What if the petitioner is contacting me pretending to be someone else while waiting for the restraining order hearing. Do i call the police? Wait for the hearing?
And I thought I’d heard it all! Keep records of this and make sure that you’re able to show the judge why it’s the petitioner and not the person they are pretending to be. Just based on what you’ve said, this wouldn’t be something that the police can help with because it wouldn’t be a crime on the petitioner’s part. What if all this is what the petitioner really did willfully but they are the one who filed a RO playing victim? Will the judge/prosecutor care to see their willful attacks based on anger? I didn’t have sex w a guy and out of anger filed a P.O. Bc he didn’t get what he wanted when he wanted. Can someone use a p.o. As a weapon to ruin someone’s life bc I didn’t give them my body or want to see them?
It depends (sorry to be a lawyer cliche) on multiple things, like how they were used before and for what purpose vs. how/why they’re being used now, but generally there isn’t a hard and fast rule barring their use in California
