    Hey Boy's ,Good job! My brother and I have been prospecting and mining for almost 40 years. We learned from an old prospector that had been at it for another 50. Never thought the people of this country would allow this kind of bullshit,pansy ass,ball less milktoast, creepy, crap to happen. We have fought with USFS.BLM , just about every acronym you can think of. My brother is still openly dredging in California and they won't touch him. I believe that with the new administration coming in ,these slimeballs are worried about their jobs going bye bye. They cost us a lot in down time,hassles and just plain bullshit. What pisses me off the most is they took the fun out of prospecting and dredging. So, payback , lets take the fun out of their lives for awhile. Piss poor excuse for a man taking another mans rights by calling it HIS JOB. Any how I'll be donating and joining soon. Keep the faith !

    “You can’t dredge on your own property because you haven’t filed a Plan of Operations with us, peasant!” (My interpretation of what the USFS lackey was essentially saying.)
    Give these bureaucrats any more leeway and you won’t be able to take a sh*t unless you file a Plan of Operations with them.

    I did,nt see any signs stating the river or creek was restricted are zoned off from dredging or mining or no trespassing......without being posted with a Federal Code restricted sign on the property the miners have the rights to continue with their work.......

    Good job AMRA, had problems with a ranger district in Colorado one year. Started caring copy of official USFS policy in my pocket to counter over zealous folks. Keep up the great videos.

    That was AWESOME! I am so glad that you educated him on case law. Now it is on record. For him to insinuate that supreme court cases are not relevant was gold. I hope you sue him in civil court so he will not do it again. He was not an attorney and should have had an attorney present if he was unsure, geologists are not experts on law, just minerals. If you had signed those papers it would insinuate that you acknowledged their authority and you might have signed away your rights. Never sign something if you are unsure. If you sign something, you may be signing away your rights. Please update this if you can.

    As a recreational miner during the winter months, I find this quite disturbing to the taxpayers. I live in Texas and I prospect AZ, NV, CO, MT. I'm a retired truck driver. I will join your organization. I believe it was a retaliatory strike against you as well because you expressed your rights. This is an out right abuse of power!

    This junior G man first had a degree in geology a science that deals with the land, minerals, plate tectonics, volcanos and anything to do with the Earth. It seems he was trying to effect a shutdown because he claimed the dredge was harming the fish. That conflict was beyond his area of expertise because the science of geology deals with the earth and not living systems. The science that deals with the fish is biology a degree which he does not have. It would first take a qualified biologist to determine any damage to a living organism. Then it would require a right, a power given from a law. I do not know the law in this matter, but it seems the geologist was out of his field of expertise. Third it would also require a punishment or fine as some laws do not have punishments or fines. An example is the law that the head of house hold must own a fire arm in Kennesaw, Georgia. This law has no punishment so there is nothing to enforce. The police can not arrest a citizen in Kennesaw for not having a fire arm. Last the agent must have the authority to enforce the law. A State Wildlife Officer has a badge and a gun can is duly authorized by the state where he patrols to apprehend and arrest a citizen for failing to comply with the law. The biologist had no badge, gun or uniform either for that matter so I doubt he had any authorization to enforce any statute, to arrest a citizen or enforce anything.
    I think in that situation I may have politely told him to have sex with himself.

      It is a Federal mining claim, it is not private property...meaning anyone can camp, fish, hike etc... on the claim, the mining claim owner owns the mineral rights. It is on public lands.

    I have a different question. If I built a dredge with 2 suction hoses would the size of the dredge be doubbled? Say a 4 inch dredge with 2- 4 inch suction hoses would that be considered a 8 inch leagaly?

    Good job guys! I consider self a strong environmentalist (not that it has anything to do with this anyway it seems) this type of agency/authority overreach is WAY OUT OF CONTROL. I hope legal action was indeed carried out against Hughes and others involved. There has to be consequences for this sort of abuse of power.

    Amazing how people that aren't held accountable degrade into ideological idiots. Also, I would imagine if the miners did submit a plan as they state is required they have the ability to simply deny any plan as they see fit.

    guys a geologist and says "i dont even know how to run this rig" wtf kinda geologist doesnt know how to operate a gasoline powered dredge....thats kinda like saying you dont know how to start a lawnmower . . .
    so sick and tired of idiots and power brokers making it illegal to dig a hole in the woods and make an HONEST living. its getting to the point here in oregon where in order to mine you have to go around like secret operatives or else risk a 6 month or so jail sentence....for trying to make a living.

    Why don't you just ignore him and go back to dredging? If you don't take the letter from him and you refused to give them your names and the sheriff is on your side and the only legal recourse he has to force you to do anything is that sheriff then why are you even worried about him?

    In 1998 I graduated High School only 2 go to CC college & have my heart broken. I was going for an A/S degree N Drafting & Design. I am now unemployed & due 2 an injury bac n 2010 I am disabled but the US Gov. denied my app 4 a disability paychek (I am partially disabled, but still..). Just because it has been over 10 yrs. since I last filed income taxes (form 1040 EZ) the rules state that I cannot apply again.. at least not n a way where I get a paychek.. 10 yr. limit. It was on the US Gov. SS website where I can C my report 4 retirement SS.. if I ever get there.. once I log N. I am so tired of the US Gov. power tripping these days.. bac N 1970 it was OK. But ever since 1990 Florida at least, if not the whole US, has gotten 2 a sad point with certain rules/laws. Things such as building codes.. which should b there 4 safety ONLY n a minimal way. But not 2 the point where it interferes with the design/creative process of homes.. 4 instance. Ex. there is a rule that a wall cannot b thicker than about 1 foot.. now what does that have 2 do with safety.. it does not! @Eidsmore on Twitter

    Constitutional federal authority in a state is Article 1. Section 8, P 17 ten miles square and authority over all places purchased by the consent of the legislature of the state in which the same shall be, for the erection of magazines, arsenals, dock yards, and other needful buildings...
    "The Congress had authority to create territorial governments prior to a new state was admitted as authorized by Article VI, All debts contracted and engagements entered into, before the adoption of this Constitution, shall be as valid against the United States under this Constitution, as under the confederation." US Constitution, Article VI, paragraph 1.
    Admission of new states was a plan under the Articles of Confederation and made a part of the US Constitution in Article VI. In that plan congress was to pull out of the new state and follow Article 1, Section 8. The only other authority provided for in the US Constitution is found in Article IV, Section 3 and that is to dispose of the territorial claims in the new states. There is not Amendment created to alter Article VI. The presence of the federal government in the Interior is unconstitutional and therefore unlawful. The plan included The Land Survey Ordinance 1785, and the Northwest Ordinance of 1787 and followed until mineral wealth discoveries plus Reservations in the west. By losing the territorial authority Congress would no longer have authority over the western mineral wealth so it created the Department of Interior giving it teritorial authority without an amendment.     What's hypocritical is that the large mines are leaving behind leaching ponds and pollution that is ACTUALLY doing harm to the environment. The guy they sent would probably even agree. He's in the position to be voicing about the tyranny.

    Hi. I am glad that AMRA stick up for the miner, you are doing an excellent work. I am sure that if there was a miner, who did not have the backing of AMRA. he would be forced off the river, and possibility would land up in the courts. I am from Wales, UK. We have similar problems, that government don't take kindly to metal detectorists here in the UK.

    it's becoming obvious that Clint has not been around the block much .... someone told Clint to do something ... so he did something, and he says it was his decision(didn't sound very convincing when he said it), ... not a good move when a supervisor probably pushed him to do whatever was needed, and intends to let Clint take responsibility for his own actions(?).

      Yeah. I felt sorry for the guy. He was nervous, out of his depth and clearly didn't really want to be there handing out pieces of paper when he could have been doing something closer to his calling. :-/
      Still, I admire how both sides were courteous in what was a contentious situation.
      Here in Australia, us prospectors and fossickers have similar issues with opponents to our activities and as a result have formed various associations that work with government bureaucrats in an advisory capacity, to oppose unjust rules and regulations, and educate the public.
      Unfortunately our recreational pastime (and in some cases, livelihood), is used as a political football, with politicians from both ends of the spectrum (left and right) abusing freedoms and commonsense in their quest for political power.

    I have faced morons like him in past over housing, property bounds, even having a few go as far as demanding a lot of additional work and expense for construction permits (which was ignored btw)....

    Mr. Hughs cannot manage/enforce mining ops when he is unfamiliar with the law. take them to court and require USFS to provide a QUALIFIED geologist that is up to date on all the law to do the job. I doubt they'll find many geologists (if any!) who are mining law experts as well. Maybe they should hire a MINER!

    During Shannon's conversation with Clint Hughes (U.S. Forest Service Geologist) the first statement asserted by Shannon is, "We are not causing a significant disturbance".___ However, some of the images in the beginning of this video show the suction-dredging operation removing large volumes of undisturbed natural river-bed gravels creating deep unnatural holes in the river-bed and displacing the processed classified tailings from those deeply dredged-out holes randomly to other parts of the river-bed creating unnatural raised levees on the river-bed which is completely repugnant to the natural ecology and natural formation of the river.___ Perhaps gold mining suction-dredging operations could be reinstated if the suction-dredge miners could engineer and implement a method to properly replace the processed classified tailings back to their original location within the river-bed in order to restore the river-bed to its original and natural undisturbed condition without leaving any deeply dredged-out holes and randomly raised levees as a result of the suction-dredging operations?___ Thank you Shannon for all you do for AMRA and its members.

    Minor point but a mineral claim means the minerals are your property not the land. Don't get the idea I want dredging stopped I love prospecting but we have to make correct arguments. How many land owners over the years have had their land torn up by some minerals company because that company had mineral rights. I think you should be required to take before and after pictures and show you did your reclamation work before end of season.

    I am claim owner in New Zealand and yes we have to jump through hoops to do what we have to to dredge legally. I can't understand why you waste your time with the USFS muppet if you are legally able to mine. Tell him to piss off and go dredging. You have vested in travel and god knows what else to do your mining and time is precious. The sound quality on your recording isn't the best but the gist of the matter is I think he is trying to baffle you with bullshit hoping you'all will bugger off well like I said if you are all legal etc go dredging and don't waste your time with them.
