My grandfather was killed on his way to work by a drunk driver. He wasn’t supposed to go to work that day but decided to go in and ride his motorcycle there. Took several days of suffering and being on life support for him to even pass. He was only in his 40s and it damaged my entire family beyond repair. My grandmother died about 10 years later and my dad ended up on heroin. It’s never ever worth it
There are sooo many options nowadays! Rideshare apps, apps that have a sober driver come drive your car home for you, taxis, subways, trains, etc... hell just gst a designated driver? I dont understand these people
After being around several universities, I can honestly say that this happens on a daily basis. These college kids put themselves above other people’s safety
48 years ago I got stopped for a DUI. I remember thinking I could handle my drinks really well and had no trouble driving home. When the policeman asked me to turn off the car, I remember saying "I don't know how...." He recognized me as a teacher at the local high school and said I would probably lose my job over this. Mercifully he took my car keys. He said I see you live about 6 miles from here...."have a nice walk" (before cell phones, more or less in the country, 3am, snowing, in February). He said we'll talk when you pick up the keys". During my walk I thought about how I could have killed somebody and if I survived how I would have to live with it. There was a lot of guilt, and also gratitude for how I was treated. When I went to pick up the keys, the officer wasn't there, but there was a note in the envelope. "Last chance, from now on I will be watching..." It was a small town suburb and I got lucky. 48 years later I have not drank a single drop of alcohol, not even a toast at a wedding. Still teaching, I tell that story to my students before Christmas because they never know what to get a male teacher. (otherwise I would get a lot of liquor) Hopefully they will learn from my stupidity.
Why do you say that? She was polite, she didn’t yell and scream and carry on like so many. And she didn’t flirt nor was she “smiling” trying to get out of it. She did nothing to indicate she’s used to getting her own way. Maybe it’s just pretty girls intimidate you.

Especially considering the fact that she clearly didn't 'fail' their dumbass field sobriety tests...I chalk up any "mistakes" she may have made to nerves and the fact that she had no shoes on! I've seen a TON of videos just like this one, and she doesn't even come CLOSE to how badly others have clearly failed the same tests! Those tests as far as I'm concerned, are designed to screw you up. I couldn't do half those things sober, and on top of how nervous/anxious I would be, they would for sure determine I was "intoxicated"... And how does it make sense that he told her even if it comes up negative or she passes, she'll still be arrested for DUI?? Special privlieges don't actually exist. There's specific instances that are dramatized and blown out of proportion by the media. Believe it or not, this is how 99.9% of traffic stops are conducted.

Sobriety test is just extra evidence. She was going to get charged with a dui anyways. She's slurring her speach, all signs point to being plastered. I'm like her I don't lose my balance even if I'm wasted beyond belief.

She was not placing her heel directly in front of the other foot several inches in between, while walking the line. She also failed when holding her foot up. She didn't count as instructed and her foot came down before instructed. She likely would have passed a breathalyzer but since that doesn't test for marijuana it was kinda pointless. The test were to try and find more evidence against her, if they can show video of her stumbling or failing sobriety test it's easier to convict right? Rather than just an off the hand "Oh I drank something".
She was tired, not drunk. Drunks dont breeze through the eye test like she did. She was crashing from a party drug or something, but not drunk. You cant fake that eye test, nobody can. She was perfect with it. She deserved a red light ticket, thats it. A good lawyer would have got her off.
I look back and realize I dodged so many bullets being a young stupid kid. Thank God I made it through those years unscathed and wised up. This easily could have been me. Hope she straightens up and flies right.
I once drove after drinking a bit and I never did it again.I thought “it’s cool,I can drive just fine”.But when I started driving I realized just how wrong I was and the danger I put myself and others in.All just to save me and my friends 25 bucks for a cab and having to pick my car up the next day.
That was a thoughtful response. It made me feel better after reading all the other comments. I’m sure she did learn her lesson. These situations can be really traumatizing but of course it is necessary. That doesn’t mean anyone should wish for her to have a difficult time- which will ultimately make it harder for her to turn it around.
I’m 21, used to drive drunk when I was around 18 & 19, luckily never had an accident or got busted. Now I just get an Uber or have a family member or friend drive me

I left a friends house drunk (I’m 20 yrs old) and thought I was sober enough to drive home, I soon realized I was not, so I ended up pulling over into a small airport parking lot 30 seconds up the road and fell asleep almost instantly. I woke up to a cop knocking on my window. I’m parked in front of a fire hydrant, car still running, still drunk as hell. I was dead serious with this officer the whole time, told her exactly what happened, and all she did was take me into the station until I had a ride to pick me up. I 100% learned my lesson, and luckily enough, did not get in any legal trouble. Some people aren’t as lucky as me, but I also made a “smart”ish decision by not driving any more than a few hundred feet
Honestly that is the best decision you made in that type of situation i cant think of anything better than being honest. Just by you parking somewhere saved your life and others as well :)
It never ceases to amaze me how much time American cops waste doing those ridiculous tests when they suspect someone might be DUI. A quick breathalyzer test and job done.

But I agree with you she did the rest of her DUI tests pretty decently compared to some REALLY wasted people. She was probably drunk but didnt have a super high blood alcohol content. debatable. Drive through an apartment complex in the hood in california and youll see tons of nice vehicles. People would rather live in a shitty apartment so that they can drive a nice car. Not saying that is whats occurring here, but benz doesnt always mean rich, especially if the things totaled lol
I know I love seeing this. 19 year old college student with a 30k dollar c300, same car I have for my daily driver. I drove a 7k dollar acrua rsx working full time throughout my entire undergrad, worked through countless late nights to get promotion after promotion through the last 10 years to make a 6 figure salary to afford one of these for a daily while paying insane california rents and still having my corvette as my weekend car. But ya know, some people just get one to start and then go out and fuck themselves with a dui. Good times!

She did better than I did when cops pulled me over for cycling without lights on my bicycle at 2am but I got let off with a warning, and wasn't underage. I told them I will walk my bike back home. On my way back I ran into two guys that were walking down the road asked what the cops were doing. I said they were on my ass and let me go with a warning. Once the cops left I started hearing foot steps and looked behind me and these guys were running towards me. So I just hopped on my bike and pedaled as fast as I could and didn't even look back behind me after that. lol

I feel ZERO remorse for people who drink and drive when there are sooooooo many options at your fingertips to get home safe. I was a bartender (who doesn’t drink at all) for years. I would use my own money to get people Ubers cause my kid is on the road. I did it for him, not the drunks who make stupid life choices.
Shut the hell up, if you’re even driving slightly bad at night by a cop in Florida they’ll pull your ass over and check for DUI. Stop generalizing the stipulation that “everyone is a bad driver in Florida and they don’t get pulled over.” Give me a break, there may be a lot of bad drivers, but they don’t show up as obvious cases of dui in front of cops. At night it’s accentuated more and this girl was probably driving just as bad as others but it’s a matter of place and time.
When you’re in college, you think you’re invincible. As someone who just graduated, I can confirm that a large majority of college kids have the “I can’t be touched” mindset.
My mother got a DUI when I was a kid and I had to pick her up from jail at 2am. I was 17 when that happened and living on my own due to a death in the family. It’s not worth your life, other peoples lives and your freedom. Walk, catch an Uber or call a friend. Sucks to see another person thinking they will be okay and ending up in jail for bad decisions.. I think they had enough reasonable suspicion that she was intoxicated. No, she wasn't slurring her words or falling over but like the officer pointed out, she had a wristband (which meant she had been in bar) and she was observed driving recklessly. But again, she wasn't super drunk and mostly complied which is probably why she only received a citation.
I lost my best friend in high school to a drunk driver that happened to be a mutual friend. I can’t describe that feeling I had in my chest when her mom had to final let me know, we cried until we couldn’t anymore. She wasn’t wearing a seat belt and came through the windshield. Let this be a massive picture on how some things like this can escalate.
That’s insane. A friend from high school was involved in a drunk driving accident and she also was not wearing a seatbelt and went through the windshield and was impaled by a tree. It felt like a dream the funeral just everything.
Because she's still a kid, and now her life is over. And some inbred jackals have seen fit to post this online so they can laugh at the humor that is authoritarian punishment. So she will be ashamed to leave her home, and will exist ad infinitum as the modern equivalent of the stockades. I am guessing it was more about her believing herself to be a good person, with dreams, who made a big mistake, and an hour ago she was just a normal kid, rather than "LMFAO laws don't apply to me for some reason!". Her first mistake was saying she was coming from downtown at the bars/clubs when she’s 19 lol. Young, attractive college girls always get a pass to get in these bars even if she didn’t have a fake ID. Unfortunately I’m old and ugly so I’d have to pay extra to get in 😂
We had fake IDs in college and never got caught but we always had a DD when we went out drinking. I don't drink anymore. I have a kid now but I have to admit I miss those party days every now and then! We were always responsible

I don't know if it's really related but showing remorse is often a mitigating factor in sentencing. When you're drunk I don't know how truly remorseful you actually are though.
Also she intentionally ran a red light. Not only is she stupid for breaking laws that draw attention to her while she's drunk she's just totally reckless. I won't even run a stop sign in the middle of nowhere. It's just not worth the risk

She kept moving her head on the first test. Almost did 10 steps in the first half of the second test, did 10 steps in the second half (she was supposed to do 9). She had to set her foot down once during the last test, and counted "1000, 2000, 3000", instead of "1000, 1001, 1002, 1003". She said "I somehow lost my *_real_* ID".
She had a fake ID I’m sure because these college kids think they are above the law and get anything they want and hopefully this girl takes this as a learning moment because this is plain stupidity DUI is completely 100% preventable
People are just weird about how they dress to go out. I’ve seen SENIORS wearing pajamas and slippers in the grocery store! Why would you wear a bra to go clubbing?! And where are her shoes?
This is why I’m terrified to drive on the road after 12am. The risk of getting pulled over are so much higher due to the amount of drunk drivers out on the road. When I have to, I’m eyeing every car in my general vicinity for any signs of fuckery. One thing I never thought about for a long time was ALWAYS look both ways at all intersections, even the ones with lights and stop signs. You get conditioned to go when your light is green without looking, meanwhile someone, like this girl, could be running their red light. She’s lucky she didn’t kill or hurt anyone. DUI at 19 is rough. Hopefully this one time was enough for her cause clearly she’s got some type of future with being in college and shit.
Yess! I saw a video where these cars start at a green light and didn’t see a huge semi that blew the red light and swoop the cars with it. So terrifying.
That’s true I used to drive to work very early morning and I was pulled over and officer said I was speeding even though I know I wasn’t. After I gave him my ID and insurance and talked for a few minutes he just let me go tho. Was late to work smh
Has anyone ever actually passed a sobriety test? Or is it just straight entrapment? Because i'm quite confident she did that better than i could sober (besides the eye one) edit: for the record, I do not condone drinking and driving, just don’t see the point of these field tests since they clearly can result in a false positive. In 2008, a friend and I went to South Beach for vacation. We're from Turkey, so we rented a car. We had a few drinks with some chicks and they invited us over to their apartment downtown. On a very empty road, with zero traffic violations, we were pulled over by a cop at 3 AM. He said we were driving recklessly, even though we weren't. Anyways, he took my buddy (the driver) to some sobriety tests. Follow the pen, walk the straight line etc. When he aced them all, he wanted the backwards alphabet. He told him that English is not his native tongue and he couldn't even do that in Turkish. The fat cop let us off, very disappointed. That day, I knew that these tests are prepared just to make you fail eventually. Even if you pass 2-3 of them, they will continue until you say "eeeaah give me a breathlyzer and be done with it".
@@thomasdimartino1001 HGN is the test that’s most reliable. alcohol makes your eyes involuntarily jerk and it’s impossible to fake it or make it stop. bad vision does not cause nystagmus at all. he probably knew he was going to arrest her after HGN because of this
That's why you never play this game of Simond Says. It's designed to trip you up and build a case against you.. Most of the time they rattle off the rules 3x faster than they normally talk so you can't understand, then they say you didn't comply.. She did great. Yeah she moved her head a half inch. big deal. Her hands were by her side the entire time she was walking, yet he kept telling her to keep her hands by her side. Remember, you don't have to take this test. You do however have to submit to a breathalyzer but only at the police station. The portable breathalyzer is not admissible in court.
As Johnny said, it's about building probable cause for an arrest and/or a demand for the blood/chemical test that you can't refuse without a penalty. The "Simon Says" game is optional, but if you refuse, it's more or less a challenge to the officer to arrest you or not based on what they've been able to observe. Blowing a red light, going 60 in a 40(?), and especially going off the side of the road, combined with odor of alcohol, supported by an admission of having consumed alcohol and wearing a wristband for the purpose of consuming alcohol is all probably enough for a good arrest, but the additional evidence from the divided attention tests gives additional cause and builds a stronger case. Remember, being underage carries lower legal limits of alcohol in your system, Florida is 0.02% BAC.

I once failed a field sobriety test, on my way home at 3-4 am after work, when I was 100% sober. (Was later proven by the breathalyzer I begged for). Because I suffer from major anxiety disorder, I was shaking uncontrollably being put on the spot like that....this girl did much better with these tests than I did! These tests are fucking stupid and difficult for most people, regardless if drunk or sober.
Thankfully you can just get a breathalyzer. But if you were dozing off or sleepy that's also illegally operating a motor vehicle. Being exhausted can be just as dangerous as drinking and driving
The tests are given as evidence that can be used in court, so a keen lawyer can’t get their client off on a technicality. They also aren’t looking at just how well you perform. They’re more about the person’s ability to listen and follow instructions, and they’re looking for specific telltale signs of impairment that aren’t commonly known, like involuntary jerking of the eye, during the eye test.

I watched bunches of these videos lately and tried to complete same tests😊 ( I have not had any alcohol in months ) , but could not complete any of these tests at home under perfect conditions when nobody is watching!! I think I should just take public transportation😊
I think this girl might learn something from this, for the simple fact that she said that her parents were going to be mad, instead of the typical crying for mommy. She's had some repercussions in her life.

This is like winning the Super Bowl for these cops because they could not hack it in school and have to go to the gym because they have inferiority complexes. They get off on arresting people and writing up senseless tickets in the same way that some women get off on gossiping about others because they live uninteresting lives. All these rockhead cops did was damage this young woman's future when she was right at her apartment. They didn't "save someone's life". They needlessly damaged her life because they are uneducated and have to delude themselves into believing they're superheroes because they can never be as smart as the real heroes, who actually run the world.
Won’t lie this is the calmest arrest I’ve ever seen. And I feel slightly bad for this lady because she seems very genuine but she just really fucked up. I respect the police for being patient in this situation.
I thank God me and my family are still alive! We were struck by an 18 year old drunk driver on the freeway .. it was the most traumatic thing I’ve had to endure .. please just get an Uber if you’re out drinking !

It was funny how she tried to make the police officer feel empathy for her by saying "i know a cop he helped me when a guy was harassing me" , "You look familiar". She's so manipulative. 23 year old male here drinking since I was 16 Thought I was immune like everyone else-- of course until it happens. I totaled my car 1 month ago, driving with no insurance on a 2017 vehicle. I crashed into a toll booth with ZERO memory of that night, don't actually have a single clue how I left the club, got out of the parking building, or even how I was "conscious". I can't express how absolutely, and I mean PHENOMENALLY lucky I was to have not only escaped without a scratch but didn't hurt anyone in the process. I can't stress enough how much harder my life is right now, not complaining because I know I deserve it but just want people reading this to know it's not worth it. I traded a few years of my youth right now so I can have 1 good Friday night I don't even remember. Now I have a $50k+ bill in fines and contract violations with my leasing company. Just take the $50 Uber or Lyft, maybe you won't be lucky enough to not hurt anyone or yourself.

My neighbor, and a school mate were in a 1968 Oldsmobile 98 which is a huge car, and we're on their way home at 2:00 AM with his brothers, and two sisters with him. He stopped at a four way stop sign, abd hus car was hit ftkn behind by a drunk driver in a Cadillac Coupe DeVille at 100 MPH. The drunk driver, abd my school mate survived, but he watched helplessly as his Four Siblings BURNED TO DEATH in the car. The drunk driver got a fine of $5,000.00, And six months in jail. He was a State Senator. What a JOKE. No one is above the law.

When she said "my parents will be so mad" the reality is her parents will be thankful the police got her and she didn't kill herself or someone else. She'll learn a very valuable and costly lesson.

As much as I get excited for DUI videos, it kinda makes me sad to see people, especially younger than me, get arrested for this stuff. But at the same time, I hope it serves as a wake up call that if you’re gonna drink underage, Atleast be smart and get a DD.
YEAH, not all are idiots, just young. Still no excuse and they should be arrested and suffer the consequences. But many of them are just kids and don’t fully grasp consequences. I was one of those “idiots” and I definitely learned my lesson that night.

I believe the police have already made up their minds whether you're going to jail or not for DUI before any of the walk the line stuff starts. Very few completely sober individuals could pass the field sobriety test. 9 out of 10 dentists agree with me.
What did she do wrong during the FST? Maybe I missed it but it looked like she nailed walking the line. I don't get why they do them anyways, such a wate of time. Just do the breathalyzer right away
Towards the middle to end of her walking back her feet weren’t completely heel to tow. It’s to test balance, consistency, and equilibrium. And breathalyzer test can’t check for other intoxicants in the system other than alcohol like drugs for example
They do them because the validation studies will tell you if you observe a certain amount of clues you are over the .08 BrAC limit. You would be wasting your time to just breathe in the Intoxilyzer (not breathlyzer, that was discontinued in the 1960's).
You should refuse all FSTs and breathalyzer. Consent to nothing - they will never help you. Just shut up and let them book you and wait for your lawyer.

My father was a cop in 1995 he arrested a young girl who crashed into a bus station and hit a woman there and sent her to the hospital. Airbags saved her life. She explained her act by trying to get away from the alien ship that was chasing her. The bottle of vodka in her car and the drugs in her blood explained everything. 🤦🏾♀
The cop "Officer Greg Nelson" was relieved of duty the following December after drunk driving his duty vehicle into a ditch. Dude's a douche and a hypocrite. Hope his career doesn't recover with the way he tries to fuck people over.
I make my 20 and 18 year old kids watch these videos. I want them to know to never drive and drive. It just isn’t worth it. Call an Uber or have someone else drive. You can literally ruin your life with one DUI. Don’t do it.
She's a kid. Learning a big lesson. I think for the most part she handled herself pretty well. She was respectful to the officers, which is more than I can say for a lot of these arrests :-) Hope she's gotten herself straightened out.
@@pablowilliams3816 these test are not pass/fail. Officers are meant to observe certain clues to determine if the person is under the influence. People have been know to “pass” the tests and still blow twice the limit. Everyone is different.

I think she passed the sobriety tests. I don’t want people to drink and drive, but it seemed like they were trying to make her fail. This is not the first time I’ve seen police give the pen test for a ridiculously long time. There should be a time limit. Also, I don’t think I could stand on one foot even sober for as long as she did. This is not acceptable police procedure. What was her blood alcohol level? That’s the true and fair test.

@Greg Lurik unfortunately, you're probably right. I don't understand why this country allows people to have multiple DUI charges before losing their license for good. Many countries have a 1 and done policy with DUI. I'd imagine their DUI arrest dates are far lower than the US.
Just 30 minutes ago, I was driving home from my office, late dusk nearly dark, stopped at a red light, 4 way intersection, almost no traffic in the area. Light turned green, and for some reason I hesitated before moving into the intersection to make a left turn. That hesitation probably saved my life. A small red truck came out of nowhere barreling through that intersection at about 60 mph. It would have struck me right at my door or just in front of it, almost certainly fatal at that speed. The driver might have been cold sober, but it reminded me just how tenuous life is and how quickly a careless or intoxicated driver can destroy lives…literally in an instant. I myself drank alcoholically for many years and drove in an impaired condition regularly. It’s a miracle I didn’t kill myself and/or others. Blessedly I’ve been sober for a long time now, but this video gave me chills, particularly in light of the crazy driver I encountered a short while ago. I pray this girl sees this as a wake up call but I doubt it. Those warnings certainly didn’t resonate with me at that age. 😞
Why does that seem illegal, if a dui suspect is able to chug some liquid down they can claim they just drank some alcohol thus negating breath and FS tests.

There's hints they look at in the tests that most people wouldn't know. For instance, when they do the eye test where they look back and forth they are looking to see if the persons eyes smoothly follow the pen, or if they jump from place to pace. Most people would never look for this, and wouldn't realize that's what the cops are looking for. Also the test isn't pass/fail, it's just for making observations and coming to a conclusion based on what you saw. There's no concrete criteria for how to pass or fail the test.
I think he was a new hire also. Before he arrived, the other cops alluded to this case being good practice for him, leading me to assume that this was one of his first DUI suspects.
There is no such thing as a technicality. There’s policies and Laws. If a charge gets dropped because of failure to follow either it’s not a technicality. It’s what’s known as Due Process

I guarantee that at least one of the cops on that call drove home with an equal of worse BAC that week.

Any time you are requested to do field sobriety tests, you are allowed to say no. You will just have to spend the night in jail. Then call your lawyer. With no evidence of alcohol or drugs in your system, they have no available charge. They can attempt to use probable cause as you wanting to go to jail instead of the sobriety tests. Your lawyer, you will have to pay them to get you out of it. Any officer is not medically qualified to give these tests, unless they were previously an EMT. Don’t trust any of them, even the nice ones. Field sobriety tests are a trap. Only doctors or medically qualified certificates can give these exams. Police officers are not one of them. They only know basic CPR…

My grandfather was killed on his way to work by a drunk driver. He wasn’t supposed to go to work that day but decided to go in and ride his motorcycle there. Took several days of suffering and being on life support for him to even pass. He was only in his 40s and it damaged my entire family beyond repair. My grandmother died about 10 years later and my dad ended up on heroin. It’s never ever worth it

48 years ago I got stopped for a DUI. I remember thinking I could handle my drinks really well and had no trouble driving home. When the policeman asked me to turn off the car, I remember saying "I don't know how...." He recognized me as a teacher at the local high school and said I would probably lose my job over this. Mercifully he took my car keys. He said I see you live about 6 miles from here...."have a nice walk" (before cell phones, more or less in the country, 3am, snowing, in February). He said we'll talk when you pick up the keys". During my walk I thought about how I could have killed somebody and if I survived how I would have to live with it. There was a lot of guilt, and also gratitude for how I was treated. When I went to pick up the keys, the officer wasn't there, but there was a note in the envelope. "Last chance, from now on I will be watching..." It was a small town suburb and I got lucky. 48 years later I have not drank a single drop of alcohol, not even a toast at a wedding. Still teaching, I tell that story to my students before Christmas because they never know what to get a male teacher. (otherwise I would get a lot of liquor) Hopefully they will learn from my stupidity.

I've seen a TON of videos just like this one, and she doesn't even come CLOSE to how badly others have clearly failed the same tests! Those tests as far as I'm concerned, are designed to screw you up. I couldn't do half those things sober, and on top of how nervous/anxious I would be, they would for sure determine I was "intoxicated"...

She was tired, not drunk. Drunks dont breeze through the eye test like she did. She was crashing from a party drug or something, but not drunk. You cant fake that eye test, nobody can. She was perfect with it. She deserved a red light ticket, thats it. A good lawyer would have got her off.

I once drove after drinking a bit and I never did it again.I thought “it’s cool,I can drive just fine”.But when I started driving I realized just how wrong I was and the danger I put myself and others in.All just to save me and my friends 25 bucks for a cab and having to pick my car up the next day.
That was a thoughtful response. It made me feel better after reading all the other comments. I’m sure she did learn her lesson. These situations can be really traumatizing but of course it is necessary. That doesn’t mean anyone should wish for her to have a difficult time- which will ultimately make it harder for her to turn it around.
I’m 21, used to drive drunk when I was around 18 & 19, luckily never had an accident or got busted. Now I just get an Uber or have a family member or friend drive me

I left a friends house drunk (I’m 20 yrs old) and thought I was sober enough to drive home, I soon realized I was not, so I ended up pulling over into a small airport parking lot 30 seconds up the road and fell asleep almost instantly.
I woke up to a cop knocking on my window. I’m parked in front of a fire hydrant, car still running, still drunk as hell.
I was dead serious with this officer the whole time, told her exactly what happened, and all she did was take me into the station until I had a ride to pick me up.
I 100% learned my lesson, and luckily enough, did not get in any legal trouble.
Some people aren’t as lucky as me, but I also made a “smart”ish decision by not driving any more than a few hundred feet

Yup, when i got stopped ages ago, they checked my eyes for 10 seconds, did a breath test and that was it... took maybe two minutes.

I know I love seeing this. 19 year old college student with a 30k dollar c300, same car I have for my daily driver. I drove a 7k dollar acrua rsx working full time throughout my entire undergrad, worked through countless late nights to get promotion after promotion through the last 10 years to make a 6 figure salary to afford one of these for a daily while paying insane california rents and still having my corvette as my weekend car. But ya know, some people just get one to start and then go out and fuck themselves with a dui. Good times!

She did better than I did when cops pulled me over for cycling without lights on my bicycle at 2am but I got let off with a warning, and wasn't underage. I told them I will walk my bike back home. On my way back I ran into two guys that were walking down the road asked what the cops were doing. I said they were on my ass and let me go with a warning. Once the cops left I started hearing foot steps and looked behind me and these guys were running towards me. So I just hopped on my bike and pedaled as fast as I could and didn't even look back behind me after that. lol

I think they had enough reasonable suspicion that she was intoxicated. No, she wasn't slurring her words or falling over but like the officer pointed out, she had a wristband (which meant she had been in bar) and she was observed driving recklessly. But again, she wasn't super drunk and mostly complied which is probably why she only received a citation.

I can’t describe that feeling I had in my chest when her mom had to final let me know, we cried until we couldn’t anymore. She wasn’t wearing a seat belt and came through the windshield. I don't know if it's really related but showing remorse is often a mitigating factor in sentencing. When you're drunk I don't know how truly remorseful you actually are though.

This is why I’m terrified to drive on the road after 12am. The risk of getting pulled over are so much higher due to the amount of drunk drivers out on the road. When I have to, I’m eyeing every car in my general vicinity for any signs of fuckery. One thing I never thought about for a long time was ALWAYS look both ways at all intersections, even the ones with lights and stop signs. You get conditioned to go when your light is green without looking, meanwhile someone, like this girl, could be running their red light. She’s lucky she didn’t kill or hurt anyone. DUI at 19 is rough. Hopefully this one time was enough for her cause clearly she’s got some type of future with being in college and shit.

In 2008, a friend and I went to South Beach for vacation. We're from Turkey, so we rented a car. We had a few drinks with some chicks and they invited us over to their apartment downtown. On a very empty road, with zero traffic violations, we were pulled over by a cop at 3 AM. He said we were driving recklessly, even though we weren't. Anyways, he took my buddy (the driver) to some sobriety tests. Follow the pen, walk the straight line etc. When he aced them all, he wanted the backwards alphabet. He told him that English is not his native tongue and he couldn't even do that in Turkish. The fat cop let us off, very disappointed. That day, I knew that these tests are prepared just to make you fail eventually. Even if you pass 2-3 of them, they will continue until you say "eeeaah give me a breathlyzer and be done with it".

That's why you never play this game of Simond Says. It's designed to trip you up and build a case against you.. Most of the time they rattle off the rules 3x faster than they normally talk so you can't understand, then they say you didn't comply.. She did great. Yeah she moved her head a half inch. big deal. Her hands were by her side the entire time she was walking, yet he kept telling her to keep her hands by her side. Remember, you don't have to take this test. You do however have to submit to a breathalyzer but only at the police station. The portable breathalyzer is not admissible in court.
As Johnny said, it's about building probable cause for an arrest and/or a demand for the blood/chemical test that you can't refuse without a penalty. The "Simon Says" game is optional, but if you refuse, it's more or less a challenge to the officer to arrest you or not based on what they've been able to observe.
Blowing a red light, going 60 in a 40(?), and especially going off the side of the road, combined with odor of alcohol, supported by an admission of having consumed alcohol and wearing a wristband for the purpose of consuming alcohol is all probably enough for a good arrest, but the additional evidence from the divided attention tests gives additional cause and builds a stronger case. Remember, being underage carries lower legal limits of alcohol in your system, Florida is 0.02% BAC.

I once failed a field sobriety test, on my way home at 3-4 am after work, when I was 100% sober. (Was later proven by the breathalyzer I begged for). Because I suffer from major anxiety disorder, I was shaking uncontrollably being put on the spot like that....this girl did much better with these tests than I did!
These tests are fucking stupid and difficult for most people, regardless if drunk or sober.

Thankfully you can just get a breathalyzer. But if you were dozing off or sleepy that's also illegally operating a motor vehicle. Being exhausted can be just as dangerous as drinking and driving

Thought I was immune like everyone else-- of course until it happens. I totaled my car 1 month ago, driving with no insurance on a 2017 vehicle. I crashed into a toll booth with ZERO memory of that night, don't actually have a single clue how I left the club, got out of the parking building, or even how I was "conscious". I can't express how absolutely, and I mean PHENOMENALLY lucky I was to have not only escaped without a scratch but didn't hurt anyone in the process. I can't stress enough how much harder my life is right now, not complaining because I know I deserve it but just want people reading this to know it's not worth it. I traded a few years of my youth right now so I can have 1 good Friday night I don't even remember. Now I have a $50k+ bill in fines and contract violations with my leasing company. Just take the $50 Uber or Lyft, maybe you won't be lucky enough to not hurt anyone or yourself.

My neighbor, and a school mate were in a 1968 Oldsmobile 98 which is a huge car, and we're on their way home at 2:00 AM with his brothers, and two sisters with him. He stopped at a four way stop sign, abd hus car was hit ftkn behind by a drunk driver in a Cadillac Coupe DeVille at 100 MPH. The drunk driver, abd my school mate survived, but he watched helplessly as his Four Siblings BURNED TO DEATH in the car. The drunk driver got a fine of $5,000.00, And six months in jail. He was a State Senator. What a JOKE. No one is above the law.

YEAH, not all are idiots, just young. Still no excuse and they should be arrested and suffer the consequences. But many of them are just kids and don’t fully grasp consequences. I was one of those “idiots” and I definitely learned my lesson that night.

I believe the police have already made up their minds whether you're going to jail or not for DUI before any of the walk the line stuff starts. Very few completely sober individuals could pass the field sobriety test. 9 out of 10 dentists agree with me.

Towards the middle to end of her walking back her feet weren’t completely heel to tow. It’s to test balance, consistency, and equilibrium. And breathalyzer test can’t check for other intoxicants in the system other than alcohol like drugs for example
They do them because the validation studies will tell you if you observe a certain amount of clues you are over the .08 BrAC limit. You would be wasting your time to just breathe in the Intoxilyzer (not breathlyzer, that was discontinued in the 1960's).
You should refuse all FSTs and breathalyzer. Consent to nothing - they will never help you. Just shut up and let them book you and wait for your lawyer.

I think she passed the sobriety tests. I don’t want people to drink and drive, but it seemed like they were trying to make her fail. This is not the first time I’ve seen police give the pen test for a ridiculously long time. There should be a time limit. Also, I don’t think I could stand on one foot even sober for as long as she did. This is not acceptable police procedure. What was her blood alcohol level? That’s the true and fair test.

@Greg Lurik unfortunately, you're probably right. I don't understand why this country allows people to have multiple DUI charges before losing their license for good. Many countries have a 1 and done policy with DUI. I'd imagine their DUI arrest dates are far lower than the US.

Just 30 minutes ago, I was driving home from my office, late dusk nearly dark, stopped at a red light, 4 way intersection, almost no traffic in the area. Light turned green, and for some reason I hesitated before moving into the intersection to make a left turn. That hesitation probably saved my life. A small red truck came out of nowhere barreling through that intersection at about 60 mph. It would have struck me right at my door or just in front of it, almost certainly fatal at that speed. The driver might have been cold sober, but it reminded me just how tenuous life is and how quickly a careless or intoxicated driver can destroy lives…literally in an instant. I myself drank alcoholically for many years and drove in an impaired condition regularly. It’s a miracle I didn’t kill myself and/or others. Blessedly I’ve been sober for a long time now, but this video gave me chills, particularly in light of the crazy driver I encountered a short while ago. I pray this girl sees this as a wake up call but I doubt it. Those warnings certainly didn’t resonate with me at that age. 😞

There's hints they look at in the tests that most people wouldn't know. For instance, when they do the eye test where they look back and forth they are looking to see if the persons eyes smoothly follow the pen, or if they jump from place to pace. Most people would never look for this, and wouldn't realize that's what the cops are looking for. Also the test isn't pass/fail, it's just for making observations and coming to a conclusion based on what you saw. There's no concrete criteria for how to pass or fail the test.

I think he was a new hire also. Before he arrived, the other cops alluded to this case being good practice for him, leading me to assume that this was one of his first DUI suspects.

There is no such thing as a technicality. There’s policies and Laws. If a charge gets dropped because of failure to follow either it’s not a technicality. It’s what’s known as Due Process

yeah, she seems like a citizen. and frankly, .94 is not wasted by any stretch. it really wasnt all that long ago that it wasnt considered a DUI. granted, any alcohol is not a good idea when driving but she didnt seem unduly inebriated to me and based upon the bullshit double parking claim it seems like the reasoning this whole stop is kind of horseshit. i curious how this case ended up. a good lawyer mightve had something to work with, even more if she had declined the FST and didnt answer a single question, but not having your DL on you kind of fucks that idea to pieces. I guarantee that at least one of the cops on that call drove home with an equal of worse BAC that week.

Any time you are requested to do field sobriety tests, you are allowed to say no. You will just have to spend the night in jail. Then call your lawyer. With no evidence of alcohol or drugs in your system, they have no available charge. They can attempt to use probable cause as you wanting to go to jail instead of the sobriety tests. Your lawyer, you will have to pay them to get you out of it.
Any officer is not medically qualified to give these tests, unless they were previously an EMT. Don’t trust any of them, even the nice ones.
Field sobriety tests are a trap. Only doctors or medically qualified certificates can give these exams. Police officers are not one of them. They only know basic CPR…
