In Today's Project Diary Video I will help and give you a walkthrough of the new Employment & Support Allowance (ESA) and Personal Independence Payment (PIP) Tribunal Service.

Oh how true, after I’d been awarded the higher rate Motability and care for lifetime. After Ester McVey etc got involved although I had lots of medical & hospital evidence of my incurable illnesses & disabilities, they kept on asking for more. I think it was a game. At my first interview with a young man who wrote a lot of lies and inaccurate things I was refused all but lower rate Motability. The lady said, you have 25 pieces of evidence like it was a crime, it’s what they asked for. I’ve had so many surgeries ongoing illnesses for 50 yrs. it’s stolen my adult life. I felt so ill and upset Just gave up. I’m housebound and feel cheated.

I remember before I left the DWP, it was kept quiet but sir Robert devereux was paid a bonus of over £7,000,000 when he retired! Also this is coming from the man who was in favour of raising the retirement age to 68 but retired on his 61st birthday? I've been working on a documentary about the DWP and the Government for the past 2 years going back to 1960s. The manipulation of many systems is utterly disgraceful. When the Tories said the Labour party would take us back to the 70s it almost sounds like a good idea :) haha!

When I tell people how plastics are made, how they can affect your body, and how many places you find plastics that you wouldn't think of ... people are usually pretty shocked. As a former CAB rep I'd say send the most relevant medical information you can at reconsideration stage and again at appeal stage if you didn't already have it. Be careful of sending too much as the more there is the easier it is for someone to miss some of the most important details. If you can it is also helpful to have a submission document of no more than 2 or 3 pages long (reps will usually do this if you have one). This basically focuses yourself and the tribunal on A) the conditions you have and B) what points you want to argue. This can make it easier for the tribunal to focus on specific areas and potentially skim over irrelevant areas. Hope this is helpful and all the best.

If I was involved in a crash and became injured, what will help me out. I hope the trolls & haters take this into consideration.
I am now a carer and live in fear of ATOS and their lies, if the person I care for fails that means I could be working with no sleep, I know I've done it before, 5 days no sleep, work go home and care, back to work etc. I nearly died, I nearly killed, it was so freightening walking to work wondering if I would make it home. We past PIP 4 years ago, I haven't settled since then as we have it to do again. My own health has deteriated over these years living in fear of PIP. It is not a benefit anyone really wants to be on, because of the way they assess it. It's upsetting to fail but just as upsetting to pass too, I broke down in tears last time we passed (after the tribunal). The system just kills people off, pass or fail.... well, thats my view anyway. My advice to anyone who works in a dangerous job is to go do something else instead, should anything happen, the knives are out, don't go thinking there is something to help, just some selfish office worker with a target to reach, pushing you in the wrong direction for their own personal gain. It's a wonder these people have not been targeted themselves, I just hope St. Peter takes note at the gates.

Unfortunately, my income support was also stopped a year ago and they have only just agreed that was a mistake! to add to your excellent site. ..for people new to pip or esa assesments....you must get into the mindset of people who just want to stop your benefit...read this again and again...
lets say you have limb damage that stops you walking unaided...scars...muscle damage etc.
they ask to see ...so you drop your jeans...shirt and reveal these scars etc...
they are not typing he/she has scars etc. they are actually typing"is able to dress and undress unaided"!!!!

For the 'can you plan a journey?' question, focus on your pain and painkillers interfering with your cognitive abilities, and also your ability to go on the internet. As in, 'I frequently can't plan or follow a journey because my medication means I can't think clearly and my pain makes me unable to focus or use my computer/phone/etc.' Basically, if any of your medication makes you unsafe to drive or operate heavy machinery, that counts as interfering with your ability to think clearly and have safe reaction times and stuff like that. If your pain means you need to stop and manage your paon immediately, and can't focus on your situation around you, you might miss a train/bus, then you can't follow the journey.
I wish you all the best on your next claim. It really does feel like a treadmill. You're great; the system is abusive.

@@krystal8900 It wasn't a court room. It was an old office building. Before we got into the tribunal meeting, we had to pass a simple security check (open your bags, give your names, that kind of thing) and wait in a waiting room with some other people.
When we were called in to the tribunal meeting, it was just a large boring grey and beige office room with a table in it. The three people in the tribunal sat on one side of the table and I and my cousin sat on the other side.
They asked questions in plain ordinary english, no legalese. They didn't need to know my diagnosis, just how badly my symptoms affected me day to day.
After the tribunal meeting, we went back to the waiting room while they made the decision, then they called us back to hear their decision in the same office.
Honestly, the waiting was the worst part. I was very tense. I cried during the tribunal, and one of the three people cried too, when they heard me talking about my symptoms. They were very sympathetic and used to dealing with stressed and anxious people.
Something like 70% of decisions at tribunal go in your favour, remember that. Be polite, don't get angry at them. The system sucks, I know, it's abusive - but it's not their fault. The tribunal people know that the decisionmakers at the Dept. for Workfare and Punishment are incompetent and wrong. That's why you have a 70% chance of winning.

Previously I was on enhanced living allowance , and
standard disability . It was a huge shock to discover my money had been cut so dramatically until I read the assessors comments and found she had lied , and failed to mention many things I had told her about how my condition affects me . This has cost me valuable points and I am truly shocked and horrified at the way these people treat the most vulnerable in our society . I had informed them I was prepared to go to appeal and they said that would not be necessary . I am still in shock TBH, but happy, very happy and relieved . It has been a horrendous few months , so many problems with my health , and family worries . I was honestly at breaking point , this couldn’t have come at a better time . Bonuses will be payed, reward for failure, tax avoidance, tax evasion, and any savings will be made at the bottom of the food chain. Food banks have become the norm at a time when we were about to spend a fortune build a bridge with a garden on it. HS2 is another vanity project that will be canceled only after we have spent a small fortune and turned lives upside down. Always good to have people there. A friend had her solicitor in hers and he didn't take long. They won. I asked for curtains to be closed as all the assements are in very bright rooms. If you need a wheelchair, get someone to push you there. You should have been issued an NHS wheelchair as you obviously need one. I don't go into these places without a CAB officer. I've been through this too, I have high functioning Aspergers syndrome, I am also Bi polar and have personality disorders.
My self and two friends received our assessments at around the same time.
I was at first turned down but went for Mandatory reconsideration my support worker wrote a very strong letter to the DWP as she was there and is an expert on my condition. and eventually I won.
I'm sad to say my two friends were not as lucky.
And they are now both dead by suicide. And I miss them terribly.
This system only favours the government it is part of their bigoted hateful agenda and discriminatory attitude to the disabled.
All these people killed by this government in their war on the poor if they had killed people in a real war by starving them by freezing them by withholding medication by curtailing their freedoms by stepping on their human rights they would be standing in front of a war crimes Tribunal. This is the same government lambasted by the UN secretary for the rights of the Disabled for their treatment of us. But they are being allowed by the great British public to get away with it.
This doesn't save them any money in fact it costs them more than they have ever paid. It doesn't prevent fraud because the system was too difficult to defraud when it was DLA you are lucky if you can get any of these benefits at all now. a it done absolutely nothing to bring the figures of those claiming disability benefits down why? Well, the answer is obvious because because the people who have managed to win whatever are very probably disabled. And why do people with life long difficulties that will only get worse have to go in every two years? It's just bullying people into early graves. Oh I have to correct my above statement they have brought the amount claiming disability down a bit by forcing them to take their own lives or they just died because of lack of care. These horrible rich bastards are more interested in making themselves richer by getting the Brexit they want and removing more our human rights than helping anyone in this country.

I'm so so SO sorry for what happened to your friends. I'm crying my eyes out right now, this reminded me of how the mental health team told me to call the Samaritans if I had any more suicidal thoughts. For a long time I was too anxious to even call the Samaritans, sometimes they were too busy to pick up which discouraged me even more. A few times people I talked to were quite blunt and unhelpful, one guy just told me we were on the phone for a long time by now and he had to go. I was referred for psychiatric evaluation at the beginning of March, thry only told me at the end of June that I was on the waiting list for therapy, no medication or diagnosis even after I asked for it repeatedly. Thry just called me to tell me I'll have group therapy from September for emotional regulation. They know I have complex PTSD from childhood abuse, S harassment and grooming as a child, domestic violence and domestic abuse etc. That's all they had to offer, group therapy after a 6 months waiting period. When I asked for medication I was told the GP should be able to deal with it and there is still no diagnosis 2 months later. Quite often I feel useless and invisible, even worse, a burden, and that's when intrusive thoughts about overdosing on pills or jumping in front of a car come by. I'm not shocked that your friends couldn't deal with it anymore. My heart goes out to you 🤗🤗🤗

As I have commented previously, I am an ex-miner, The Tory Government and Labour before them, take a 50-50 split on the assets of the Mineworkers Pension Scheme, which now runs into Billions that they have taken, they took a Pay holiday in the late 80s and since then they have not put a single penny into the fund ( they are Guarentours of the fund) so not only are they robbing my Benefits they are robbing my Mineworkers Pension as well.

I’m so glad I found your video. I’ve just applied for mandatory reconsideration. I found that my report was full of lies and I am trying to prove that I need the extra 2 points for mobility. Part of me wants to give up but my gut feeling is telling me to keep fighting xx

How disgusting for people with disabilities to be treated this way 😡 I have always be proud to pay my tax because it went to where it was needed (or so i thought). Looking after people less fortunate than me. I am saddened by our MP's that life seems to have come down to number crunchers and not about humanity, kindness and moral responsibility! Thank you for your videos you are an inspiration to me xx

I have my tribunal for pip in a couple of days. My health issues are bipolar, a variety of other issues including severe back pain that varies in severity. The last tribunal I had was over 10 years ago under the DLA system, it was the tribunal from hell and I wish now I had reported them. My mom came with me. My bipolar is hereditary and my Nan, her mom, committed suicide when I was a teenager, they focused on this point and pushed and pushed and had myself and my mom in tears, it was a disgusting and despicable attack, but I was so shaken, numb and totally blind sided, I was rendered speechless. This time round, I hope I’m stronger. Over the years I have learnt that I should make no apologies for who I am, I am not trying to pull the wool over their eyes, I am not lying and I tend to not suffer fools as easily, however, suffering from mental illness, I again now feel like an errant child about to be told off by the headmaster. Anyway, my pip assessment report was all total lies. The assessor put words in my mouth, said she witnessed no evidence of back pain (well, I followed her down the corridor and when I stood up at the end of the assessment, I had to support myself on her desk because my back had stiffened from sitting for 45 minutes, she specifically mentioned that I stood up ok, she didn’t see me struggle of need support because her back was to me - this whole system is a complete farce). There were loads of other inaccuracies, she questioned my heart problems and her report stated that I was on no meds for this, but I am and I told her I was. I even had the assessment recorded (another joke - I had to specially purchase 2 tape recorders and brand new unopened tapes - which aren’t refundable expenses). I had promised myself after my DLA tribunal years before that if this ever happened again, I wouldn’t just sit by. So this time I reported them and I also wrote to my MP who promised to raise the issues in parliament

Watching your video gave me a better understanding of my condition, Social Anxiety Disorder, which helped me a lot, thank you for sharing your experience. Today as in 31,October, I attended my PIP Tribunal which was pure torture because my health condition is Social Anxiety Disorder, so facing the Judge, Doctor and two other people, one by my side who was from the DWP, put me in panic, leaving me crying and shaking almost all of the time that seemed to have no end with one question after another. When the tribunal was over I was asked to wait in another room for a few minutes before being called back in and told I have won the appeal, which for both myself and my lovely wife who was my representative, left us both feeling a great relief with much emotion. Was explained that I would receive the standard rate for both Mobility and Daily living, back dated from March 2021 and would continue to receive until March 2024 before being assessed again. Still can’t believe I won, not just receiving what am entitled too, but also beating the DWP.

I too failed on the Mobility on the planning a route. Despite being hardly able to walk more than a few feet most days because I can plan a route I'm perfectly fine and only get lower rate when I had higher rate DLA. I too had a younger assessor and tbh he was fine, he could see I was in a lot of pain and never had me do the physical checks apart from my grip.
My physical disability is pretty obvious to most people but even so I still get the odd "get a job" comment. I do work from home part time as at 61 and physically disabled what is the chance realistically of me getting a job? My ability to work varies tremendously day to day from the physical aspect and the mental aspect. I often work at 2 and 3 am as that is when painkillers I take before bed kick in, I'm not sure there's many employers out there who are that flexible.

i had a similar experience. first they stopped my esa and said that i had to claim uc. i fought for 11 months to get the esa back with no payments being made, all the time they kept saying that i should claim uc whilst i waited but i refused because it felt right. i have since come across others who were forced to claim uc as they had no other income and they were never awarded esa again. when this happened to me, i was in a position to wait for the decision as i had an active dla claim but not for long. the pip form arrived on the doormat and it took me another14 months of fighting to get it awarded. so yeah i feel your pain in lmore ways than one. it's a long old struggle sometimes isn't it but we keep on keeping on with hope and a smile 😊

Good luck to you don’t give up. The hints and tips I strongly recommend are as follows- If you going to enter a building where there’s only steps and you have difficulty using them don’t go in because you and in particular the owners of the buildings may be breaking fire as well as health and safety regulations which will put you and anyone else at risk. Further, this would be in breech of disability accessibility regulations . Always try and check out the location of where assessments and tribunal are going to be held.

As you know this disease affects all the vital organs,Bladder , kidney, etc. The stress. Has been so bad that I am getting breathing problems which is making my heart hurt my way to describe it! I thank you with all my heart and wish you many pain less days once this is sorted. When I asked for a mandatory reconsideration, Capita actually changed several sections on the original report to push it through for decline.. I had to pick both reports to pieces and threaten legal action against them for falsifying information... at which point they caved in and gave me the higher rate mobility I needed without a tribunal.
I always wear make-up when I leave the house, basically to make myself feel better, I was actually criticised by the assessor for looking too presentable. when I complained it was removed in the second draft of their report. I will never wear make-up or take my medication before attending another assessment.

    Thank you.
Iv just done my tribunal for ESA and won. Unfortunately it flagged me up for a change onto universal bloody credit ( giving it its polite name ) because I was put on UC before January 1st 2019 the government is not paying the equivalent amount that I got on ESA with the disabled components. There is how ever a top up scheme for those that have migrated after that date to make sure you get the same amount. For those like me I have to wait for a law to be passed eventually.
After I won my esa case I thought I would be backpaid the money I would have gotten on the ESA with my disabled component but I was very wrong. All they did was back date the equivalent of UC which is a lot less as we all know. So the government have saved on just my case over £3000. And I am in debt to the tune of just under £1000. So all the worries and stress and sickness and lack of sleep and lack of dignity and self esteem was so worth it.
I have a friend who won't fight for his PIP because he said after seeing what I went through he knows it would kill him.
Thank you again for this video just to know I'm not the only one. I hope things improve and you don't have to do it all again.
