    • @nickelpickler6532
      @nickelpickler6532 7 ปีที่แล้ว +83

      Yes you can sue, because salary is payment for services rendered, if the employer does not compensate you for previously finished work then yes, they would be in breach of contract. If after paying you what you are owed they decide to no longer pay you for your future work, they would be voiding the terms of your contract. If you have a notice period before termination or change of contract, then you could also sue, if they have not given proper notice of change of contract.

    • @bobafett407
      @bobafett407 7 ปีที่แล้ว +32

      You can always sue, but it doesn't mean you will win. The company notified them that they will not be paid for future work, so they would not be able to get those wages. If they didn't pay for work performed before they were notified, they would be able to collect that, depending on what happens in bankruptcy court, if this goes there. This kinda of stuff is what happens while they are filling for bankruptcy. Sometimes it works out for the employees, because then they get better positions when they come out of bankruptcy.
      BTW, each state is different, but they should be able to get unemployment compensation. It might be contested, but the unemployment office would basically consider this a layoff, after the investigation.

    • @louisphilippe1100
      @louisphilippe1100 7 ปีที่แล้ว +15

      You can collect unemployment benefit when quitting. It just depend from why you are quitting. And with a company not paying you for your service (assuming you have a valid employment contract), they are going to grant unemployment benefit for sure. What Fyre is doing is an indirect way of firing people and the people managing unemployment benefits are well aware of this scheme.

    • @the.kid.ginger
      @the.kid.ginger 7 ปีที่แล้ว +8

      unemployment varies from state to state and also rules on how long you were employed apply. They could very seriously screw over employees depending on ind. state rules on the benefits.

    • @BeeBumper
      @BeeBumper 7 ปีที่แล้ว +4

      alphadawgxx Yeah, they really kept their cool, especially considering what was at stake. What shocked was the part about them being screwed out of potential unemployment benefits while they searched for a new job. I didn't know that could happen based on the way a company got rid of you deliberately. This whole thing smells like a massive scam to me, hope the founders get prosecuted for this if there is any legal ground to do so.

    As someone that uses instagram often, I find it's better to either ignore the ads, or do you own research on them. I someone is selling a product that I find interesting I look it up myself, outside of instagram, and see what other people have experienced with this product. If there's no reviews or bad reviews it's best just to steer clear. A lot of the products people promote are products they've never even used before, so they tell you it's great, but they don't really know.

    I ain't trusting shit that's gonna cost me thousands of dollars. If a friend says hey there's this thing that costs less than $10 you wanna give it a whirl, I may give them the $10 cause that's a loss I can absorb if it turns out not to be true. However if they lose my $10 I'm not giving them any more money. People who go into a situation like Fyre Festival without researching it are either deeply stupid or have more money than sense.

    just a point, IT structures inside of large organizations typically roll out patches very slowly for at least one good reason: there have been times when patches to an OS or other software has made that software either vulnerable or completely bricked. there's a fine tightrope to be walked with upgrade procedures.

    • @betaich

      Another good reasons is that some software or whole devices have to be re evaluated before you can use them again, if you changed anything on the device for example updating the software and that just takes time.

      Also with most business and places like the NHS you can't stop a bunch of computers doing their job to do and update. Also a lot of these places where using outdated versions of windows because they have specifically design software which which only works on that operating system and would cost a huge amount of money to replace.

  • @LatexFashionTV
    @LatexFashionTV 7 ปีที่แล้ว +259

    For many businesses like banks or health services it's not as simple as they didn't install updates. They can't. Imagine with the NHS. They have various medical equipment like MRI machines and the vender that sold it has gone out of business. It runs on embedded Windows XP because that was the newest thing at the time. Now it can't be updated but still needs to function to save lives. Same with banking systems and ATM machines ect. They're hard wired to run XP in many cases. Making this virus all the more dangerous.

      @Grape Flavored Bleach Expect cost of living and cost of general items across the board to skyrocket, friend. When Amazon moved into Seattle they made the city rich and its citizens poor. On the upside it creates a lot of new, high-paying jobs and gets the city more money to improve, but with those wealthy employees comes new, costly homes and services and the rest of the city rubber-bands right with it. If you're not one of the people getting those new jobs, you get left in the dust as costs inflate faster than wages can account for. They raised the minimum wage in Seattle to $15 an hour and many people are still barely treading water.

    A few weeks ago there was an Instagram thing where if you reposted a photo from this one swimsuit company within 24 hours, they would give you a free swim suit. I thought it was a small start-up trying to expand their business, especially since one of the models who frequently appeared on their Instagram account was a friend of mine in high school. I was definitely wrong because all the swim suits said "sold out" by the time I could get to the site the next day and I'm pretty sure 99% of the people who reposted their photo never got a swim suit. Lesson learned. :/

    Phil, your argument about updating windows has a huge flaw. Many companies and government agencies use custom programs that can be expensive and sometimes dangerous to rework for a new OS. it's why many investment firms still use software from the 80s( if they were to update they could potentially lose millions of investment accounts.)

    • @dragonwingz1
      @dragonwingz1 7 ปีที่แล้ว +23

    • @badcactus819
      @badcactus819 7 ปีที่แล้ว +32

      the program still does it's job, and updating it could cause millions of dollars in damages. However, the programming language many of the programs use is so old that they are running out of people to manage the programs. updating will have to happen, but until it is unavoidable, the risk is too high.

      Yeah, it's a little bit of Sunk Cost, and a LOTTA bit of "this code is
      too unwieldy to refactor, so our best short-term solution is to open
      another can of spaghetti"
      I mean, Fortran IS a good language, but if it's not being taught anymore, it loses its maintainability, and like Mr. Austin stated, eventually, it'll have to be rewritten in one of these newfangled languages these kids understand.
      My suggestion would be either Go, Scala, Haskell, R, Erlang/Elixir or Rust, but I don't know _any_ of those languages well enough to make an informed recommendation beyond the fact that all of those are supposed to be good at that sort of thing.

      Quite right. While in my undergrad, i worked for the university as well and at the time they used a version of windows 7, and had to have an older version of IE (9?) to be able to use their propriatery software. This university employs several thousand support staff, instructors, assistants, etc., all using some component of this software. This software is also capable of properly interacting with government databases to import HS grades, has dozens, if not hundreds of customized subroutines to performs various data manipulation tasks. Each patch implemented to the OS, or updating to a slightly newer version of IE, has to be rigorously tested with the propriatery software to make sure there are no bugs or issues that could potentially make the entire university come to a halt. It's not as simple as just installing the new patch on allcomputers....

    • @Fitzavig
      @Fitzavig 7 ปีที่แล้ว +14

      This argument of "but we need the old software and it doesn't work on newer systems!" is as old as the systems we're talking about here.
      There are plenty of options to secure these archaic systems without exposing yourself to a full security time bomb like we saw go off here. Virtualization alone gives these businesses plenty of options. The technology is here, guys.
      What probably happened here is a common occurrence. A business wanted to increase its profit margins. Those darn windows updates are so annoying though. So the fossils running these businesses decide "well, our software won't run on new systems. I don't want to pay for new systems, despite the opportunity. I don't want to pay for a half decent IT staff to secure my systems, despite the opportunity. Instead, I'll just cry bloody murder to save face if it ever actually happens. I mean, hacking is just a thing from movies anyways, right?"
      And lo and behold, this mismanaging mindset has led to a spectacular display of incompetence yet again. I'm sorry, but I feel my sympathy has wandered off elsewhere. Security should not be compromised when it endangers lives like this. End of story.

We aren't allowed to plug any outside devices into company computers, open any emails that are not from the company server, or use the internet for any websites that are non company approved.
    It's a HUGE legal issue if our server is hacked. We have the entire state of Utah's medical records in our completely electronic system. Plus we have thousands of employees with access to it. They feel we have a target on our backs. My company (Intermountain Healthcare) would easily pay a 1 million+ dollar ransom if we were hacked.

I'm not going to hate on people who are in the marketing industry, but marketing in general has always been a manipulation, at least to my mind. And I've always seen this type of manipulation to be an assumption that I'm dumb enough to get tricked into wanting stuff I don't need. Nowadays, that seems to be the road that marketing is taking: creating a need rather than understanding it. So yeah, this is why I have AdBlocker Plus on all my broswers (Sorry Phil, but I'll get over to Patreon once my rent is paid to show my appreciation for what you do).

I'm not saying that because I'm here, but because I've been here... for the better part of a decade, and I've seen a couple of his ancient webcam shows even earlier (many of which are now private). Phil has almost always has been transparent as possible, and isn't afraid to call things how he sees them. His content doesn't serve to lie or manipulate the people to get ahead, or spin things his way.
    His meticulous research, which he mostly did by himself back in the day, while not always 100% accurate, it wasn't for a lack of trying.
    Phil is probably the greatest TH-camr of all time, his personality and work ethic is a great representation of the original TH-cam spirit.

    There are still many government and institution computer using windows 7 and even windows xp, and previous windows server, embedded, posready, thinpc (based on the windows xp,7,8, 8.1 iteration) bcos it costs MONEY to upgrade every computer license + let alone maintaining the system + updating apps used + dependencies + different agencies compatibility + TIME + etc. The bigger the company, the more expensive it is to maintain (and just be honest those exec that isnt computer-literate would belittle managing IT hence they wouldnt care decades old servers/towers as long as they are working as intended).
    Now, thats just the software, I haven't included the professionals required to maintain the hardware side to support the software (usually Desktop PC in big institutions require major hardware upgrades every 5 years to keep up with the latest tech but this is also depending on the budget they gave/needs). All it takes is some hackers who knows which government/agencies/part of the world not keeping up with latest patches/tech/hardware updates and take advantage of that cos there are still more than 40% chance these people were not a part of early adopters. So it again comes down to money management to micromanage the tech. If they think nobody gonna attack their server just cos nobody had successfully attacked them in the past, they would be wrong. Thats why everyone nowadays should keep up with the tech world cos you never know how motivated these hackers can be in finding backdoors.
    Even though one is considered to be professionals/ IT expert doesnt mean they would understand how hacking works unless they learn hacking first. Theory/certification/degree alone wouldnt help. Tech always evolve as the case with everything in the world (cooking/education/language etc). So being an expert or very secure again begs the question of how knowledgable one is/how far it is secured.
    Then there are people who says (like my parents) "just get an Apple then"... WTF Its not as simple as that Mom people would always try to find a flaw in the system no matter how secure an OS is cos there is always one hacker one step ahead of you!! bla... bla... (I need not explain more tldr)

      Those companies should invest in some information security professionals. Data is the most important thing on a computer. They should have at least some sort of backup solution. They could simply reimage the system and restore the data.

      Dave H; that's all well and good to say, but almost all Government agencies have IS Professionals. The major problem we have is that you can make all the recommendations in the world, but you can't do jack shit without a budget to implement them properly. A lot of Government systems only work because some very smart (and underpaid) person worked out how to implement required features using existing technology for a fraction of the cost of the actual recommended solution.

      For many businesses the national health services it's not as simple as they didn't install updates. Making this virus all the more dangerous.

      constant vigilance, They might of done. Except that, the NHS isn't particularly well funded. They can't exactly afford to buy the up-to-date software out of their own pockets, so what are they going to do? Windows certainly isn't going to donate it.

    When it comes to trust and advertising, its like making a new friend. The more I see them the more likely I am to trust them, and my trust exponentially increases when someone tells me about it. For example I trust that you are not feeding me bullshit because I have done fact checking on some things and I haven't yet seen a false statement.
