    As someone who got into the D4 alpha and beta through the family and friends list I had to sign the same NDAs. Violating the NDAs is getting his Blizzard employee friend fired. It clearly states that in the NDA, so he's fucking over his friends career for this clout bs

      Right?! I mean I would assume that anyone who wanted to get away with this stuff would be using a burner phone with no sim with an always on vpn to access the leaker account. For like 200 bucks this would never happen. This is basic opsec.
      Of course I wouldn't ever bother leaking most of the bs he did. NDAs are important to prevent corporate espionage, and unless your leak is important to the public good, (like prism or something like Facebook app recording with the app closed) it really isn't acceptable. These types of leaks just mean that gaming companies will be less able to get community feedback early in the development cycle. Literally just makes gaming worse for everyone.

    Ya know, I've thought about this for a while, as to how many leaker accounts are owned by legitimate people in the gaming space who are trusted with this information. I feel like this doesn't just ruin his reputation, but it could make developers more cautious about who they reach out to and share information with.

      This is very true. Having worked in industries with NDAs being very common, this shit just makes everyone's life worse.
      It's like someone shitting on the boss' desk and the whole office knows exactly who did it, but everyone loses their special perks to ensure it doesn't happen again.

    I think publishers trust news outlets more than streamers is the risk. A media company is probably more unlikely to break an NDA as they have responsibility to shareholders and much more at stake than a single streamer or a small streamer group.

    I worked in the Reality television genre, and we all singed NDA's. Hell's Kitchen w/ Gordon Ramsay was just one of the many shows I worked on. I told my close friends the show was scripted, but I never revealed who won the show. I liked being "in the know" I'm good at keeping secrets.

      @@EggEnjoyer He told his close friends that he had knowledge that a show in a genre that is *extremely widely known* to be scripted and planned out ahead of time... was planned out and scripted ahead of time: I've signed precisely zero NDAs ever, and I could have told his friends that, with exactly the same weight of authority behind my pronouncement.
      He didn't tell them anything that wasn't already extremely common knowledge already, people know reality TV shows like that are scripted and not actually "reality", there's an entire cottage hobby of people pointing out and laughing at their editing goofs that inadvertently give that away on the actual broadcasts. Taking reality TV at face value is like believing in Santa Claus.

    While its hard to enforce, its Activisions legal team.
    If the language is specific enough, even in CA that has made them harder to enforce, they can get you in civil court for any damages they can prove.

      If I remember correctly, there was a bigger tech company that, to fight leaks, would distribute the same memos but in just so slightly altered versions. E.g. just very subtle changes in punctuation or spelling. Nobody would notice, but they could then narrow it down further.

    If I was the company I would total press charges and sue him just to make a point. If companies keep letting people break NDAs with no consequences then more people are naturally going to do that more often. But as Asmongold has said that this is a grey area overall.

    i dont think he was committing a crime, as NDAs are civil law. These companies have to use NDAs in order to be able to show they have taken steps to protect their intellectual property, witch is required if you want to copywrite it. The companies should be protected enough in this matter just by having the NDAs in place but it can cause hell of a headache for them if they have to track down and follow up on people misusing this information. the Allen guy would be liable for that cost.

      Every gamedev company gets NDAs broken from time to time, it's sometimes easy especially when you hire freelancing companies like 99.9% of AAA companies these days - it leads to lines of subcontractors where you might not even broken your own NDA but your contractor NDA. It's mostly a tool to get people in the industry marked as untrustworthy publicly.

      I don't know what pseudo law this is but that's not what NDA is hard at all it's not to protect copyright?! It stands non-disclosure agreement it's a contract signed which probably has penalties outlined so they'll take him to court and tell the judge he broke this contract now we want him to pay the penalties that he agreed to if he broke this contract he will get a chance to argue that maybe it was for a good reason but in this case definitely not.

    For the lawyer/ getting sued thing. They have to prove it caused damages. Like leaking the name of a game, well you can't prove people suddenly never bought the game because they found out the name too early so no they can't really sue at all. Well they can but it gets thrown out.
    The better way to make an example is to limit information for a short while and to make it extremely known that its because of the leaks. Way more impact.

    Something to also mention about NDA law. If an NDA is signed over an action that in itself is illegal, then the NDA is actually non-binding and is void. An example from a real crime I researched: A serial rapist forced his victims to sign NDAs and threatened to sue them if they ever spoke out. This was not a high profile case, it was actually a story that broke out in a small city. He was only caught by one woman finally speaking out. I think the reports were somewhere between 5-10 known victims of the guy too. It's been years since I researched this, but if you are ever forced to sign an NDA check to see if the contractor is actually just trying to hide a crime committed against you, because you cant be sued over breaking an illegal NDA.

    We don't owe companies anything we don't agree to. If I find out about a companies secrets without an nda I dont have any responceability. But if you want trust and respect from them because you want to work with them it's better not to.

    I genuinely don't get the appeal for breaking NDA. Especially today when it feels like fans are primarily angry at people for breaking NDA.
    But to me as a fan and as a business person, I cannot fathom breaking an NDA. From a business standpoint, it's helpful and good business to be in good standing so I can obtain early codes, review codes, and ask questions directly to the PR / developers. It's wise to keep those relationships healthy. From a fan standpoint, I'm excited to play some of my most anticipated and hyped games early. Getting to see it and experience it sooner than later is a beautiful and treasured privilege.

    4:54 No, breaking a contractual stipulation is not a "crime". The stipulations within the contract are not laws. They can sue him. And if they can prove he entered into the contract with bad intentions then they can prosecute for a crime. But otherwise, not a crime... just a shameful action.

    To touch on the verbal countract thing "if you say yes to this thing, that is a contract and is still binding." Yeah, absolutely. You just don't usually hear about it because its a much more difficult to prove that this consent and agreement actually took place. But, if you can, it absolutely counts. It's like if you verbally made a contract on facebook market place
    "Im selling a $40 calculator do you want to buy this?"
    "Yes I do."
    "Great, do you want to meet at my house?"
    "sure."
    "Okay bring cash, come alone, drive up in a blue car and if you don't then you agree to pay $60."
    "Sounds good. Be there soon."
    And then you don't show up in a blue car and instead ask to pay by sending Paypal funds, now you're obligated to pay $60.
    There might be more nitty gritty complications with that example, but, you get the point. If you 2 parties agree to do something, it can be binding.

    If I did something like that, I would have a dedicated desktop computer in a specific location for the "undercover" account and ONLY use that computer to post on that account. That way you never accidentally forget to switch accounts. ;)

    Breaking a NDA contract is not a crime, nor a criminal offense. NDA's are civil contracts. You can be sued for it and face financial penalties for it, but you are not going to get jail time. At least in the USA.

    That apology was be, Idrc about leaks like we all knew gow ragnarok was coming soon, but he only apologised cos he got caught, and the ONLY reason he’ll never don anything like this again is because he’s never getting invited ever again, and if he was ashamed of his actions he’d have just not done it or stopped a long time ago, the comment abt him doing it to feel important is spot on and he probably had more followers in his leak acc than all his socials and content creation acc combined, with not thing he’s sorry for, is getting caught

    Yeah he did more harm than good. My self and so many other people were looking forward to a MGS remaster announcement at TGS. But all Konami showed was a remaster for a niche asf jrpg. Now so many people are even upset with Konami because their hopes were high

    No, breaking the terms of an NDA or MNDA is not a crime asmon…. It’s a civil agreement and you could be subject to injunctive or legal remedies.

      @@masterblue1 no, that is not from breaching MNDAs. That is in the UK (maybe other countries as well) and is for criminally breaching electronic systems for information.
      Here, we are only talking about breaching MNDAs and NDAs. The issue of leaking Trade Secrets depends on whether it was done for commercial gain and what state it took place in. This is a separate issue than breaching an NDA.
      Your MNDAs will not list trade secrets or terms like that, but will instead use the term “Confidential Information” and will keep it generally broad to better protect your info.

    Breaking an NDA is not committing a crime, it's a breach of contract. He's deleting his accounts because he opened himself to a lawsuit, then outed himself as the perpetrator.

    5:00 - Breaking an (non-governmental) NDA is **NOT** a crime. It’s breach of contract that grants grounds to sue/collect. But it’s not **criminal** . Different legal standards of proof and things like no jail time possible
