  • The state medical licensing board is considering the future of an Indiana doctor at the center of an abortion case.

      She did it without parental or guardian consent...which is against HIPAA law regarding minors. It doesn't matter if she gave identifying information or not.

    OB Doctors are stuck between a rock and hard place. I would expect this hell in places like Afghanistan or Iran, not in the USA, but here we are.

      All they have to do is follow the law.
      This doctor spoke about the case without parental or guardian consent..which is against HIPAA law regarding minors.
      The child could have received an abortion in her own state which has exceptions for rape, incest and mothers health.

      @@jenntip A rape victim could still be in danger after the rape. When a child is about to go through the worst times of her life because of idiots who know nothing about the female body doctors are obviously going to help her first.
      And not to mention what if the parents didn't consent?? Is she just supposed to let a 10 year old die??

      She was fined 3k.

      @@hp2474 yes I saw that this morning. They were there very late last night. I’m glad she didn’t lose her license. She could have they could’ve taken it away but the thing and understand she never said the child’s name so I don’t know how that could go against HIPAA laws, but I understand HIPAA laws. Thanks for this appreciate you guys answering back and being civil about it.

    I wish President Biden would give Dr Dr. Caitlin Bernard the Presidential Medal of Freedom- it would make a strong resounding statement for women's rights, health, self-determination, progress- no matter what this Indiana board decides- she is a true dr, advocate and hero

    I am against abortion but in this case it's needed.

      Abortion isn't wrong even if the victim wasn't raped. The fetus doesn't have life, it's not equal to a living person. Even if you have your "exceptions" in your mind, your still voting for raped children to die

      She never named the patient nor disclosed identifying information to anyone who didn't have a right (ie., she gave the records to the state as required).
      So the HIPPA claim never enters in since the only stuff she otherwise disclosed was age of patient, procedure and general condition. Those aren't protected items.
      You can, in fact, as for the number of people under 19, for example, that had appendectomies or splenectomies last month from any hospital. And YES, doctors discuss cases all the time, without identifying info. That's allowed.
