    As a US ARMY Soldier, I swore oath for a reason. Here in the army we fully advicate for Equal Opportunity. Doesn't matter if you're gay, straight, lesbian, trans, man, woman, black, white, a furry, etc. You have rights. You are American, serving in the greatest military. You matter.
    I will not follow an unconstitutional order, I swore oath for that reason.

      Enforcement is not explicitly defined but it's obvious the VP must refuse to count votes for a disqualified person, and failing that, the Chief Justice must refuse to administer the Oath of Office to them. Any elector is free to engage in protest voting by submitting the name of someone under 35, or a non-citizen like Elon, or a fictional character like Batman. Voting for someone disqualified under the 14th no different.

The FBI went to my childhood neighborhood and walked down the street to ask people about me.       REAL law hasn't found him guilty of anything yet. Also 14th Amendment states:
      No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
      I don't know what you think its supposed to do in your favor. I mean, if we got rid of it then sure we could definitely stop Trump from becoming president, that would just take us dismantling the constitution to do it..... you know, the same constitution that you all think Trump is going to dismantle, just saying.

    I don't know why this hit me so late: How can Donald Trump swear to defend the Constitution when what he is planning to do THAT HE STATED WHILE CAMPAIGNING would be a violation of that oath? To do so would be the most public commission of perjury ever!
    So if he can't do so, how does he take the oath of office without committing perjury?
    And since he wouldn't be President at that time, where is the immunity that only resides with the President?
    I would also add that if he violates the oath of office, would that not then give the military and any government official that also swears to uphold and defend the Constitution the ability to possibly arrest/detain Trump for violation of the oath?

      The Supreme Court reviewed this case and ruled that Sec. 3 in its present form DOES NOT disqualify Trump from holding office. Their language was also extremely clear, as was, more importantly, their authority to do so.

      It certainly can be, here's how: Trump's disqualification could be removed by a 2/3 vote in both houses of Congress before Jan 6. That's unlikely to happen, so it must be enforced by VP Harris rejecting votes for disqualified persons during the Joint Session. Trump's electors can still change their votes up until Dec 17, accepting whatever penalties their states may impose for doing so, or they can stick with Trump as a dumb protest vote, which sends the election to the House (and to the Senate for VP election). That's assuming Harris takes her Constitutional duty seriously. Otherwise Chief Justice Roberts must refuse to administer the Oath of Office to Trump on Jan 20. Now I'm not betting on anyone to do the right thing, but wouldn't it just be super great if they all did?

    As much as I would like to believe that the highest-ranking generals uphold their oath, I’m not convinced. As the daughter of a Dutch sergeant major in the Air Force stationed in Blomberg, Germany, during the 80s, 90s, and 2000s, I often heard stories about the cooperation with Americans and the strong bond that existed. To my surprise, an American Army General responded to a post I made. He, too, expressed his fondness for the Netherlands.
    We reminisced about the damaged streets in the Netherlands and Germany caused by American tanks. He shared that he was the one who had to apologize to the Dutch government and arrange compensation for the damage. However, the Dutch tore up the bill and didn’t charge any costs, he told me.
    Then, to my shock, he revealed that he voted for Trump. Unknowingly, I had ended up on a Trump-aligned platform. He also said he had always believed those wars and American interference were unnecessary. I found that deeply unsettling.
    If a man in his late 70s, with his experience and rank, can vote for someone like Trump with such conviction, I fear the worst. It makes me believe that even at that level, they have been brainwashed. Biden must conduct a thorough investigation into the current generals. This is horrifying. It gives me a pit in my stomach.

      Do you understand NOTHING about the law??? The issue WAS DIRECTLY ADDRESSED!!! The Supreme Court UNANIMOUSLY ruled against Colorado. "UNANIMOUSLY" even includes all three liberal justices. States DO NOT have individual authority to decide whether a Presidential candidate is or is not an insurrectionist under Sec. 3 language of the 14th Amendment. Period. That enforcement rests directly with Congress under Sec. 5 of the 14th Amendment. Failure of Congress to act means they obviously did not recognize a violation of Sec. 3. It's over. Move on.

      That is the best answer and one that should be pinned on the very top of this forum. However, that would not fit the partisan progressive narrative of this channel. If I am not mistaken, the federal statute that had provided the mechanism for enforcement of the insurrection clause had expired so there is no current 14th Amendment insurrection enforcement mechanism law on the books currently.

    Shouldnt Kamala just refuse to certify until Trump gets 2/3 vote of both houses? She is a federal official and has jurisdiction over certification

      Nooooo listen to that again! They need 2/3rds of the votes of both the House and Senate in order to REMOVE the disqualification. Biden can actually enact 14.3 right this second if he wanted to…. And he has immunity backing him but it would take both houses 2/3rds of the votes to remove it and let him be inaugurated.

      That would not happen because Congress actually would have to enact legislation to provide a mechanism for the enforcement of the 14th Amendment Section 3.

      That's true but if more folks would have done there fact checking and understood how government works just maybe it would of went differently.
