- The plaintiff says the defendant is his wife, and even though they’ve separated, they still live together and split time in the bedroom. He’s suing her for her portion of the mortgage payments. The defendant says the plaintiff is being childish since she covers all the bills in the household. He doesn’t pay anything toward those, so she says she owes him nothing.

People are commenting on the defendant's appearance. She's not the superficial standard of beauty, many of us are not either. But she has gorgeous skin, beautiful thick healthy hair, a nice figure, and seems to have a great personality. Yeah, she has a lazy eye and needs some dental work. Those things are easily fixed. So many people need way more done than that to look as beautiful as the defendant does.

True dat. But if I were the woman, it's an easy solution. Pay some of his bills (if not all), continue paying for cable & live-streaming, do his laundry (you're doing yours anyway), cook 2-3 meals a week (home-cooked meals are cheaper anyway and you eat too), watch a netflix movie together with popcorn, and don't bring any men to the house. Be a good roommate and negotiate something in lieu of paying rent. Men don't want to be lonely and you don't want to move out.

He knows her wages are being garnished for back taxes yet he wants her to keep shelling out to pay what's essentially HIS bills because nothing belongs to her and he knows it. Because this was about the mortgage, which is not marital property. The plaintiff owned the house before they got married. Therefore it’s not a divorce court issue. As the judge said, he can choose to evict her.

I don’t think you people understand how rent works. She’s living there using the house. Why should she live for free? She either pays rent to him or she moves out and pays rent to an apartment complex. You can phrase it like she’s paying down his mortgage but that’s what everyone does when they rent. They pay money to someone who owns the property.

Well, I gotta say, my wife's been takin' a break from the workin' world for a spell now. Sometimes I jest around, tellin' her she oughta git her rear in gear and find herself a job. But truth is, we made a choice. We didn't want strangers raisin' our young'uns. So, she's been holdin' down the fort, right here at home, tendin' to our little ones day in and day out. It's a tough job, but she does it with a heart as big as Texas. And that's worth more than any paycheck, I tell ya.

I do not know what state law the judge is discussing here. Any state I have lived in once you are married any appreciation in the value of the home becomes split 50/50 as it is concidered both contributed to living there. The original main value would be go to the original owner. Even if it is his name it is concidered the marital home and he cannot evict her.
So if he does go through with the divorce she would be entitled to a small percent of the homes value, I'm guessing.
I wouldn't have her pay anymore " rent" or any repairs or upgrades. Just pay the utilities.

Y’all are missing or willfully overlooking the point that the house is his….ONLY his because it was purchased prior to the marriage. This is why she’s considered a tenant and he can actually evict her now that he’s filed for divorce. It is an incorrect assumption that marriage equates to 50/50 in all aspects. The key factor is whether the acquisition of property/assets occurred prior to or after marriage. The other point that was clear is that the marriage is over. They’re totally disconnected from one another and only still living together because both are struggling financially.

I've seen other people get some equity but never the whole house or half as well, now maybe if their name is added to the deed then that's different but I've even seen some get some of the business that the spouse was thought was covered by an LLC
