I'm a little confused by the original question. I thought the Patriot Act required a warrant to access cell phone records and that it established a court and procedure for doing so? If I am wrong, then it seems clear that a non-consensual search by the police of my cell phone contents would violate my 4th Amendment right, but the police accessing my phone records held by my cell phone carrier without a warrant or consent would not violate my 4th Amendment rights. Otherwise, it has never occurred to me that I have a constitutional right to avoid being "revealed" or to hide where I go. Future generations will probably laugh at us. We want all these electronic toys that let us access information a hundred times more easily than before, but how dare the government use that increased efficiency to learn about us.
