Yes, but remember the investigators were backed by short sellers. Their aim is to discredit the company so they can make a huge profit. Otherwise, it was the end for Lumber Liquidators and their products were exposed as unsafe, which is really the whole point.

I wish the undercover person would have asked a follow-up question to the lumber mills, "Did Lumber Liquidators asked you to produce flooring like this?" If all three say "Yes." Then LL is guilty of knowingly committing a crime, and all of the BOD including the CEO should be arrested and charged.
That type of thing doesn’t often happen here. I’m a capitalist, but I believe in a certain kind of capitalism that feels far removed from what we have. It makes me feel like the same people I criticize for claiming the communism they believe in hasn’t ever been “done right”, and in my opinion, speaks to the dark reality of government, economics, society, and morality.

There are literally two basic types of people in the world: Those that just want to live life and generally help others live healthy safe lives as well and then there are greedy people who value money and their own personal gain over the safety and general well being of other humans.

Now the settlement, was this the typical class action result? The person with this poison in their home gets a check for less than half of what they paid for the material (but nothing for the installation labor, or the removal and replacement labor)? If a contractor did this, they'd be bankrupted and run out of business. Big corporation? Class Action Lawyers? It ends up being a nuisance expense, the lawyers get a nice chunk of change. I just got a check for $10 for the $100 of crappy LED bulbs Home Depot sold me. The check had a three week expiration date. It's more trouble cashing it, than it's worth. How are consumers protected when the crooked corporation suffers a small cut in profit and we're still burned?
Legal system is all about money, no matter what type of law is being practiced. What we have here is just another example.
In a class action suit, a large portion of the settlement goes to the attorneys.
Yeup, it's the economy of scale. While a 100,000 dollar court fee would bankrupt a small dealer. A conglomerate its just another expense.

Stock high for Lumber Liquidators was about $120 per share (late 2013). Fell to about $12 in 2016. After market close yesterday, it was just under $14.

It's actually a bunch of lawyers that own his stock and want to sell it short. Aren't you paying attention?
Its not really as simple as "dey took our jobs!" The issue is a cheaper option was available and the company took advantage of it and played the game of "its not our job to test what we sell. If they say they comply then they comply!" but the chinese typically dont work that way. In all my dealings with chinese vendors, its always easier for them to do whatever it takes to make a sell and if they get caught apologize for it afterwards (or close the company and re-open down the road as another company). In that sense American companies aren't that different. The only difference is the governments involved. Generally speaking the US has better oversight and regulation of industry where as its an open secret that a solid bribe can get you past any regulation or officials in China.
But at the very end of the day, its the consumer who makes these calls. We want products cheap and standards and safety as well as employees making a living wage dont come cheap. Its why China became so big and why Africa will likely become the next China once the chinese middle class becomes too costly. They just dont care, and american consumers just want products cheap.

You get what you pay for i guess...it's cheaper flooring for a reason. I certainly won't blame my floor company for the quality of the air i breathe or the water i drink daily.
@David Stoney Umm no. Nail-down site-finished oak and other hardwoods can be installed for $8-10 a foot. Laminates and engineered run a few bucks less, maybe. I've seen plenty of fancy Chinese engineered that cost far, far more than real hardwood. The only downside is that hardwood isnt really DIY-friendly, which is a major cost saving.
The US has massive reserves of red oak. Red and white oak were the basic floors in most homes for 100+ years, only to fall out of favor once carpet became popular. With more demand, comes more supply and labor, and cheaper prices.

No amounts to formaldehyde is safe!!!!!!!! Especially since the exact amount of exposure can not be measured, therefore it can not be considered safe.

It might surprise you to learn that most of the formaldehyde in your body is produced by your body itself in an early stage of something called the "one carbon cycle" which is used to produce DNA and key amino acids. Therefore our bodies have natural mechanisms to deal with formaldehyde up to certain concentrations. There is virtually no toxic substance on earth that you're not exposed to at some level, which makes the assertion "No amount of X is safe!!!" hold little meaning. There is always some concentration level, below which your body's natural repair mechanisms can handle it, or below which the damage done to your body happens at a rate slower than than of natural aging (you'll die before it kills you).
Remember that the next time that you buy a new car and take an extra deep sniff of that new car aroma.

My family used Lumber Liquidators Laminate flooring. I had asthma to begin with and there was no warning that this flooring had possible dangers. I battled blood cancer and immune deficiency since installation and living with it. Everyone in my home has abnormal high levels of white blood cells and platelets. We are part of the lawsuit and I am getting a $50 something dollar judgement. The flooring has been removed. I have no flooring just bare wood. I am also still in treatment. This is not justice.
That is so awful! To experience on-going and potentially life-threatening health issues, then to only get $50 as compensation! This is why we need increased oversight and testing of products, materials and food coming from other places as well as here. So much of the illnesses people go through come from scenarios where safely practices haven't been followed! I hope you and your family see better compensation than that and that all of you regain your health with no further harm!

Not sure why China is getting so much heat. This does not break their regulations and it is 85% probable that if they are mislabeling things that they are doing so at a request from the U.S. buyer who is making the money. The chinese are not selling it to U.S. companies for the much higher price to do better quality. They are giving the U.S. company the low price and the labeling the U.S. company needs to re-sell it at a high price in the assurance that no one will look into it. The U.S. company makes the money, the stock investors make the money and the U.S. public suffers health effects. As long as we measure "success" by capital in a capitalist paradigm there will continue to be people who sell people's lives to win the money game. As soon as we start measuring "who helped American's get healthy, happier lives" and measure social status using social metrics we will have people putting people first.
I don't know where you came up with the "85% probable" figure. If the Chinese companies are knowingly mislabeling their products to please their buyers then they deserve the heat, like any wrongdoer.

Ummm, ANY honey bought on a regular grocery store shelf is NOT honey. It's all imported from China and is watered down with other things. Always buy honey from a local source or a known health food store that only sells organic. (I'm not some health food nut either, but I'm not about to eat fake honey)

We had this toxic flooring installed in our Californian home and noticed immediate health effects we unfortunately didn't relate back to the flooring until watching this series a few years later. The floor still exists there today and we're looking at our options. It's very sad, and if the owner knew about these allegations, it's criminal.

Remove the floor. Just do it. Selling the home? Tell the buyer. If you don't you're just as bad as Lumber Liquidators.
Brian C, if you don’t take it out or don’t tell the buyer, and they find out, like how you have posted about this on the internet already.... they could come back and sue you for the health damages you caused them by knowingly not telling them. How would you feel if it’s a new young family and you cause an infant to get cancer? Not to mention they could also sue you for the cost of replacing the floor too. Or you can do the right thing now for your family, your realtor, and the buyer, and just replace it!
Disclosed! Btw, we had the floor measured using a VOC test. Apparently after 3 years the floor has "degassed." That's why we didn't go to court. In terms of how we felt, most of the health effects diminished after the first 12-18 months. After that we seem to have improved but we're still more sensitive to chemicals after the initial exposure.
Long story short, buy in America and do your HW. Avoid China and anything synthetic at all costs.

He sold Lumber Liquidators and started a new company I heard, called Cabinets To Go. Which has now got into the flooring business too. All flooring on the cheaper side of the market.

This is the reason I ONLY put terrazzo in my home. People laughed at me when I rebuilt an old concrete grinder in 1990. but terrazzo is so much better looking and longer lasting than that chemo crap they call "laminate".

Saw a story they did on them putting drywall in houses after that I said I would never do business with Lumber Liquidators.
altha 2014 yeah i saw the drywall one too but this kind of hazardous materials are in thousands of cheaply made crap that we get from china. It's all a very sad mess.

I bought a laminate from Lumber Liquidators. It was so cheap and defective my floor man refused to install it. Lumber liquadators did allow me to return. I switched to engineered Hardwood at a far greater cost. Hoping it’s ok!

You want it cheap? This is what you get. From construction materials to automotive parts. This is what you get when you want cheap. If you own a track home I'm sure its full of Chinese building products. Youll never know.

This kind of journalism is expensive and time consuming, so in a time where the people think news should be free of charge, the news media have to sell out to bring in the bucks.
Last year, an investigating journalist brought down the pinnacle of Norwegian culture, by investigating how high performance cross country ski wax is made.
Turns out it has killed a few hundred (if not thousands), not including miscarriages, in a small Italian town.
Use your brain people. The Chinese mills are not forcing Lumber Liquidators to buy the cheaper option. Hating another country is not your solution!
I hate laminate. My house is all 100 year old original oak and plaster walls. Not an inch of drywall. I don't understand the fascination with replacing original details with modern imports from a big box store.

damn....i was shopping for new flooring for the bedrooms in my house, and checked this company out, but went with a different company. glad i did.
Every time I hear a story about a big company doing shady things and find out the investigators hold short positions ( 4:30 ) it makes me truly wonder how much I can trust the findings. Everyone is capable of lying to shape a story his way.

my husband works on wood floors and laminate , it's what he does for a living and I would like to say anybody who is going to purchase a floor please ask the person in the store if it contains harmful chemicals ! because they will not tell you when you go in and buy it. my husband has worked with very toxic flooring because people wear cheap. he has never been asked what he is putting in somebody's house and he is not supposed to. so as a family who makes a living on installing floors and carpet I tell you please be careful with what you buy ! don't be cheap ! even carpet can be harmful. make sure you know what you are paying for because eventually my husband has to touch that crap and inhale it as he's installing it in your house to poison himself and your family. !😵

China has almost no timber. They get most of their lumber illegally from Siberia, then sells this product to the USA.
I am one of those guys that is a part of the lawsuit. My floor did not last 3 months , then finally I got a letter in stating that there is lawsuit going on.
I will never buy there again.
Just think of the millions of homeowners that think they saved money on their flooring when they're breathing in all that formaldehyde off-gassing everyday

Monkey Master Respectfully, you are comparing apples and oranges. Greed is not crucial to life, oxygen IS crucial. There are good and bad aspects to EVERYTHING. But greed causes much more harm (more negative aspects) than oxygen does. Greed is an ugly part of human nature. We can reduce the prevalence of greed but we HAVE to CHOOSE to do it.
Working in import and export... US companies/buyers always want to lowball the price and ask if the price can be lower. China response is "yes the price can be lowered but the quality won't be as good, but it can look good"

To be fair they literally said they can make the compliant version, lumber liquidators just has to pay more money. 9 times out of 10, the factory can actually make higher quality products but the clients simply choose the cheaper option and let the factory take the fall if it happens

The government would. They've done it for air and water, drugs and food; its done for housing, autos, asbestos products, alcoholic beverages, radon in your basement, etc. You can argue about how effective it really is, but it is there. Flooring is obviously somewhere down the line from these, which at this time are being dismantled by the current administration.

State governments should be responsable for creating these laws. Still its seem very convenient that liberals are always blaming conservatives even when conservatives don't have a say. California is the most liberal state, the one with the most regulations and the most expensive to live in and democrats are still blaming republicans for this.
Turning control over air, water and food quality is pretty much tantamount to turning it over the Chinese, and for exactly the same reasons. Oh, and I wasn't arguing about liberals vs conservatives, and I had already read your first post; you didn't have to throw it out there again just for me; that's not the issue.
Wrong torta122, the importation of goods from China (or any other nation) falls to the Federal govt under the Interstate Commerce Clause. California can control what is made or sold in CA, but the Feds have complete authority to inspect and investigate any and all imports. It's not a conservative vs liberal issue, it's a safety issue. Unfortunately, the current administration seems to be turning a blind eye to those willing to break the law to make a buck and put our citizens at risk.

During Hurricane Katrina FEMA was running out of trailers and had some made in such a hurry that they didn’t let the glue dry fast enough and it had high volumes of this same poison and people were getting extremely sick. That wasn’t China that was the US government and they were told that the trailers weren’t safe yet and they didn’t care bc it was for black people anyways
His response was not complete denial, that tells me that he might be in the dark about all this to an extent, but regardless, the responsible thing to do is take responsibility for his company’s actions and correct it.
Nick Akers It looked to me like he was avoiding the question. I think he knows, but blames the Chinese Warehouses. Why would the warehouse managers openly admit that they are not CARB 2 compliant but still add the labels? Because the American Buyer told them too.
Erica Davis I am all for holding large corporations responsible, but another possibility could be that lumber liquidators gave some real hard bargaining to this manufacturer saying that they wanted Carb 2 compliant flooring for a certain price or they would take their business elsewhere, so instead of changing the way they made the flooring, the factory simply started labeling the product incorrectly.
Want to know what's in your home? Pull up a couple floor registers. If you don't see 3/4" of pure thick hardwood...you have fake flooring. You can tell by the sound it makes when you walk on it, and the finish is too perfect. Get rid of fake flooring, and take some pride in your home.
