      Before electoral bonds parties were mostly funded by black money. Electoral bonds are not the best solution but definitely a step in the right direction. At least we knew where and how much the money was coming from. But now we are back from where we started. SC is run by people and people err, certainly in this issue.

      No, the problem is , let say if my company or myself give a donation to X party, and then Y party comes to power, there would be possible retaliation from the Govt of Y party on me or my company.
      So donor cannot be disclosed.

Since you are already known to be a donor of X party and if Y party comes to power and retaliates against you, everyone will know you were retaliated against because you donated to X party, and then public would be angry at the vicious party and kick them out of power and X party would be back on again. So, Y party is smart enough to understand this and will not retaliate. It will in fact try to be more neutral than you would assume.

      Current electoral bond also rule party can easy trace. Which company gave electoral bond to which party. In this amendment loss making company or shell company can also donate amount to political party. That is very dangerous

      ​@@subhadeepmandal9639I understand your concern but you have to balance this against the possibility of crony capitalism that arises from anonymity.
      Also, what kind of retaliating action can a government take against a company which has done no wrong? I'm sure if a company is doing something wrong the government can get some investigative agencies on them but if they haven't done anything wrong there isn't much that the government can do keeping in mind how powerful these organisations are just by the means of money they have available.
      And as explained in the video, SBI has this information anyways. So, when the other party comes in power, they can still get to know who's donating to the opposition party. Which tips the scale of power completely in the favour of the ruling party.

    I vote for BJP but I hope in the next 5 years they don't try to remove the collegiate system and compromise SC's independence. We need an independent judiciary at all costs. Mind you this is the same SC that ruled in favour of Art370 and Ram Mandir too. The fact that they manage to piss off both the bhakts and the liberandus is a good thing.

    Justice Gogoi had made apparent that even the Supreme court was an extension of the government but the judgements that have come in since the appointment of justice DY Chandrachud have restored the faith of common man in the justice system.

      Come on. Chandrachud when Gogoi was CJI was part of many benches which gave orders in favour of BJP also. Our highest court is extremely professional in this regard and doesn't look at cases through political angles.

    It’s not just ADR. I was a political party itself, CPM. Why Shekhar Gupta has inhibition in acknowledging CPM, who refused to take fund through electoral bonds, and indeed filed litigation against it.

      By the same Logic the same system can demand after the results who I/we have voted for and then try and tally that information with the results to conclude that there is a flaw in the Voting !!! I would be 😂😂😂 but it is a silly & dangerous situation that we are in today thats due to the Judges sense of fairness !!!

      ADR, Common cause, CPI(M), all are leftists. They are always accused of taking money from China. In reality China does not give them any money. So they filed this petition out of jealousy - to show who really gets money from china. But three weeks time is quite sufficient to change the names of Byjus, Paytm, Oppo India and Vivo India etc to Bhavesh Bhai and Jignesh Bhai.

    Where was "Good Faith" in this law?
    Forget about it being anonymous, it has other problems -
    1. Earlier a business man could give only some part of der profit to political parties. Now they can give everything.
    2. This was passed as a money bill. It was enough indicators of so-called good faith.
    3. The government knows everything but the opposition cannot. How it is done in good intention.

    This judgement of SC deepens our faith and pride in Indian democracy. Trust in the SC has gone up a notch. The impunity with which the govt of the day brought in such abominable changes making electoral funding opaque shows cracks in carefully create facade of non - corrupt conduct.

    In the name of transparency and also with the promise of keeping black money out, we had created a system that was entirely black. The whole system was a black box. And that black box now had been broken by the SC.

    Instead of striking down the law, it should be amendment of the law to make it more transparency such as giving name. By striking down the law, it enables more black money to political parties, it will be worse.

    Despite the optimism, the judgement won't materially change anything with regards to Political funding.
    Why you might wonder?
    The judgement doesn't change the fundamentals of political financing.
    To illustrate what I mean, consider the following. Today, a Tata might donate money to a party thru SBI and it's gaurantee of privacy, tomorrow after the judgement Tata will do the same thing with several layers of shell companies. It's essentially the same system that worked under the UPA.

In a transparent system, a big donation draws immediate attention. Now companies wishing to donate 100 crores would distribute it over a network of say 100 proxies donating 1 crore each.

      @@tapemaj I disagree. They have used shell companies to fund political campaigns and pay haftas. The transactions done by them through shell companies (during UPA) are actually all available in the open if you know where to look for it. Sometimes the same transactions takes the form stock manipulation of small cap firms. IMO, invariably the judgement has made things worse - the guarantee of privacy allowed Tatas/Birlas etc. to be more direct about their political funding instead of resorting masking it's transactions.

    SC should ban present EVMS election system immediately which is very doubtful. We will follow old paper ballot election system .

      Bold occasionally, he is unpredictable, his judgement in 370 is fallacious. His judgement of not stopping the toppling of the maharashtra govt, raises doubt on his objectivity.

    Good that anonymity has been removed from funding of Congress-communist-momin alliance. Chinese, Soros, Canada, Gulf money to these political parties and NGOs must be stopped. Next, seize the foreign money going to media. The day Chinese, Soros, foreign funding of Wire, The hindu, Satya Hindi, Print, Quint, NewsLaundi, Ravish Rajdeep, Barkha, etc etc are stopped, India will start making more progress.

    The conclusion of this whole thing is, we didn't know which company was giving how much money to which party in electoral bonds and we will not the know the same going forward caus they will use shell companies do that so we the people didn't gaine anything out of this drama that sucks 😢

      Shell companies have to still comply with the companies act, which means the data is there for people to find if somebody wants to investigate shell companies. Electoral bonds made that impossible.

    CPM is the only political party which declared not to take donation via electoral bond. CPM started a legal struggle against electoral bond fraud and now came out victorious. Modia, Godi media, bhakts supported it, good to know you were one of them.

    The Supreme Court has passed the justified order, having struck down the anonymous part of the Electoral Bonds. It was a bad and hypocritical decision by the Modi Government. SG is delighted on this issue.

    Be absolutely sure - no political party ever wants transparency in political funding. If they are committed to transparency then the first thing they should do is make audited financials of parties, public and subject every party to RTI. That will be a start

    How will the courts enforce requirements that contributions are only made by legitimate channels and not by cash? Can the SC be realistic about what they can actually enforce the legal compliance rather than idealistic value judgements. 78 years is independence and supreme Court has not been about to curb black money and just piled up lakhs of pending cases

    Very clear judgement. Electoral bonds were a good idea as for as the sourcing of the bonds are concerned but not on the subsequent steps. I do not support political parties getting funds unanimously - especially when they need not even show in their balance sheet. It sets a dangerous precedent. I support the argument that all political parties should disclose their source of funds. I can say with happiness that this bench of the SC has restored its honor - which it lost by opening at 1:30AM for the member of an India divisive forces.
