dock owner, ping their dock and set up a fishing event there so everyone goes and fishes their dock to mess with them and get them to stop being a jack

Check your rights out with the DNR. I live in Wisconsin, and the waters are public domain. You can't get up on the dock, but you have a right to fish everywhere around it, or under it. The rules change by state, but they shouldn't. Our laws are based on the Northwest Ordinance from a couple hundred years ago. Look it up.

If it is a federal impoundment the government owns the lake. So, they probably have to lease the land from the government to build the dock or marina. I do not know how it applies to fishing the waters contained there in.

This gets to a national issue which is the loss of public access to private interests (money). For Pacific NW fishermen, it's largely about fewer legal places to access rivers. We are slowly seeing our American outdoorsman heritage taken away by private interests. This goes for public lands too. We need to stand up!

Parallel: in most states it is illegal to harass a hunter or disrupt a hunt. Introduce legislation to make it illegal to harass a fisherman. Legislators will listen when you present the numbers of votes from fishermen and the possibility of withholding those votes from an anti-fisherman friendly official.
