If they don’t know who’s car it is then how are they gonna call you and ask about the car? You need a sticker or report the license plate with the office for overnight visitor parking. When the plaintiff said that I almost laughed… made no sense.
Several of us had our cars towed from an apartment complex but the tow company didn't notify mgmt they were on property so we all got our cars back no charge. Had to track them down though! I thought my car had been stolen so I called the police. At one point the space had been a handicap spot but the paint was faded & there wasn't a sign. I asked the officer if it was a legal handicap spot & he said no for the reasons I mentioned. So yes, sometimes tow companies tow without prior approval from the property mgmt!

After a car accident my vehicle was totaled and towed to a car lot. When I went to the tow company to get my belongings that were left in the car the guy that ran the tow lot told me I had to give him $200 to get my stuff out. The law says that you are entitled to get any belongings out of your vehicle without being charged unless the police have the vehicle impounded for evidence collection and mine was not. This dude was threatening violence if I didn't pay him so I called the police, then his whole demeanor changed once the cops showed up and he was all cooperative. This was in the 1990's before cameras on cellphones, but I was able to get my college textbooks and other items out that night and when the cops left I went back inside and flipped the tow truck dude off to his face.
The judge was wrong here the point was that no one called them to pick up that car. Yes they had a contract but the protocol is as he stated the judge was wrong. Speaking from experience
