That is actually a wise move on the Philippines part. The Philippines does not want to take responsibility for any illegal contraband, drugs or weapons leaving their country and arriving in another country. Good on the Philippines for doing that.
You will be denied a U.S. passport if you're currently on supervised release for a felony drug possession or distribution charge, and you will likely be denied a U.S. passport if you've recently committed certain violent or drug trafficking crimes. The Philippines will NOT allow you entry if you have a drug distribution or human trafficking felony conviction.
Canada takes alcohol-related offenses seriously and can deny entry to anyone with a DUI on their record. This includes layovers, even if you're only staying at the airport.
Mike, if Joe contacts you again let him know that it's best for him to procure a visa from the nearest Philippines Consulate before he travels and not rely on the (Visa on arrival). Thanks so much for this informative video. I have a fiancee in the Philippines and we are working to obtain a fiancee visa so that she can come to the US and we can be married. I visited her in the Philippines and met her family and we all got along great. As for the process of trying to obtain the visa, I was very honest in the paperwork, and I admitted that I had been arrested on a felony drug charge 49 years ago, in 1976. I was 19 years old at the time, just a kid and making mistakes. I thought it best to be completely open about this and hope and pray for the best. After all, I have spent 49 years sober and stayed out of trouble, and proved myself throughout all those decades... I am not the person I was when I was just out of high school. So anyway, my fiancee and I are waiting to hear the results of all this, if she will be able to come here and we can be together. She is in her mid '30s and I am 68, but I don't see that as an obstacle as we really love each other. But, yes, my past does haunt me and it does concern me. One little mistake can affect your entire life, which is very sad. Thanks again, you gave me a lot to think about. Not that I haven't already been thinking about this, but I pray for the best.
Please, explain how the USA can have effective government when one of two major political parties' mantra is consistently for many, many decades "lower taxes & smaller government" regardless of the efficiency of government operations or the effects on the Treasury and the deficit from unsupported tax cuts such as Trump's that added ~7.5 trillions of debt to the deficit? One need only look at the effectiveness of the IRS. The Republicans just removed $65B from their budget. This is after removing $20B in 2024 and $10B in 2023. This after a hard fought bi-partisan negotiation by Congress and signed by Biden to FINALLY update their archaic computer systems. The IRS has been underfunded for decades, primarily but not completely by the GOP, by design. The IRS cannot go after those with complicated tax returns due to their limited and underfunded resources. Who and what businesses do you think "owns" those complicated tax returns? I have read reports that for every $1M spent by the IRS on tax agents, they bring in $1B. But yeah, let's not fund them adequately, makes perfect sense to me said every tax cheat. Coincidently....how did Trump get $431M from his father (that he denies to this day)? 'Trump Engaged in Suspect Tax Schemes as He Reaped Riches From His Father"- By DAVID BARSTOW, SUSANNE CRAIG and RUSS BUETTNER, Oct. 2, 2018, NYT.
If a person got a felony for not paying taxes, but paid all penalties, interest, served all their sentence and hasn't had anything else that would demonstrate a history of crime, would they still be deported? I believe that is different than someone that didn't serve their time and are on the run.
Pretty much the same anywhere, take them seriously, be open and be honest. Bring your documentation, have it in good order and easy to look through. Don't forget a little smile - but don't laugh at them. Give them the respect they deserve as they are serving their country and in the long run serving you too.
For those who are saying foreigners do not have rights in the Philippines, that is a false statement. Foreigners can hire a legal representative or attorneys in the Philippines. Your case will be heard in the Philippines court of law, you can also take a complaint to the U.S. Embassy and depending on the situation the U.S. embassy can intervene, but its still wise to behave in the Philippines... "If you're rude, vocal, and vulgar, using bad language, you could be labeled undesirable." This disqualifies many Americans. Officials just need to find a way to get peoples inner Karen to expose herself.
Yea, funny. If the Philippines ever want to seriously grow as an economy, they need to learn about efficiency and customer service. They could take a few good lessons from Karen but they only seem to do so when they are being managed by an American and being paid by an American.
Well, I'd have no problems. I work for Loomis, where I had to get a background check from the police and federal government as well as have to take a lie detector test. When I was hired. If any of those things happened I would never be able to have this job.
Would you know if having a misdemeanor in your background , would prevent entry ? Case has been resolved over three years ago . Best I thought to get it expunged .

He is wanted for sex with child under 12 years of age. Law TERM, CSC MINOR 12 AND UNDER. It's guys like this that give us Foreigners a bad name. He has been here 10 years, married and has children, being a Officer I verified the warrant. The warrant is verified.
Sir, pls be a good guy and report him if is still doing the same act here, otherwise maybe he repented and now have a new life in the Philippines. Get the police alerted so he will be in their surveillance
@@jacobspoor7058 You clearly do not understand how this works. If someone is on a warrant, then that is in most if not all states in public records. You , me, him and everybody can check if a person has a warrant for arrest.
Most likely is this man bribing the local police. I VERY much suggest that you inform a higher government. You can also inform the Michigan State Police of his presence, where they then can put in a formal request for his arrest and deportation back to the US.
The simple fact is about 8% of the adult U.S. population has a felony conviction of some kind (25 - 30% among black males). Felony drug possession alone makes up about 1/3 of that. Property crimes another 30% or so (and most property crimes are committed by addicts). Felony DUI (multiple DUI's during a short period - varies depending on state) is also big. Drug distribution, weapons charges, and violent offenses (all three go hand in hand) are a much smaller percentage of the total. So anybody care to guess at how many American expats in the Philippines have felony convictions? I really don't know, but based on the expat behavior I have personally observed, I wouldn't doubt it one bit if 25% of all expats in the Philippines had felony convictions. I've met far more shady Americans in the Philippines than I have in the U.S. And by the way, 80% of felons that do prison time will reoffend. Yeah, some people do learn their lesson and go straight. But for the vast majority, once a criminal always a criminal. Sad, but true!

In the US, it depends on the crime/charges because Felonies have different levels 1-5. If you have a Felony 1 or 2 on your record, you will get denied (think murder and serious violent crimes) but if you have a Felony 3, 4 or 5 (and non violent crime) you can get a passport.

These things almost NEVER make it to court. The so-called victims are paid off handsomely and any criminal/civil charges get dropped. Don't fight in the Philippines at all if you can possibly avoid it. Swallow your pride and run away. The legal deck is almost always stacked against the foreigner even if your completely innocent.
Potato potatoe, but I personally would rather be called an immigrant than an expat. Expat means expatriate. Almost makes it sound like you've voluntarily given up your citizenship or are a traitor or something.
@Mike you said that 'having an argument' is the same as a foreigner bringing their 'bad habits' to the Philippines. Couldn't it also be the case where a foreigner is 'having an argument' with a Filipino who did something wrong? It seemed like you were assuming that anytime a foreigner raises his voice or has an argument, it is automatically his fault. My guess is no matter who is at fault, the foreigner could still face the consequences of deportation.

Possession or distribution? Misdemeanor or felony conviction? If it's just a 30 year old misdemeanor conviction for possession it probably won't affect you but you MUST disclose it if asked in person or it's on the visa application.

Hello Mike. Does your visa allow you to work or conduct business in the Philippines? If yes great. Are you registered with the BIR and if so are you paying the appropriate taxes on your TH-cam earnings? If so great.... cause I hear the BIR and the BI are investigating a lot of foreigners conducting such activities here.
Maybe Mike can look into this. The Bureau of Internal Revenue (“BIR”) has issued Revenue Memorandum Circular (“RMC”) No. 97-2021 to clarify the tax obligations of social media influencers, and to remind them of their obligations to pay taxes and comply with registration and reportorial requirements, and the possible consequences for non-compliance. The concerned BIR officers were also directed to conduct a full-blown tax investigation on social media influencers. RMC No. 97-2021 provides that for resident aliens, any income derived from Philippine-based contents shall generally be taxable. Thus, the burden of proof that the income was derived from sources without the Philippines lies upon the resident alien. Absent such proof, the income will be assumed to have been derived from sources within the Philippines.
@mikesphilippineretirement it's the law. @mikesphilippineretirement if your conducting your business in the Philippines and/or deriving any form of income here you are obligated to pay taxes here. Also you may have to register and secure business permits and licenses in accordance with law.

That is actually a wise move on the Philippines part. The Philippines does not want to take responsibility for any illegal contraband, drugs or weapons leaving their country and arriving in another country. Good on the Philippines for doing that.
you can retire in the PI if you have a felony, but against children or rape or murder you can not go to the PI
Thailand would be a better place for those people
You will be denied a U.S. passport if you're currently on supervised release for a felony drug possession or distribution charge, and you will likely be denied a U.S. passport if you've recently committed certain violent or drug trafficking crimes. The Philippines will NOT allow you entry if you have a drug distribution or human trafficking felony conviction.
How about a DUI felony? No other charges.
@@ChuckFasst you are good. They mainly don't want sex offenders coming into the their country

Getting the visa issued from the Consulate allows him to pre-declare his past for official adjudication by the Phillipine Government. Less likely to have surprises upon arrival.
Thanks for the advice, I will pass that along to Joe.
I read a newspaper article about when USAF Clark was open a USAF member born Filipino stole some C-130 parts and sold them on the black market and then went AWOL. He thought he was sittin pretty in Mindanao for 19 years until the USAF special investigations working with the PNP nabbed him and sent him to Guam for a military court martial, I don't know but I think Ft Leavenworth would have been his new residence.

A charge that old I would have kept that to myself.
Generally speaking, the fact that the U.S. issued his passport, should be a pretty safe bet he’s ok!

Don't you think they're doing a lot already?

Thanks for the info 🙂
Any time
If a person got a felony for not paying taxes, but paid all penalties, interest, served all their sentence and hasn't had anything else that would demonstrate a history of crime, would they still be deported?
I believe that is different than someone that didn't serve their time and are on the run.
if you make things right. I would them give a second chance
Everyone deserves a 2nd chance especially in the US where u get arrested for a gram of weed.
Safer for them to relocate to Thailand. There you can get away with almost anything. 😅
Nowadays the US Justice system which is rife with corruption hands out felonies for everything under the sun. This is so wrong in so many cases.
Pretty much the same anywhere, take them seriously, be open and be honest. Bring your documentation, have it in good order and easy to look through. Don't forget a little smile - but don't laugh at them. Give them the respect they deserve as they are serving their country and in the long run serving you too.
The last thing u want to do at point of entry is be a smart ass. U look stupid being denied entry.
I agree. Respect is a two-way street.

I hope you can afford to pay for your extended stay while your case is before the courts. The wheels of "justice" turn very slow in Philippines.

Yea, funny. If the Philippines ever want to seriously grow as an economy, they need to learn about efficiency and customer service. They could take a few good lessons from Karen but they only seem to do so when they are being managed by an American and being paid by an American.
Literally he just described 90% of Americans 😂

I have a American here in Mindanao that has an active Felony Warrant at The Michigan State Police in The United States and no one here in Mindanao will arrest him. He is wanted for sex with child under 12 years of age. Law TERM, CSC MINOR 12 AND UNDER. It's guys like this that give us Foreigners a bad name. He has been here 10 years, married and has children, being a Officer I verified the warrant. The warrant is verified.
Maybe he is paying off the local police? 😅
Sir, pls be a good guy and report him if is still doing the same act here, otherwise maybe he repented and now have a new life in the Philippines. Get the police alerted so he will be in their surveillance
You used to be a cop or you still are? If you are retired, how are you still accessing these databases?

You clearly do not understand how this works.
Good they are clearing out a lot of these, they should stay where they come from and not bring their crap to new places

In the US, it depends on the crime/charges because Felonies have different levels 1-5. If you have a Felony 1 or 2 on your record, you will get denied (think murder and serious violent crimes) but if you have a Felony 3, 4 or 5 (and non violent crime) you can get a passport.

Hi Mike, just curious if a foreigner gets in a fight in a bar, do they typically get jail time for first offense?
No! unless serious crime
Why do you call yourselves expats when you are immigrants.

The problem was caused by his failure to disclose, not the simple assault itself. He effect, he submitted a false application.

I pay taxes in the US. Why would i pay in the philippines?
@mikesphilippineretirement it's the law.
