      I agree, but I also think that everyone on this planet has the right to self defense. Why not use this court case against them when they try and disarm us? Remind them that even illegal aliens have the right to own a firearm for self defense, so there is no reason to remove that right from law abiding citizens.

      no, the constitution affirms the right of every american to bear arms - everyone has the right to bear arms, american or not. If they do something wrong, like be here, they should probably be sent back, but having a gun is not the wrong thing and should not be a charge against them.

    As a former IL resident who was charged with felony unlawful use of a weapon for simply possessing a firearm without a valid FOID which expired while I was serving in Iraq in the army. Somehow, my renewal never made it to the state police and despite having copies that I had sent it. I was still subjected to a trial and $10k in legal fees. Still ended up with a misdemeanor for something that was perfectly legal in 49 other states that didn’t require a FOID card to simply own a firearm. My mistake for being a citizen and serving my country. At the time I was young and naive and didn't know that the left only punishes the law abiding.

You’ll discover that they had strict caps on the number, in 1910 it was limited to 3% of a given nationality’s representation in America.       Many are let in while they wait for a court hearing to see if they get to stay. They walk up to the fence and law enforcement opens, cuts, lifts the fence. We have all seen the videos. Some certainly are bad people sneaking back and forth. But the debate should be about stopping the immigration at points other than legal ports of entry. And getting back to being able to walk into a business and pay cash for a machine gun, if you so choose, and leave without having to jump thru hoops. It really is two separate problems. Stop the illegal immigration solves both problems. Making possession of a firearm illegal accomplishes nothing.

    It's not just Hispanic foreign nationals breaking into America; we've also got Chinese and Middle Eastern foreign nationals as well sneaking across the border. A friend of mine in a small town owns a gun store. He just told me a crazy story. A couple of weeks ago several Syrians, lacking passport, drivers license or visa, attempted to purchase firearms from him. He reported it to the alphabet agencies--the FBI, ATF, and ICE--and none of them could or would do anything about it. If this is true, then we should all be prepared for the eventuality of a terrorist attack in America. Maybe before the year is out. And all this for what?! So the Democrats can grant them voting rights and solidify their power base?! Very scary times we are living in.

      Have you read the Federalist Papers? Also, there is far more to law than picking out a single word from the Declaration of Independence and making a ruling based solely upon that.
      Do you believe our rights outlined in the Bill of Rights come from the government? If so, and thus, only protect certain people, that document should be renamed to the "Bill of Privileges". I believe people are conflating these two separate issues. Human rights (which are natural or God given) can exist just fine while still deporting people who are here illegally.
      Did you know that while in the US (not of the US), you are protected by the 1st, 3rd, 4th, 5th, 6th, etc. Amendments, even if you aren't a citizen? That being the case, why wouldn't the 2nd Amendment be included with the rest? If you feel it's because guns are different and should be treated differently than all other rights, you might be on the anti-gun side. Just something for you to think about.

      @@bewbew0016 Have you read the Anti-Federalist papers? Regarding the Federalist, keep this in mind: "the legitimate meaning of the Instrument must be derived from the text itself".
      Regarding being protected while in the US despite not being a citizen, the 3rd, 5th, and 6th amendments refer to "any house/owner", "no person", and "the accused", which is how those amendments apply to everyone. The 1st is kind of mixed because the first portion before the colon applies to all persons, whereas after colon only "the people" have the ability to peaceably assemble and to petition the government. This is supported by the preamble, where it begins with "We the people OF the United States". The other amendments, like the 8th for example, don't specify who it applies to, so it is understood that it applies to everyone.
      Did the constitution apply to members of the various Native Nations in the 1800s or does it now? Just something for you to think about.

      @@TrackSol Yes, but my point in bringing that up was specifically the publications relevant to the Second Amendment. Actually, supporting this specific case or not, I think everyone should read it. I would assume you have, given your mention of the Anti Federalist Papers.
      Regarding your arguments, we can go into great legal depth which quite honestly, would require both of us having JDs and have been focusing our practices in constitutional law. I don't know about you, but I haven't.
      As for the last paragraph, I'm not certain of the point you're making. Especially with that being the case over 200 years ago and having since been determined to be unconstitutional (which it was). Again though, it seems like the point is that it would apply to non citizens the way it did 200 years ago to native Americans? Because the reasons behind that were both racist in some ways, and in others, don't apply to the current situation. I don't want to assume that's your position. Until we start becoming unable to travel without a high likelihood of coming under attack from a group on illegal aliens, much of that doesn't apply to this situation. Even then, I wouldn't be likely to agree with disarming all of them unless a large enough number of them, acting in a coordinated way, sufficient to deem them as enemy combatants. In which case, I would be out there with my "friends of silly geese", acting as a combatant against them, as I would consider it to be a legitimate conflict. Though I do consider what's happening now to be an invasion and extremely dangerous, I consider it to be a separate issue from gun rights. As in, you don't have the right to be here, and though you are being removed, you still have basic human rights. Technically, while being removed, you would be a prisoner and thus, be disarmed for the duration of us holding you. Before and after that, I believe they all have the right to be armed.
      Anyway, I think this comes down to your personal philosophy. Mine is (to put it simply) that gun rights are human rights. Because they are human rights, like all others, they are rights that all humans have, no matter where in the world they are, with a few limited exceptions. The exceptions being a current prisoner (including POWs), and possibly part of a very recent post-war treaty which would only apply to their military forces, and not their citizens, and only for things like specific offensive military equipment. I believe if you're here in the US (for example) legally, but not a citizen, you should be able to carry. If you commit a crime while here and are removed, that is a separate issue. The same goes for those here illegally. They have the right to carry (as I said earlier) and them being here is a separate issue. Just as, they have the right to pray to whatever God they wish.
      I do realize, of course, that while these are inherent rights, governments in various countries will (and do) infringe upon those and many other rights, such as speech, religion, assembly, protests, etc. I believe, given the many historical examples, (including your own) that gun control is firmly rooted in racism and classism. Even when the disarming of citizens is to allow tyranny, the underlying reasons for the groups they target is almost always racist &/or classist.
      So, the real question that it all boils down to, regardless of legal arguments, is do you believe that everyone has the right to keep and bear arms? Or, are you in support of gun control? It sounds like you do support gun control, but I don't want to put words in your mouth. That's why I've asked you plainly and simply. Also, if that is your belief, I'm not suggesting you're racist or classist. My argument regarding that is towards the motivations of the government. Sometimes, it's also the motivations of the individual citizens who support gun control, but I'm certainly not even insinuating they are yours. Just to be perfectly clear.
      By the way, I appreciate that, though we appear to disagree, your response was intelligent and respectful. I hope mine was taken the same way, as was intended.

    On December 2nd 2023 I passed my state's ( South Carolina ) CWP class . Earlier this month our Governor signed into law our version of Constitutional Carry as the 29th state to do so . One stipulation of our gun laws are that the the carrier may not be trespassing on any property . Illegal aliens are trespassers on US soil and should not be able to own or carry firearms anywhere .

    Not many more pro 2a than me, but id have to say no. If your first act of entering the country is a crime then no. Then theres the fact that these people arent being vetted, so are they going through NICS? i think not. I dont want no cartel members packin

      Don’t claim to be pro 2a and then add but with some type of stipulation. Bottom line, you’re not pro 2a, you’re pro 2a for anyone you see as fit, no different than the tyrants trying to take guns from those of us who are actually pro 2a.

      So, you're all for gun control. Then, yes, there are many who are far more pro 2A than you, thankfully.
      You are aware our rights aren't granted to us by the government, right? The right of the people to keep and bear arms is just that. You also don't appear to care about due process and support removing rights from people who committed a crime.
      That's fine, it's your right, but you aren't pro 2A. I mean, if you can call someone who supports hate speech laws "pro free speech", then I suppose you can be called "pro 2A". I just don't call those people pro free speech. I call them something else.
      I'll take your same mentality and apply it to the 4th Amendment. Not many are more pro 4th Amendment than me, but I'd have to say no. If the police feel you might have committed a crime or you did in the past, they should just be able to search you, your vehicle, or your home. I don't want no criminals to be able to hide nothing. Like the "not seas" said, if you got nothing to hide, you got nothing to worry about.
      Doesn't sound very pro 4th Amendment, does it? I think I've made my point. I hope you give it serious consideration. Do you want dangerous freedom, or something else?

    Appreciate the rundown, thanks for the great summary. Without a doubt, most things that are happening these days are creating a lot of questions and challenging a lot of beliefs for many people. Unfortunately, things are getting crazy to the point that ideological debate just isn't possible in the heat of the moment, which is something that seems to be forgotten amongst the comments sometimes.

    I know of a couple different families who immigrated here from parts of Asia decades ago for a better life. They are now trying to get citizenship in places like Panama and elsewhere because they feel our nation is quickly going down the tubes and they are prepared to abandon ship. It's scary to see just how far we've fallen in just a couple decades.
