Like this clause - many people won't look it up and if they receive the email that they signed it it and now have violated it they just might give up. I was looking this up casually and getting pretty nervous at the idea that there was no apparent way to stop vendors from imposing these types of non-disparagement clauses on customers... Thank God there actually is a law about this. Non-disparagement as part of a legal settlement is one thing, but as a sales condition, it's another.

Probably blame BPD which as someone with BPD it’s exhausting how bad we get made to look by folk like this. I have been told by medical professionals at hospitals that ‘if a woman comes in and has BPD on their chart we won’t keep them in, it’s just crazy bitch disorder.’ It’s horrible, I have worked so hard to manage my BPD and it doesn’t harm anyone but me, I have coping mechanisms and way to communicate to those close to me that I am spiralling with it. BPd is like any other mental illness, it’s on you to manage that.

I've heard too many stories, even from professionals, of the attitude that "BPD isn't treatable" or "too much trouble." I have bipolar that was misdiagnosed. Therapy still helped. A close friend with BPD gave up on getting help. I think it's the repeated rejection. She tries to cope with a social network and staying busy. Sometimes it works.

If I were making an order and got that pop up, I'm hitting the back button and deleting what's in the cart. That screams that the shop has had/is having massive issues with orders. No way I'd take a chance on that business, idc how unique their stuff is.
From a crafting perspective I could explain why the rugrats shirt was faded, but to keep it simple, if you want it bright in the way that she makes them, it needs to be printed on white. You have no idea how common this behaviour is in small online only shops. Not all of them, not at all, but so many send sub par product, months later if it all. They blame their kids and then things escalate until cancer suddenly hits themself or their family. It's amazing, there almost seems to be a script.
Yep! This has happened to me twice by two different baby/toddler moccasin small businesses. Spent $120 with one and around $110 with the other. Wild stuff. One of the excuses was that her sewing machine was broke so she had to buy a new one.. ok whatever, one of the pairs I ordered was for my sons Easter outfit and it was almost Easter but whatever.. fast forward to fucking summer *end of summer I may add and I finally received the moccasins…. Of course NONE of them fit because it had been literal months upon months so she said if I sent them back she would add length to them and send them back to me.. cool, I did that, tracking said it was dropped off at her address on her doorstep and she claims she didn’t get the package. Never got them back and never got a refund and she ignores all my messages.. I tried messaging her on Facebook again like 2 months ago and I was blocked so I messaged the company’s IG account and no response. This was NINE pairs of moccasins! (Ordered them during a sale in February of 2023) Thats a lot of shoes I didn’t get back! I’m still pissed and this happened this past year. It’s so infuriating that people literally don’t care about other peoples money.

As a small shop, being upfront with turn around times (TAT) for items whether they are custom or not is super important. During busy times I can be out 6 weeks on custom orders.
Same for my brother. He got slammed for the holidays. So he had to change his time too. There were ones that saw it and still was ok with it. A couple that was snarky. He just provided screenshots of the multiple places it mentions shipping times. They usually dropped it because they realized it was their bad

I’ve waited 14+ weeks for fabric from an amazing shop. Unfortunately this has lead to lots of shops getting overwhelmed or they mismanage money and don’t have the money to ship the product when it arrives months later. Fb groups like the one CC talks about in the video are lifesavers for communities like ours, consumers need to know who they can trust and it’s an amazing thing that these groups try to have the shop owners be members so they can explain their case if an order goes wrong. If they can’t handle the business nor take accountability this is what we end up with. I’m not really shocked I guess that Janet has her hand in it, she’s a shit magnet.
Yes, absolutely. But part of the problem is the platforms. Etsy changed its business model, so now it's like early e-bay. Most big platforms aren't set up for custom or handcrafted work. There are platforms where creators can list or post. For creative work, customers are shopping by guesswork, shop appearance, or word of mouth.

I’m not a lawyer, but that pop-up disclaimer in non- binding. You can’t tell someone that they cannot complain. I would never buy from a shop that has that kind of thing on their website. It would definitely make me feel like there would be something to complain about.

The quickness that I would have responded with “please let me know the date, time and location of our court appearance. I will be requesting compensation for attorney fees, travel, accommodations, and missed wages. I will also be requesting compensation for the distress this has caused me and my household as I feel your statements had an underlying tone of threat.” 😂😂
That pop-up “non disparagement clause” violates “The Consumer Review Fairness Act or CRFA” and wouldn’t be enforceable. Allegedly. Ironically you could report that to the FTC.
The BBB doesn’t actually do anything to help customers though. People should consider contacting the state Attorney General where the business is located. Also know the time limits for chargebacks on your credit cards-a lot of them are 90 days. PayPal is 180 days. Document your attempts to contact her to get resolution as well as those tracking numbers that go nowhere and FILE CHARGEBACKS. Also girl if you like business drama where people routinely fake their own deaths, welcome to the knitting community.

As a seller, I don't even get why she'd bother buying a label. The buyer, Etsy, USPS can clearly see that the label is in "pre shipment" and hasn't been scanned in by USPS. It fools no one, but costs her shipping. 🤦🏼♀️
@CalicoBelleHandmade op is correct, there's no pay-out if the USPS tracking never reflects USPS accepting the item to begin with. Pre-shipment status = it was never dropped off in the eyes of USPS. It's in the fine print on the insurance. After it reflects being dropped off by an acceptance or pickup scan, a thief can then scam USPS and the seller out of both money and the actual item. They usually do this by asking the seller to ship it to a different address than the one provided by Etsy during the transaction, which breaks ETSY rules so they won't have the seller's back. Inexperienced sellers deal with this a lot, unfortunately.

Love your content. Just wanted to add my .00000002 cents on usps/tracking as of at least last fall, as a small business owner. They don’t scan on acceptance sometimes. They don’t scan at all sometimes. I’ve had packages arrive to customers with zero scans at all. I can’t afford to bump up to a “better” service (fedex/ups/dhl) and I’d have to pass that expense on to my customers which I refuse to do to them. This truly keeps me up at night. Not to defend this woman who clearly wasn’t shipping things. But, USPS is severely underfunded and understaffed. It’s a miracle we can still use it at all. In my region, my most local post office told me verbatim they do not scan anything there, it all gets sent to the closest bigger city. So I cannot ensure a first scan for my customers unless I drive 2 hours away to that specified post office. 💀💀 I hate that for them and I hate it for me. 😂 there’s no winning for anyone there. Luckily I have the best customers on the planet who are not only snarky but patient and kind humans. Anyway, thanks for letting me rant and keep up the good work!

I own an etsy shop and I usually do everything to make sure that my orders are shipped early at minimum on time I don't understand why do this? Most people do shops so they can do something they love.. it gives us all a bad look and trust issues on the consumers side to even order from noncoporate stores. This makes me so sad as someone who is actively trying to even get sales as a new etsy shop owner, that this person is getting sales and not making the products scamming the customers 😔

These kinda small biz owners upset me so much as a small biz owner. Listen, sometimes usps doesnt update great... but its not regular practice. And she could avoid it by dropping packages off herself.
Okay I will say, as a business owner, occasionally there are times where tracking won't be updated. This is typically only during the holiday season when they're SWAMPED so they skip some of the scans. That being said, it's obviously not EVERY package and clearly this scammer is taking advantage of the very few times this mistake gets made. But I just want to make sure people know that sometimes this does happen and we're not all scammers lol.
As someone who has been working for USPS for 8 years now, I can confirm, you are right about the tracking information and label being created. Happens ALL the time. Literally just had a customer call 2 days ago about this type of issue. Label was created on the 2nd and never entered the mail stream as of today. We see it all. The businesses can't hide behind "tracking" and usps as the issue in this kind of scenario. We don't receive it, we can't deliver it.

I am not a lawyer, but I used to be a paralegal, and my husband is a lawyer, and this is some hilarious bullshit. Every single thing that she says in those posts is grounds for being disbarred, at least in the state where I live. And then it will catch up with her, and this video will be one of the reasons why. You’re doing the lords work Cc. But for real, we have been married for 17 years and are 42 years old, and we just finished paying off his law school loans last year. They were as much as a cute studio apartment every month for the better part of two decades, and it pisses me off when lawyers think that they can invent the law. Her days will be numbered the minute the bar association finds out about this horse shit.
Lawyers nowadays really seem to just be inventing precedence, laws and standards of practice to suit whatever angle they've got. Very disheartening.
As a small shop, being upfront with turn around times (TAT) for items whether they are custom or not is super important. During busy times I can be out 6 weeks on custom orders.
Same for my brother. He got slammed for the holidays. So he had to change his time too. There were ones that saw it and still was ok with it. A couple that was snarky. He just provided screenshots of the multiple places it mentions shipping times. They usually dropped it because they realized it was their bad

Same, I’m in the sewing community and custom printed fabrics are typically preordered, made in china and then shipped to the US where the shop cuts and ships. I’ve waited 14+ weeks for fabric from an amazing shop. Unfortunately this has lead to lots of shops getting overwhelmed or they mismanage money and don’t have the money to ship the product when it arrives months later. Fb groups like the one CC talks about in the video are lifesavers for communities like ours, consumers need to know who they can trust and it’s an amazing thing that these groups try to have the shop owners be members so they can explain their case if an order goes wrong. If they can’t handle the business nor take accountability this is what we end up with. I’m not really shocked I guess that Janet has her hand in it, she’s a shit magnet.
Yes, absolutely. But part of the problem is the platforms. Etsy changed its business model, so now it's like early e-bay. Most big platforms aren't set up for custom or handcrafted work. There are platforms where creators can list or post. For creative work, customers are shopping by guesswork, shop appearance, or word of mouth.

I’m not a lawyer, but that pop-up disclaimer in non- binding. You can’t tell someone that they cannot complain. I would never buy from a shop that has that kind of thing on their website. It would definitely make me feel like there would be something to complain about.
If I got a pop up saying I couldn’t share negative comments about a business at check out, I would back out of that purchase so fast. Big red flag!🚩🚩🚩

The quickness that I would have responded with “please let me know the date, time and location of our court appearance. I will be requesting compensation for attorney fees, travel, accommodations, and missed wages. I will also be requesting compensation for the distress this has caused me and my household as I feel your statements had an underlying tone of threat.” 😂😂
That pop-up “non disparagement clause” violates “The Consumer Review Fairness Act or CRFA” and wouldn’t be enforceable. Allegedly. Ironically you could report that to the FTC.

The BBB doesn’t actually do anything to help customers though. People should consider contacting the state Attorney General where the business is located. Also know the time limits for chargebacks on your credit cards-a lot of them are 90 days. PayPal is 180 days. Document your attempts to contact her to get resolution as well as those tracking numbers that go nowhere and FILE CHARGEBACKS.

As a seller, I don't even get why she'd bother buying a label. The buyer, Etsy, USPS can clearly see that the label is in "pre shipment" and hasn't been scanned in by USPS. It fools no one, but costs her shipping. 🤦🏼♀️

@CalicoBelleHandmade op is correct, there's no pay-out if the USPS tracking never reflects USPS accepting the item to begin with. Pre-shipment status = it was never dropped off in the eyes of USPS. It's in the fine print on the insurance.
After it reflects being dropped off by an acceptance or pickup scan, a thief can then scam USPS and the seller out of both money and the actual item. They usually do this by asking the seller to ship it to a different address than the one provided by Etsy during the transaction, which breaks ETSY rules so they won't have the seller's back. Inexperienced sellers deal with this a lot, unfortunately.
@CalicoBelleHandmade yes, I can file a claim as a seller. You aren't understanding the issue. You're saying USPS will refund you for a package lost BEFORE they scan it into USPS possession. As a seller, I can't "lose" a package in my house pre scan and get refunded 😂

Love your content. Just wanted to add my .00000002 cents on usps/tracking as of at least last fall, as a small business owner. They don’t scan on acceptance sometimes. They don’t scan at all sometimes. I’ve had packages arrive to customers with zero scans at all. I can’t afford to bump up to a “better” service (fedex/ups/dhl) and I’d have to pass that expense on to my customers which I refuse to do to them. This truly keeps me up at night. Not to defend this woman who clearly wasn’t shipping things. But, USPS is severely underfunded and understaffed. It’s a miracle we can still use it at all. In my region, my most local post office told me verbatim they do not scan anything there, it all gets sent to the closest bigger city. So I cannot ensure a first scan for my customers unless I drive 2 hours away to that specified post office. 💀💀 I hate that for them and I hate it for me. 😂 there’s no winning for anyone there. Luckily I have the best customers on the planet who are not only snarky but patient and kind humans. Anyway, thanks for letting me rant and keep up the good work!

I own an etsy shop and I usually do everything to make sure that my orders are shipped early at minimum on time I don't understand why do this? Most people do shops so they can do something they love.. it gives us all a bad look and trust issues on the consumers side to even order from noncoporate stores.
This makes me so sad as someone who is actively trying to even get sales as a new etsy shop owner, that this person is getting sales and not making the products scamming the customers 😔

Okay I will say, as a business owner, occasionally there are times where tracking won't be updated. This is typically only during the holiday season when they're SWAMPED so they skip some of the scans. That being said, it's obviously not EVERY package and clearly this scammer is taking advantage of the very few times this mistake gets made. But I just want to make sure people know that sometimes this does happen and we're not all scammers lol.

As someone who has been working for USPS for 8 years now, I can confirm, you are right about the tracking information and label being created. Happens ALL the time. Literally just had a customer call 2 days ago about this type of issue. Label was created on the 2nd and never entered the mail stream as of today. We see it all. The businesses can't hide behind "tracking" and usps as the issue in this kind of scenario. We don't receive it, we can't deliver it.
