    सबसे पहले supreme court को किसन हक दिया की, दुसरो की property मे गलत कानुन बनाये, कानुन बनाना है तो gov property के लिये बनाये , gov. लोगो को मकान नही दे सकती तो ऐसे गलत कानुन बनाके समाज के विशिष्ट समुदाय (मालीक) को जान बुजकर court की तरफ जाने के लिये मजबूर किया जाता है , कोई किरायेदर कितने भी साल रहे, जब मालीक को अपना मकान वापस पाना हो तो उसे किसी चौखट पर जाने की जरुरत ना पडे,ये simple कानून है

      बिल्कुल सही, कोर्ट अपनी झकमारे government property में प्राइवेट
      प्रॉपर्टी में कोई भी कोर्ट को दखल नही देना चाहिए , चाहे १२ साल हो या १२००० साल owner owner ही रहेगा
      कोई adverse possession नही होगा

      This is not the intention of Supreme Court or the law. The law is very simple, if someone is sitting on your property for 12 years (which is huge number of years) and you did not even send one notice against such possession nor any rent was being paid then courts have to assumed you had given away the property and now you want to claim it back. For example sometimes father gives away a property to a friend or relative and after death of father and after many years, sons of the father can wake up one day and realize they can earn money by selling that property. By this time the given away property might have been built upon and was being used by the person who was given this piece of property as gift. It would be unjustified to make him leave the property. Unfortunately many property transactions in India are not registered and taking benefit of it some people re-claim their sold property. The intention of the law is to protect such people. You cannot buy a property for 12 years and do not check whats going on, on it.

      Most of the cases are related to tenants and they are reluctant to vacate the flat or shop then? In that case how he can become a owner
      ??? Just because he is staying ther for १२ years??? If father has not given property to tenants ad a gift
      Then son should throw tenants away righ??
      Also १२ years is very less time
      It should be minimum ३०-४० years because in India after ३०-४० years genaration generally changes
      And then it would be more justified

      If a person wants to give a gift, then he should register the property to his friend's name before his death and don't let people fight behind him and create confusion...

    कब्जा गुड्डा ब भू-माफिया ही करते हैं।इसीलिए ये बडाबा न दें। फिर तो गरीब किसान की पूरी जमीन छिन जायेगी ये गारंटी है।क्यौकि बटवारा ब हदबंदी के मुकदमे सालौ साल जानबूझ कर चलाए जाते हैं। ये सरासर गलत है।सुधार होना चाहिए।

      भाई जजो को कोई फर्क नहीं पड़ता, जो गरीब थे वह पहले भी गुलाम थे आज भी गुलाम हैँ और आगे भी गुलाम रहेंगे, यह अंग्रेजो का कानून जिंदाबाद था जिंदाबाद हैँ जिंदाबाद रहेगा, गरीब गुलामी के लिये पैदा हुए हैँ यह कोर्ट का फैसला हैँ यदि कोई ऑब्जेक्शन लेगा तो उसके परिवार को कोर्ट तहस नहस कर देगा कब्ज़ा कौन करता हैँ जो दबंग हो पैसा हो गुंडा हो नेता हो , कोर्ट मै मात्र एक बार जज बन जाओ पूरे देश का निर्णय मात्र एक जजमेंट पर, यह क्या हैँ और यह कानून कैसा हैँ इसमें न्याय व्यवस्था 1% हैँ क्या कोर्ट ऐसे गलत फैसले लेता हैँ और कोई ऑब्जेक्शन करने की हिम्मत किसी की नहीं, कितने गरीब कितने किसान, कई परिवार तो केवल रेंट से अपना घर चलाते हैँ ग्वालियर मै एक ने अपने घर को रेंट पर दिया 3महीने बाद वह आया उसपर कब्ज़ा हो गया 10 साल से कब्ज़ा हैँ केस चल रहा, सामने बाले पर एक भी मकान नहीं

    Even my Flat has been adversely overtaken by a local goon in Ulhasnagar. There no law exists as police takes no action and local lawyers switch sides when paid by the other party.
    I only Wish THIS CORRUPT LAW be NULLIFIED and REMOVED COMPLETELY for safeguards of orIGINAL property owners.

      I have long possession on owner property since 1953 i have rent receipts but since 1988 we are not paying any rent as owner denied to take it. Now owner don’t care of there property. We renovate it and paying property tax. Electric bills and water bill as well. Can i suit adverse possession case?? There is no agreement copy as owner is dead and their childrens not transferred property from their father to them since 1977.

      Nations are not built in a day. It requires participation of the whole society to decide on policies. Bharat had transfer of Power and independence came much later. Policies and law were not entirely made by Bharatiyas + we lost Lalbahadur Shastri an able prime minister and for these reasons
      We never had stable policies from our other leaders.only a Few played their part well.
      Bharat needs to work on its Judicial and police reforms. Work in these area is yet to be updated we have redundant and non functional system slow paced judiciary. This aspect has not improved even after 75 year of independence.
      Everything has to work in coordination i.e. social, economic , political and judicial matters has to work in co ordination then only there is hope of Justice to every strata of society is possible.

      Posession has to be - "Adverse" possession. Adverse means against the wish of owner . If tenant is paying rent the possession is not Adverse Possession . When tenant refuses to give rent and continues to occupy then only he is called to be in Adverse Possession.
      Possession has to be undisturbed uninterrupted If u have a property nd somebody else occupies it nd u didnt do anything to oust him for 12 years then it means u r not vigilant about ur rights nd hence law will presume that u have given up on ur rights.
      The person occupying ur property has to show undisturbed possession which means tha for 12 years no casewas filed by u or no legal step was taken by u to oust the occupier .

      There has to be a rental agreement between owner and the tenant. The rental agreement must be for 11 months, with term and conditions of rent payable on time, eviction if rent default on due dates as agreed. Eviction on completion of 11 month occupation, with advance to notice of 30days to the tenant by house owner. If the tenant and house owner both are willing to continue, the owner and tenant will have to make and sign a new agreement for another 11 months with new terms, rent, conditions, agreed by tenant, indicating the tenancy period is only for 11 months only, and the owner has the right evacuate the tenant with due notice, wel before or completion of 11, months tenancy.
      So 12 years of occupancy by tenant can be prevent by owner, by new tenancy every 11 months with the tenant, with renewed terms of tenancy agreement. Adverse occupancy does not, will not arise in any manner, to be claimed by occupant tenant.

    Actually, this 12 years usage was, for approach roads/foot ways. That is if a person/persons use the approach road passing through other's/other' properties and that path was used uninterrupted for 12 years for which the owner/owners did not object even after knowing that that path was being used by others, then after 12 years the real owner/owners can not object. That is why one can see the board, 'No thorough-for. will be prosecuted.'. on the properties.

    Sir, I want to ask a question, if owner has recorded 11 months 29days contracts renewed for 12 years and property tax is paid continuously by owner with water bill. Does the Tenant stand a chance to claim the ownership of that property. ❓️⁉️
    Like in Tanzania 🇹🇿 we have the law of 14, 30 days law for notice to Tenant to vacate vacate , this is on land lords choice to discontinue contract before it ends. Is there such law in India.

This act protects writes to those who are living on ancestors property which has not been transferred due to such issue where title has not been mutated due to costs was too high for gift deed to be written and pronounced.. hardly 30 years back there were 0 value in comparison to today's value of the said land .. before oral commitment has values and now documents has no values

It is possible that he is concealing the fact of the judgment he is referencing, where an illegal possessor purportedly acquired ownership after 12 years.

    Sir mere parents ne 97 mein ek plot purchased kia tha .nd tab se aab tak vo plot khali hai..means boundary nhi hui hai nd even we don't have registery coz we dont have that much money..nd due to parents laziness nd negelegency vo kabhi nhi hua...jha plot lia hai..vha goon rehtay hai nd vo plot mein apni car rakhtay h..so we r frightened ki khi vo kabja na kar le...kya humhri registery ban skati hai kya... disputed land toh nhi ban jaiga..coz we hvae just gpa nd will of laat owener jissay buy kia tha..nd vo bhi itna purna hai ki tear ho rha hai...pls tell...kya registry ho skati hai..plss..we r scared..ki ek hee zameen hai..khi vo hadap na le...😢😢..iss xase mein kya ho skata hai

    At video time 22:44 it shows the statement that an uninterrupted possession for more than 12 years was in the original owner's knowledge.
    So if the owner lives in USA and knows that somebody is living in his property in India for 12 years for rent or occupied his property without buying it and all the villagers know that real owner lives in USA for 12 years who allowed the stranger to live there for free then this supreme court rule says that the stranger becomes the owner of the property IF AND ONLY IF the stranger pays water bill and property tax with strangers name in the bill and lives continuously for 12 years without leaving that house even for a month and makes house repairs like painting.
    So why would the real owner allow a stranger to steal his property after 12 years when the real owner showed pity on the stranger and allowed him to stay for free or rent. So before 12 years if the supreme court won't inform the real owner in USA by phone call that his property will be occupied by a stranger living in his house for12 years then supreme court is a thief who helped the stranger to occupy his house by buying it from the court and not by buying it from the real owner in USA but if the supreme court informs the real owner by phone call then supreme court is not a thief.

    Please protect the property of land lords. Tenants should be in no way allowed to become owner. Any dispute should be solved in one month. It takes 10 years in india. And right to appeal for tenant should not be there. Land lord buys his hard earned property so he can get rent. But tenant misuses laws. Iur judicial system is very painful procedure for common man. Supreme court judges. Should have fast track system
