Truly sad how the hard work and discipline of a good father is completely thrown away by an enabling mother. Hopefully the girl realizes how awfully she treated her dad and the rest of her family as she gets older. It's depressing when a split-parent manipulates their child to get dirt on their previous partner, that should be a crime in it's own, it ruins kids for the rest of their lives in a lot of instances.

There’s a deeper issue here. She is clearly feeling upset that her father has a new wife and daughter. I don’t think she should have had him arrested but he clearly isn’t fulfilling her needs.
It was the mom that had him arrested. She owned the phone and he refused to give it to her. The dad can confiscate the phone when the daughter's at his house but when his custody time is over then the mom as the property owner decides what happens with her phone as it's her property.

He took her cell phone away because she was doing something wrong with it. That's being a parent. The woman saw the texts her daughter received and probably showed them to her husband. Where he might have gone wrong is whether or not he handed the phone to his ex when his "turn" was up. If he didn't then yeah, he might have stepped out of line a bit but it's still a waist of our tax dollars.

My thought is how truely bad was the messages on the phone. If it was something over the top bad would the daughter not have been held accountable in court? The messages were to her step sister is it possible it was a regular sibling fight/argument that got a little out of hand.

Getting arrested for this is silly, however I also do not support punishment on an adolescent by taking away his/her belongings. what I would recommend however is something like cutting of internet or something of the sort.
The father shouldn't have even punished his daughter if she Isn't even staying with him (ONLY if she Isn't staying with him!).
Either way, her mom and dad were the one who escalated this whole situation, one by taking it to court and the other by not wanting to return a phone that is not his and being stubborn on it.
