      English Common Law. Law based on custom, precedents. Prior practice. Current Standards of decency. Evolving Morality vs Original Intent. Protection for convicted criminals, Bleeding Heart Liberals!

      Cruel and unusual is what the Supreme Court currently defines it as being.
