I think we have to come to grips with the fact that our entire system of governance and the Constitution is a paper tiger. It depends on everybody playing by the rules, and one side doesn't. This collapse began when Reagan got rid of the Fairness Doctrine and gave Rupert Murdock permission to set up shop on these shores.
Spot on. I'm English, when Reagan and Prime Minister Margaret Thatcher joined in an unholy alliance, planet earth began to self-immolate. And both the UK and the USA are still bearing the consequences of that partnership. And this managed decline of the UK's economy began with the mutual appreciation between these 2 politicians from the depths of hell.
The people of America need to rise up in mass protests against Trump taking office. This needs to be nation-wide and sustained. If the people voted him in then the people can vote him out at any time by demanding his resignation. But alas, the American people don't have the passion of the South Koreans. There may be a time, though...
So disheartening and so disturbing to know that multiple opportunities to follow and abide by the guidelines of The Constitution, and all were ignored, or swept under the rug. It's so hard to have any faith whatsoever in the United States Judicial System, as we once knew it, anymore. My parents would be horrified, were they still among us, to witness this sad state of affairs. I don't know about others who support the side of what's moral, right, and decent here, but frankly, I am afraid of the future. Genuinely. And there seems to be no way to stop this roach of a man.. Thank you, Mr. Romano, for your expertise and decency. I became a subscriber shortly after the disastrous results of the election became known. I come here to validate my beliefs, which align so closely to yours. It's a huge comfort to know that some people still possess a sense of wisdom, compassion, and moral character.
Can be done. He is awaiting sentence on charges for which he has been convicted. Get the sentencing done before Jan 20th. and he won't be able to be sworn in.
He was already adjudicated to be an insurrectionist in both the Colorado case and in the second impeachment. The SC did not reverse those findings. No further sentencing is required - disqualified is disqualified unless both the House and Senate clear the disqualification with at least a 2/3 vote.
So if he is already disqualified then why is there no formal vote set yet to remove his disqualification?? The reality is that Trump has no disqualification since Congress has not invoked a disqualification against him in accordance with section 5 of the 14th Amendment.
You are 100% correct, unfortunately. Congress has proven itself to be a self-interested body intent on enriching themselves. Long have they forgotten that they are public servants elected to serve the people. They serve themselves and big money. Period.
There is a typo in your comment. The word "Congress" should read "Republican Party." The democrats in Congress impeached Trump twice and conducted the Investigation of the Jan. 6 Insurrection, along with republicans Liz Cheney and Adam Kinsinger.
@@mikewagner2153 I stand corrected on that point but don't forget that Nancy Pelosi and her husband had huge monetary gains by trading stock and she adamantly opposed any legislation limiting/forbidding politicians from stock trading.

I think that the most disgustingly disturbing thing about the whole ordeal is, there are so many villains that have been working for so long to surround us that it makes my head spin!
So many people in powerful positions have taken oaths to protect this and enforce that, but they never do. This clown should have never been able to run. Instead of delaying court cases to see if he's going to win, we should delay their ability to run until the court cases are over. The supreme court just runs amok with no regulation or restriction, and that has to stop. But we need a big majority in Washington to do that.
Sadly, we have such a spineless, weak, and corrupt court and legislative system. The people who claim to represent law and order will not step up. It's so disgusting, so frustrating 😫
The problem with this amendment is there is no punishment for attempting to take office after having taken part in insurrection. The other problem is that, like any law it needs to be enforced and if no one is willing to enforce it, there’s really nothing that can be done. We have an entire establishment who is unwilling to uphold the constitution.
Thank you for addressing this. I’ve been wondering why you haven’t and why some others have not. In my heart I’ve known nothing would be done and you have confirmed that. It’s so disheartening. We all feel it.
Even though I appreciate your thoughts; NOBODY will stop Trump. The Supreme Court has already given him CARTE BLANCHE to do WHATEVER the FUCK he wants!
The supreme Court is protecting the elected president, Congress must do their Job for the sake of themselves, their daughter, son's,and other relatives..we are all human beings and I am sure 💯 that they will not happy for other politicians to the same to hurt their family.Again I 🙏 that Congress must come to realization, before it back fires on them.
He’s got an iron grip in the Republican Party, how did he manage this?? This is a serious matter, I am absolutely shocked by the American government, and the simpletons that elected him
Rules, smules! Those are for the little people - just ask Marrick Garland. Clearly we have laws and clearly they don't apply to the wealthy or politicians.
Perhaps a naturalized citizen or someone under 35 should push to be put on the next ballot and demand congress take up the issue as is required for an insurrectionist.
Jessica Denson is the TH-camr he’s referencing. So here’s the thing, even if Congress doesn’t act, they need to be pressured to act and held accountable for not acting. If the issue is raised to a vote, then they are placed in the spotlight, and on record, as either violating their oath to the Constitution or satisfying their oath. We can sit here and point fingers at who should have done what and who failed, etc., but if we the people sit by and do nothing then we are just as accountable as those Justices, Senators, and Representatives whom we blame. They work for us, not the other way around! So, in that vein, there is going to be a protest in D.C. the 3rd through the 5th (currently being organized). Jessica gives details on how to get involved and where to register. I would also urge you to contact your elected officials to voice your demand that they adhere to their oath and force a vote. Take a stand and be counted, or know that you willingly chose to look the other way and thus willingly forfeited your rights.
The beautiful thing about the 14th is that Congress has to act to allow him to be sworn in. No vote means disqualified. No vote means the process in the Electoral Votes Act applies. The only electoral votes that can be counted are for fully qualified candidates. No action from Congress means Harris becomes the president on January 6th.
@@RechargeableLithium But that isn’t going to happen on its own. Democrats in both houses are going to certify in order to avoid drama, and have pretty much said as much. Only pressure from their constituents can possibly push them to take up a vote on A14.3. And while it’s almost a certainty Trump will become president, perhaps we can get on record which members of Congress honored their oath and which did not.
Speaking as a retired member of the military... the military is prohibited from acting against US citizens by the Posse Comatatus act, unless a national emergency is declared. Like, maybe, the insurrection act, oddly enough. You must do your job! The military exists to break things and kill people. If you wait for us, you will not like the result. Neither will we. I was happy to hear that you are an experienced lawyer specializing in constitutional law because I think that gives your commentary a great deal of gravitas. While my respect for our Constitution remains intact,my respect for Scotus has plummeted .They seem to be practicing what I call balloon animal law.First it's a dog,now it's a giraffe, now it's a crane which would make our Supreme Court justices hired clowns performing at a birthday party.I particularly liked senator mcconnell pontificating (I call it harumphing) about constitutionality and pr in nciples to keep the court seat open until AFTER the election then quickly reversing that position to put Amy Coney Barrett on the court like she was shot out of a cannon! No wonder people are (just a tad) cynical.I do appreciate your legal and poltical analysis. All of us need to stay engaged. This is our country.
Unfortunately, his supreme court(sic) cleared him and his zombies voted him in. Now we have to brace ourselves for his last term. Whatever happens after he leaves is up to an ethical legal system.
The 9 to 0 decision over the Colorado case was the greatest piece of injustice since justice was established as a concept in this planet. It was also what opened the doors to fascist revival in the US. The US presidential elections are a series of state elections, not federal, and the public chooses electors. Therefore state legislation is the only rule.
Sorry, this is incorrect. The 14th (and the other 3 requirements in the Constitution) are for being sworn in - for actually taking office. The SC's decision in the CO case was correct because the Constitutional requirements are for taking office, not running for office. Recall that Biden ran for and won his first congressional seat when he was too young to be sworn in. He had to wait until a birthday in order to meet the requirements off the office. Same for the Executive - one cannot be sworn in unless they are qualified.
I do not understand his inaction. Is it corrupt? I don't think so. I simply think he should have been on the Supreme Court rather than his current role. He is super methodical.
He should be disqualified! Let's enforce section 3 of the 14th Amendment otherwise everything we stand for will be a joke to the world! One of my friends is leaving the US for good, her son is 5 and he doesn't understand the pledge of allegiance everyday at school. Giving the circumstances, this is the biggest joke.
The action that Congress needs to take is to vote to absolve him of insurrection. It's a very clear statement. It doesn't matter whether or not they are going to absolve him. They need to be on the record.
Exactly! S3 of the 14th makes clear the candidate is unqualified unless/until the liability is cleared by a 2/3 vote in both the House and Senate. No vote=unqualified. No vote means the rules of the Electoral Counts Act prevail. Votes for a disqualified candidate are nullified.
The Constitution’s 14th Amendment doesn’t prevent him from campaigning or even appearing on the ballot, but it DOES prevent him from serving in office at this stage. Unless Congress clears a path by two-thirds majority.
The law in every state is that only those who are qualified for the office are allowed to appear on the ballot. The 14th amendment disqualifies him, and thus, by logic, he should not have appeared on any ballots.
@ That sounds excellent… and yet there was the Supreme Court decision and Colorado as an inescapable example to the contrary. I’m willing to throw in the towel on that early stage stuff, but I draw the line at his inauguration, which the 14th A clearly prohibits without Congressional override.
@@TheRomanoReport Ultimate Joe Biden must uphold the Constitution, and the Supreme Court has affirmed that he has incredible powers to force Congress to put it to a vote.
The SCOTUS ruling only ruled on whether Trump could remain on the ballot and said congress would have to make the decision/rules. At this point, Sec 3 enforcement would keep him from being sworn in; it has nothing to do with a state's ability to remove him from a ballot.
It's mind boggling that THE PEOPLE are more incentivized to implement the rule of Law than Congress is. What do we need them for then??? They're not fighting for us or with us.

Yes, and one of the worst injustices is that a sitting president cannot be indicted for crimes.WHAT ?! why exactly? That is why we elect a Vice President, to fill that gap when the criminal president goes to jail, and go to jail he most certainly should.
Now that is an interesting question. Honestly, at that point, it would be easier to just impeach and remove him. But to answer your question, yes they could.
I would respectfully say though that once he takes the oath and assumes Article 2 powers that he could at that point in time only be removed via the impeachment process or the 25th Amendment.
The US has to restore law and order and remove anybody from office that does not abide to the written law. (I leave out the details with intent because of HERE)
Laws are only effective if enforced. Our legal bodies do not enforce the laws in place. And, why is it that we have so many laws, like Roe v. Wade, that were never codified?
@@cathyallen3967 Nope, unfortunately for all of us it doesn't work that way. There is no constitutional provision for a "snap election" in the United States. In addition, it takes up to a year for states to prepare for presidential election cycles.

I have been since Nov. 6th...and continue to...I was just getting ready to contact Bernie Sanders. fyi...Plan on marching in the Women's March...I'm Marching in Spokane, Wash in Jan...It will be Nation Wide...Google info in your area...we can't give up!!
How to get ahold of senator raskin?
@ I don’t think youtube allows me to leave a phone number. Simply google Representative Jamie Raskin DC…. That worked for me
Go on Lights on with Judith Denson. They are marching in DC from January 3 to the fifth.
She's Jessica, not Judith
I think we have to come to grips with the fact that our entire system of governance and the Constitution is a paper tiger. It depends on everybody playing by the rules, and one side doesn't. This collapse began when Reagan got rid of the Fairness Doctrine and gave Rupert Murdock permission to set up shop on these shores.
🎤 drop
I'm so glad someone finally said it!! Thank you!
Exactly Correct!
Would sure like to get rid of this Supreme Court
Hear this Supreme Court: we don’t want you
The people of America need to rise up in mass protests against Trump taking office. This needs to be nation-wide and sustained. If the people voted him in then the people can vote him out at any time by demanding his resignation. But alas, the American people don't have the passion of the South Koreans. There may be a time, though...
There is going to be a protest on January 4-5-6 in Washington.
I think it’s beat to ignore him for a while. Don’t watch cable news. He hates low ratings and seeing sparse crowds will depress him.
He WASNT VOTED ON WITHOUT THE PEOPLES VOTE BEING "REARRANGED"
@@Jayne278I don’t have the money to be there , this should be organized everywhere.
Thank you for your kind words. I really appreciate it. And thank you so much for watching and for subscribing to my channel.
@@RechargeableLithium So why is he not in Jail ?
Insurrection disqualifies someone from office. It's not the same sort of crime as grand theft auto or murder.
@@heatherwhaley7623Out of the over-generalization frying pan into the whataboutism fire. Paul Pelosi was a San Francisco venture capitalist well before Nancy was in Congress. Think about that. The silicon valley startups disclose way more info directly to VC than they ever gave to Congress. Paul could have made way more money from his direct access to VC info, but as he said, "I religiously steered away from anything that would look controversial to her [Nancy's] position."
HAPPY NEW YEAR, Romano. You are awesome and I do thank you for sharing.
And happy new year to you, my friend!
Sadly, we have such a spineless, weak, and corrupt court and legislative system. The people who claim to represent law and order will not step up. It's so disgusting, so frustrating 😫
I agree with you, I read a lot and yes he is not the president suitable , he doesn't have qualifications,
The problem with this amendment is there is no punishment for attempting to take office after having taken part in insurrection.
You're welcome. Thanks for watching!
Even though I appreciate your thoughts; NOBODY will stop Trump. The Supreme Court has already given him CARTE BLANCHE to do WHATEVER the FUCK he wants!
This is the best explanation on this issue that I have heard so far. Thank you sir.
My pleasure. Thanks for watching!
Where’s the money in your statement? We’re not talking about just people, these are bought and paid for robots
Less than two years we can vote these idiots out of office
That is if we still have a country left
"You'll never have to vote again!" ~ djt!
@ then we have to have a cue
He’s got an iron grip in the Republican Party, how did he manage this?? This is a serious matter, I am absolutely shocked by the American government, and the simpletons that elected him
Money is the answer to every question. Or more correctly, power, but money is how you get and keep the power.
wow a lazy supreme court has failed their duty!!!
Rules, smules! Those are for the little people - just ask Marrick Garland. Clearly we have laws and clearly they don't apply to the wealthy or politicians.
I appreciate you talking about this, but nothing will get done, ever !
Unfortunately it wont
Perhaps a naturalized citizen or someone under 35 should push to be put on the next ballot and demand congress take up the issue as is required for an insurrectionist.
YES!
And while it’s almost a certainty Trump will become president, perhaps we can get on record which members of Congress honored their oath and which did not.
it's an open and shut case. So, naturally it doesn't apply to Dump.
I was hoping the military would honor their oath and enforce the constitution putting a stop to this with as much force as necessary!
MSgt Out.
That would be unconstitutional.
Thank you!
Thank you Romano. You are awesome. 🎉
Totally 😊
You seem like an Excellent lawyer. I love it when you state "he is disqualified". In a nutshell.
Unfortunately, his supreme court(sic) cleared him and his zombies voted him in. Now we have to brace ourselves for his last term. Whatever happens after he leaves is up to an ethical legal system.
Oh, you think he'll leave? Really? Can't say as I'm so sure about that....
MERRITT should have been fired from AJO .
I do not understand his inaction. Is it corrupt? I don't think so. I simply think he should have been on the Supreme Court rather than his current role. He is super methodical.
@jeaniescosmicserendipity He's either a total coward or a maga tool. Remember, he's a lifelong R !
Americans keep deciding their laws don't exist or not to enforce them because... random excuses.
Mock Trump, mock Congress, mock Senate, KEEP MOCKING
The action that Congress needs to take is to vote to absolve him of insurrection. It's a very clear statement. It doesn't matter whether or not they are going to absolve him. They need to be on the record.
Exactly! S3 of the 14th makes clear the candidate is unqualified unless/until the liability is cleared by a 2/3 vote in both the House and Senate. No vote=unqualified.
No vote means the rules of the Electoral Counts Act prevail. Votes for a disqualified candidate are nullified.
Oh well people buckle up because Trumpsky will be taking a dumpsky on us all.
And who will prevent him? Congress won't do a damn thing.
@@TheRomanoReport Ultimate Joe Biden must uphold the Constitution, and the Supreme Court has affirmed that he has incredible powers to force Congress to put it to a vote.
The President cannot force Congress to vote on anything. Also, this is Joe Biden we're talking about. He wouldn't do a damn thing even if he could.
I want to scream
The SCOTUS ruling only ruled on whether Trump could remain on the ballot and said congress would have to make the decision/rules.
At this point, Sec 3 enforcement would keep him from being sworn in; it has nothing to do with a state's ability to remove him from a ballot.
I thought he got impeached . That's action by Congress
I just found you! Thanks for sharing an opinion that I agree with 🥰
It's mind boggling that THE PEOPLE are more incentivized to implement the rule of Law than Congress is. What do we need them for then??? They're not fighting for us or with us.
There are three laws.....one for the rich...... one for politicians ......one for the rest of us.
Good 😊 Morning, And thank you.

It's very disappointing. But, I appreciate your honesty

A good argument that will go nowhere. Just like our justice system, our Constitution isn't as iron clad as we once thought especially since Trump.
Yes, and one of the worst injustices is that a sitting president cannot be indicted for crimes.WHAT ?! why exactly? That is why we elect a Vice President, to fill that gap when the criminal president goes to jail, and go to jail he most certainly should.
Elections have consequences. Voting wisely matters. Democracy requires an informed and engaged electorate.
Great channel Mr.Romano, please keep up the great work. America desperately needs to be in formed.
Thx for pointing this out. Ya, our Constitution is pretty useless if they won’t enforce it. God help us

Jessica Densen? Everyone is too terrified to do it and it’s a damn damn shame
Is it possible to do a disability vote if the democrats win the majority in the midterms? Then we can kick him out…
Now that is an interesting question. Honestly, at that point, it would be easier to just impeach and remove him. But to answer your question, yes they could.
I had the same question. Thanks.
Trump looks old and sick. He may not be around for the midterms!

I would respectfully say though that once he takes the oath and assumes Article 2 powers that he could at that point in time only be removed via the impeachment process or the 25th Amendment.

He is a mess! Kick him out!💙💙💙💙
The US has to restore law and order and remove anybody from office that does not abide to the written law.

There is a flaw in this. Trump isn’t the president. Elon Musk is 😂
Make them vote !
Appreciate your knowledge and integrity! It’s better to know the truth!
Laws are only effective if enforced. Our legal bodies do not enforce the laws in place. And, why is it that we have so many laws, like Roe v. Wade, that were never codified?
that article should mention mental illness also.
Even if it were possible we'd simply get President Vance.
Not necessarily if Trump isn't sworn in there may have to be another snap election.
@@cathyallen3967 Nope, unfortunately for all of us it doesn't work that way. There is no constitutional provision for a "snap election" in the United States. In addition, it takes up to a year for states to prepare for presidential election cycles.
SCOTUS will just say he is immune
Congress can Stop all of this by not certify this election, same thing for the justices

Why do you want us to obey in advance?
