  • The plaintiff alleges the defendant illegally towed his car, scratched his bumper in the process, and charged him an outrageous fee, so he’s suing. The defendant insists he had every right to tow the plaintiff’s car because it was illegally parked.

    An emotional support animal is not a service dog. An emotional support animal does not go through any type of training and could literally be any type of animal that the person feels comforted by. A service animal goes through extensive training and has to pass certain criteria to qualify as a service animal for specific medical and physical needs of the person they're needed for.

      ​@@marleonetti7It looks to be an American Staffordshire Terrier, just as the guy said. It is a real breed that was bred from the Staffordshire Terrier from Britain. The Staffordshire Terrier has been around well before the American Pitbull Terrier.

      There is no criteria for training, certification, nor registration for service dogs in the United States. Different training organizations can have their own criteria but that is not Government required.

    When you park somewhere you shouldn't, with a car that isn't even registered, there are consequences. If he had it registered, he could have probably negotiated a solution right there.

    After reading a lot of these comments, I come to the realization that the people who say plaintiff should have won case are the same people who have probably have had their cars towed when they were parked unregistered on private property and towed.

      never had that happen, but I'm hard pressed to believe most of what comes out of the mouths of tow companies, they've always been crooked for decades, everyone old enough knows this. a lot of crooked bullshit in the towing industry.

      ​@The Bipolar Express they DEF can and r great ESA, but I think in this situation folks think he has the pup.2 look tough 4 his job. If he had a Lab probably wouldn't think that. I'm not saying it's right, your ESA is whatever animal breed you bonded with. I myself have been badly attacked and wounded and my lab has been attacked by a pit BUT I have no bad feelings towards the breed. If I'm honest I would probably be more scared of a large pit, stocky with cropped ears versus a Labrador or poodle. I advocate 4 having whatever breed as an ESA u bond with that is under your control in public without any behavior issues.

    Regardless of what’s going on with the defendant, the plaintiff is an idiot for bringing this case to court. He was in the wrong for parking where he shouldn’t AND not having his vehicle registered AND jumping into the car.

    His dog is more like a bodyguard to intimidate people. He couldn’t look at the judge when answering questions, Judge Judy would have made him look at her, he was just lying also about the picture.
    Even if the plaintiff shouldn’t have parked his car there, I believed him and the Judge treated him unfairly.

      He wasn't treated unfairly. She probably would've granted him more if his car was registered, but his car wasn't. So the full tow was in fact lawful.

    That plaintiff lied several times, he lied about how long his vehicle was parked illegally on private property, he lied about his car not being on the road....so I guess he teleported his vehicle there, and his bumper damage really looks like it's been there for a while.

      According to Harvey Levin, the laws vary from state-to-state, so that's not always possible unfortunately.

    Most tow places that I've dealt with in Missouri will let you pay to drop it off the car right there or you're going to pay extra if they take it to the yard but you have to catch them before they're driving away

      I live in Missouri and fortunately haven't had to deal with any tow lots here. But in Florida, when I was 19, they towed my brand new Firebird. The car was licensed in Missouri because I had only lived in Florida a couple of months at that point. In order to release the car they wanted to see my I.D., which is fair, and the registration, which was in the car. They said they couldn't let me into the car unless I could prove it was mine so I couldn't get the receipt out of the glove box to show them. They said the title would work as well. Back then in Missouri the title was held by whatever bank the lien was through. So I got a copy of the title from the bank. The tow lot saw the copy and said they needed the original. Of course the bank wasn't going to release it unless I paid the car off. So I asked if there was something else I could get to prove it was mine. At this point over 2 weeks had gone by. They said I could get an original registration issued by my home state. To Missouri's credit I called and told them the situation and they had me a new registration in my hands in about 3 to 4 days. Still, at $30 a day plus the original tow fee the total was over $600. That's in 1987 money. The tow lot knew how hard it was for out of state people to get the proper documents and there was absolutely no government oversite of them at that time. And I can tell you it left a really bad taste in my mouth!

    A tow company can NOT release or drop a car if it’s not proven he owns the car. The plaintiff did NOT have a bill of sale or was it registered in his name. The tow company had every right to tow him.

      @@alyssahamlettthey aren’t really protected. You can’t take an emotional support dog just anywhere. You can with a service dog, though. My girlfriend got kicked out of a hotel who had a “no pets allowed” policy. We looked it up, and the hotel was correct.

    I do not believe the Plaintiff, for if you are not living there and had not parking permit in the parking lot of the complex, they can tow you, signs are all over the place telling you will be towed. And since he did not live there, he did not have a car key to open the gate. Knocking on the gate like a door will not make them open. LMAO! And not good to get into a car that is getting towed, for the police can be called to arrest you. And then he jumps out of the car, then gets back in. This plaintiff was nuts and stupid. And any damages it the fault of the plaintiff acting like a complete nut. And then, in the court room, the plaintiff decides to only break down the cost of the estimated cost of the so-called damages. Bet the bumper was already damaged.

    An emotional support animal is NOT the same as a trained and certified service animal. Much less leeway {usually} on where you can and cannot take a "teddy bear" support animal.....

    Do service animals ever not have their vests on in public ? Like any time I see people say that and they don’t have anything on them to say that then I’ll think they’re not being honest

      Yes, frequently! No vest, harness or special gear is required of any service animal. Per the Americans with Disabilities Act. This way if damage, bad weather, a dog having an issue with its skin (like a bug bite you dont want to turn into a sore), or other circumstances prevent the use of gear, the handler can still go out and about their daily lives.

    Lol this whole case is a mess but I genuinely feel like the home owners association is bullying the residents and causing all this drama. His friend who also got her car towed is reason enough for me to know that the leader of the HOA is a menace to the neighborhood. How bout tell the guy YOUR NEIGHBORS before you start towing

      You obviously don’t get the case. Apartment complexes and other property homes have rules and regulations they have to follow. And many apartments complex will not allow unauthorized vehicles just sitting there. It’s the legal law.

    Years ago in Dallas a bunch of tow truck companies were caught illegally towing cars out of low-income apartment complexes, booting people's cars in parking lots after the drivers paid for parking. One year during a Tx vs. OU game a person with a sign was collecting $20 car to park in a field and 30 minutes after the game started tow trucks started towing all the cars away. It was later discovered the guy taking the money worked for the tow company. In every case, the City tried to shut them down all they did was transfer to company to a different person and change the names.

    Thats my service dog, I am such a great person that I need one to protect me. By law you are not to tow a car with someone in it. I took pictures of his car before hand and it was already messed up but they did not turn out showing the messed up part so she just took his word.

    correct verdict BUT, no way in hell the photos became "corrupted" on the tow truck driver's phone. Corrupted on a hard drive, that can happen, on a phone, not so much. marilyn was gullible on that one.

    cool outcome, but sometimes the tow company is in the wrong. I've had tie rod damage, rocker panel damage, and transmission pan damage from a tow!

    I don't believe the tow truck guy saying he had pictures of the damaged bumper. His face said it all when he said the pics were "corrupt" I mean he went through all that, risking 2 lives to tow the car, yet he couldn't figure out a way to get those pictures? They are both nuts, but I believe the plaintiff. The tow driver was probably swirving irradically and the bumper hit the ground. Smh

    Where did he buy the car, dealers can get you temporary registration until the DMV gets the paperwork done. There are some self-storage places you can pay to store the car until your registration is done, just have insurance. He's an idiot for leaving his car at a complex he doesn't live at. Fair ruling.

    while impartial to the plaintiff because there are alot of tow truck drivers that are greedy , not all. People it happened to me as well, do not park your car in any parking spaces where its private property or at apartment buildings condos lofts any type of parking structure where you have to have a permit to park.!!! However they can not damage your car regardless if you got damage on it or not

    Pit bulls are smart enough to be an actual service animal, but dogs have to pass rigorous temperament evaluation. So service dogs are not usually pit bulls, but an emotional support dog can be. But that is not a service dog. I had an American Staffordshire terrier for 13 years she was the smartest dog I ever had. She champion pulling lineage and she was a beautiful pitbull!

    I believe the plaintiff whole heartedly. The defendant broke so many tow truck driver rules.
    I know people generally just dislike toe truck drivers, but there’s no excuse for not offering a drop fee. Ownership could’ve been proven by a drivers license and insurance card.. but he decided not to give him the option.

    If someone gets towed for illegal parking and their car gets damaged in the towing process they shouldn't be compensated for the damage because it's their fault they got towed.
