    Mr. Sibal, I am a student of Law, I really follow your oral arguments, specially in Article 370, although I don't support your ideology or argument, but I have to say you have an appreciable skill of argument
    The question which you has made, being a citizen of this country I want to answer, the answer is as follows
    First thing, constitution doesn't fail in 2024, it's the supreme Law of the land, and we are still govern by it
    But its fails in 1971 not in 2024
    Second, Law is an instrument to govern or control the external behaviour of human beings
    And Constitution is to govern the external and internal behaviour of the fundamental institutions of the state
    If institutions or organs of the state fails then is the fault of the Law, because law is made for governance, because it's doesn't achieve it's goal i.e. governance
    The reason behind this answer is the law must observe it's functions and the behaviour of it's subject
    Effective and successful laws are never made its always found and made in juncture
    Lastly, its the only option we have i.e. evaluate the law
    If today a law fails us then after such chaos we have to evaluate the law considering the reasons for such failure and precautions thereof
    Conclusively, Constitution doesn't fail today, but it failed in past, and the reason for such failure as per my analysis, was not having pure supremacy of Law on that time.
    And if it failed then the sole reason will be not evolution with time to time basis (except in case where the Law is, "Ought to be the Law".)

    Human psychology works in a way that it is much easier to engage masses on divisive and hate agenda. But Karti is correct that Congress doesn't have the type of structure which the scores of umbrella organizations that BJP has on it's side to spread their political agenda irrespective of the fact whether it is good or bad.

    Constitution may be all good in books.. but when it comes to implementation its woefully a failure... Take the case of Manipur.. they are playing politics.. and in Manipur's case, the constitution has failed us... Ideally in such a situation the constitution must take precedence over politics. But no.

    How do these respected judges calmly talk with Kapil Sibal , it baffles me! He was shamelessly defending the wb govt in the RG KAR RAPE AND MURDER case. And now he lectures about the constitution! The irony man!
