    Important note: If you need to go through the charge back system for a refund. DO NOT. I repeat DO NOT AT ALL call the transactions fraudulent. Your charge back needs to be written with this information:
    - The EXACT description of what was ordered (yes get pedantic)
    - The date that you were most recently aware that you would have gotten the merchandise if the company did not go under
    - the date the company shut down and was no longer able to give you your merchandise
    - and the most recent date that you attempted to contact them to resolve the issue - even if they don't respond! They need record for both Visa and MasterCard that an attempt was made.
    If you call the charges fraud, some banks will take you at face value of it being fraudulent and will deny the claim as you initiated the charge.
    Please get your chargebacks sent in as soon as physically possible. The sooner you get the chargeback in, the better your chances of getting your funds back.

      Source: My day job was processing credit/debit fraud and dispute claims. The amount of incorrect submissions I got on a daily basis was baffling

      @@SC-hk6ui that's why the disputes dept. Needs the date that the business ceased operation. Otherwise; you have to wait 15 days after the date you expected to receive before issuing a CB

      @@SC-hk6ui You guys are making it into a much bigger deal than what it is. If somebody incorrectly requests a chargeback due to fraud and it's rejected, then they can simply request it a 2nd time for the company's failure to deliver the product as requested. I also worked for a credit card company and processed dispute requests.

      It needs to be put as “item not received” along side the information you said
      Because when a bank see’s “fraud” the will dismiss what is said and instead check to see who, how and where a transaction was authorised and if it shows as a non fraudulent authorisations they do indeed just fail the claim
      So FFS everyone subject is “item not recieved”

    Holy cow. Watching that "CEO" streaming segment was REALLY painful. As someone with a self-taught "English", I had problems grasping the meaning of "cringe". Well... not anymore I don't!

      He didn't even have the good sense to scrub the list before doing the drawing. Sure that wasn't the only blunder he made, but it was a super-public one. It always results in hurt feelings if you announce a "winner", THEN, on camera, check to see if they're eligible. No, scrub the list first, then pick a winner after you sanitize the list. You don't even need to publicly itemize how the list got scrubbed. If someone doesn't know their name got wiped for not trying hard enough they'll have no reason to gripe when all you did was randomly draw a different name. This? This resulted in hurt feelings, and hurt feelings by proxy. that got spread really fast.

      He had rules for his drawing posted on a website. but during the stream he announced that he'd changed them... but he doesn't even spell out what the new rules are DURING the stream. And there is no official written copy. That's just DUMB, and inviting people to get POed at you.

    An interview with the ex-COO would be an interesting one. Not because of why they left Artesian, but how they built the company up to be as successful as it was. Sounds like an absolute gun of a COO, and that sort of competence is in short supply in every industry.

    It really sounds like the CEO hit the jackpot when he hired the COO. That guy grew the company and things went bad after he left and the CEO was left with something he never built and didn't have the skills to maintain. This really sucks for the employees, I've seen firsthand how destructive a leadership change can be when you go from competence to incompetence.

      I knew a guy like this CEO once. General duche, great sweetalker, massive narcissist and extremely good manipulator. You are against him? Prepare for all his friends to hear his sob story all sad faces and everything, all while he is gaslighting you publicly in front of the people that side with you. That is how a pathetic sorry excuse of a human being does, and this CEO is no different, all pretty face, narcissism and lies, makes my stomach turn.
      Keep your eyes peeled it is not going to be long before Noah ends up in some NFT project and/or a cryptoscam ;) Calling it now.

      Yep, yet another bad egg. I've been through a few positions at various companies in my engineering career. And I can tell you right now, there's no short supply of head-up-ass CEOs and managers that leave a path of employee devastation in their wake. Life is difficult and we need stable jobs, and so it's disgusting when bad managers fuck you over without thinking twice.

      My take is the CEO was an ignorant showpiece who only succeeded because he had a top notch COO who did all the real work. The company began its decline when he left and while the CEO stupidly accelerated the decline the end result was all but inevitable once the COO left.

      Here in Québec people like to whine about our lottery and contest laws that exclude us from most worlwide / North-American contests. Thing is that these laws make it impossible to pull such scams. Companies exclude us from their contests because 8million people isn't worth the hassle of hiring a legal conselor and spending the time to follow our consumer protection rules.

      Yeah, if only more crooks were that obvious. There are ones who self-BS so hard that it is hard to read from their demeanor. I fell for a couple of that type, and it only honed my BS detector further.
      I also personally participated in a marketing contest (for the game console Ouya) where they changed the winner selection process mid-contest and turned it from an apparent baiting through skill emphasis into a pure social media self-promotion contest.

      @@bappo456 I think you'll find that the Federal Reserve's mechanisms to control the money supply in a fractional reserve banking system are written in "the rules". Particularly the Federal Reserve Act.
      Also an act of violence is required to be charged with terrorism under US law, so the government won't call you a domestic terrorist for saying really anything. I don't think being publicly ignorant of monetary policy counts as sedition either.

      @@ttww1590 Please do explain how this is not professionalism on GN's part. Steve (and the team) took every respectful avenue they could to give Noah the chance to explain what happened. They didn't initialize the conversation with Noah publicly at all, they clarified their intentions with the interview and from the beginning stated how they wanted it all on record. Where in this video was Steve preaching to the faithful? The company is essentially dissolved as far as Steve is concerned, and at most he wants the customers to get their pc's (which they can't now, so a refund hopefully) and the employees to be able to find work after a mistake their employer made effected their livelihood.

His channel is a tech-related channel... Artesian is an SI that should be held with accountability just as NewEgg should be. I don't know why people are so fast to assume genuine care over a community automatically means there's inauthenticity in what they're doing. Not to mention it requires him to spend money and many hours to create this 'easy content'.

Hopefully all these people will find a job with a new company, that will treat them better and if lucky enough, will pay better as well. For with the way the company ceo acted. I have to wonder, just how well they treated their staff members, given their treatment of small streamers. Since well the one who should be punished for these things is their boss, not the staff who had nothing to do with it. For it sucks big time to lose your job, over the faults of idiots higher ups that you had no control over.

    It really sounds like the COO was the one handling the operations and keeping the books in check. The CEO was pushing for giveaways on social media without regards to operations and especially the financial side of things. When the COO left the CEO went wild and ended up bankrupting the company. On top of this there seems to be several legal actions that are taking place to complicate the matter.

      I feel this all points to a perfect way out for almost everyone involved. The CEO will try to run up some investors to restart the company, but if the former COO gets to them first, they can do do one better: build a new company, with an as of yet untarnished reputation, with the former COO as the new CEO, without the toxic bits of management, and he can scoop up all these trained skilled workers who are now fresh out of job and it'll be pretty smooth sailing. I'm sure a new company staffed with these fine people will do financially a lot better than trying to rescue that dumpster fire.

      Indeed, the COO left in November, so if he was running (and let's be clear here, it seems like he was the one actually running the company and keeping it afloat) well back then and left it in a good state, I could see Noah burning through it all in 5 months for it to have ended up how it did.

    I was one of the Twitch Ambassadors and there was a lot of drama behind the scenes on the private twitter dm group as well.
    If it was "just" the streamer give away, it could have easily be resolved by apologizing and just taking the loss. But there was a lot of drama about treatment of the employments as well, ambassador payouts after referrals~
    Angel, one of the good employees there was always really kind to us, will miss them and I hope you can help some of the employees that just lost their job like that.

      We did speak out and we got removed. It's on our Twitter, even before this exploded.
      We are Ambassadors not employees, we spoke out and we got removed, some of us left to show our disdain and no longer support them through social media influence. We did our due diligence. And that was already on mistreatment they did to some employees.
      And thats before the streamer give away rule changing scam.
      And after all this happened, we also used our social media influence to bring it to the attention to the masses. We did more then just a random stranger on the internet saying after what happened that they find it disturbing and or disgusting.
      So no, we aren't complicit and we did everything right. We spoke out, we left, we stopped our support and we rang the bell on all major social platforms. And after the events we continued spreading the word.
      Redirect your anger to the actual company and their management.

    The CEO has mention that his role model is Linus and seeing the way he behaves screams of trying to be like Linus, aka a fun leader that doesn't things too seriously and memeing and so on . The difference is of course that Linus is a professional. While he acts like a goof, it's clear from behind the scenes that Linus takes his job very seriously, has a good grasp on business and so on. Plus he is making sure to take of his community. And this is why Linus is the position that he is today. Sure, I don't doubt that Linus's on screen persona isn't unlike how he is IRL but from what people has told about it, he is very business minded (in a positive way) and that's why he is so respected. Noah Katz attitude and behaviour would never get him on the same level as Linus.

      I caught that in the way that he speaks, too. Trying to give that same vibe. Like hey, I really like Linus too, but I can appreciate that there's no friggin way he built his empire by being his on camera persona 24/7. In fact, I like the LMG videos that are "darker" and on more serious notes because it gives me a glimmer of the true business person he is.
      I also so appreciate GN's dedication to professionalism and consumer protection here too, and I can tell Steve and team do not fuck around when it comes down to issues that effect real people. From last year's garbage hardware to this incident, it's nice to see that kind of integrity.
      I try and bring that balance into my professional life as well. I'm a great, fun person to be around (on camera persona) but if I need something done that's going to potentially impact a customer or the company, I get serious and unyielding very quickly. I think it actually has a better effect than always being serious, because seeing that change in persona is jarring enough that people listen.

    I had a boss like him once. Outrageous behaviour with seemingly little regard for boundaries, larger than life personality to the point of being cringe-inducing. Employees just generally being taken advantage of, strung along and guilt tripped constantly, worst cases involved verbal abuse and threats.
    He was a narcissist and a sociopath. These emails you showed are eerily similar. Gave me goosebumps and brought back some traumatic memories. Glad you want nothing to do with him.

    I will never understand the motivations for company leadership to pee in their own pool; if Katz had the tiniest shred of hope of resurrecting himself or AB in the tech social media space, he needed to proceed in at least what would appear to be a good faith effort. Instead, his actions give the appearance that he is self-indulgent and delusional enough to believe that he is the victim here and will build a bandwagon of "this is my reward for trying to be a nice guy and giving away computers." Katz is young, his company experienced explosive growth in a short period of time, and suddenly what began as an ego-stroking sandbox rapidly turned into a serious situation in which the livelihood of dozens of people depended on his transition to a responsible and mindful leader. You have to put the interests of your staff before your own, and the scope of this failure far exceeds his failure to his customers.

    Just a note from the 15:00 mark where Steve recommends calling your bank and reporting any charge as fraudulent because you would not be getting your build. You should call and initiate a dispute but NOT report fraud. Reporting fraud means you have to get a new card and then they process your transaction as a fraud claim which would be denied (because you did initiate it) and then (if your lucky and depending on the bank) your claim may be shuffled into the disputes team. Call and do a product 'not received dispute' and tell them you cannot resolve it with the merchant because they have no staff to resolve the issue given the layoffs. This will prevent the need for replacing the card and will get your dispute to the right team for resolution.
    Signed - A guy who has been in card operations for 19 years... and has done disputes with both Visa/MasterCard's back end systems.

    I feel bad for the employees, they seem like they really enjoyed their jobs and wanted to treat customers right. But, they had a CEO that saw this as his own playground like a real-life version of The Sims. He had no idea what he was doing and it seems like he only wanted to do the fun parts of being your own boss and ignored the hard parts until the whole business collapsed. His email responses were not those of a businessman but as of a rich kid whose dad bought them a business as a birthday gift.

    When my company went belly up we managed to cover almost all debt except for a months worth of pay for two employees (Around 4k€, including taxes, health insurance, etc.). It took me almost two years to work out the feelings of guilt I had for letting them down.
    Katz is more than tone-deaf, I'd wager there's something wrong with the way his mind works.

    I think we can guess at this point that the COO left because they realized the CEO was a child with no clue how to run a business and wanted to be internet famous.       I think his lawyer team is part of the problem. I live in So. Cal. I've worked for large bankruptcy factories before. I've worked for companies that milk their accounts payable in that time. Basically you generate purchase orders, buy materials, then ghost the supplier to avoid paying them cash. When one supplier stops supplying you, you find another.
      I have never worked for a company that milks their customers to get money generating claims for bankruptcy court(I have had to however work WITH companies that do this). Those companies go bankrupt once and vanish. Those CEOs go to criminal court because it is in fact fraud and theft.

    The CEO screams entitlement. It seems every time he speaks, someone else is at fault. Aside from him wanting to become twitch famous, the way he talks about ambassadors and partners as if he's some sort of merciful god is very telling. He has zero remorse for his actions because he probably was handed a lot of things without the threat of consequence.

      Maybe it's a blessing in disguise that all the workers were fired. Now the COO that used to run the day to day operation in the production centre and was fed up with taking the CEO's bullshit, can just scoop them all up and give these skilled workers an actually nice new job.
      Every possible investor that CEO might run to, to try to secure some money to resume operation should be like "OK why would we feed the dumpster fire - we can have the COO and the old production team build a new company unburdened by the existing debts and the tarnished name, and it'll be better and more lucrative"

      Honestly such a rare thing to see in modern society. He is chill enough and yet professional without it being a flaw or drawback. Honestly GN is like the most scary generalist I know of to date. No BS and yet manages to make scummy people/companies look like they have the grim reaper of sales knocking on there door. But still go out of the way to let them show what they got. Being fair and realistic.

    Christ, this is one hell of a dumpster fire. From what it seems, the CEO is such a sociopath that he is able to instantly dismantle the entire company and fire 50 people while acting like nothing of consequence happened... Essentially, cutting his losses and running like a coward. What a pathetic waste of oxygen.
    I hope the lawsuits that come after him will leave him penniless and hopeless, as that is the only way a sociopath learns any lessons, via severe consequences.

    I can honestly say, I stumbled across your Alienware review (after purchase) and agreed with every thing you said.
    This pops up in my feed and I'm hooked, you're pretty great at what you do. Easy to listen to, you also have, and this is weird to say, a heart, crazy to think that people exist only to cater to themselves, and it's weird to see people worry more about others than themselves these days.
    "Take care of you're people, and your people will take care of you" that's like, rule number one! But you sir, are making it clear that your people, viewers, friends, employees are what your main goal is, and that my friend is some inspiring stuff.

    You were right to ditch Noah, he comes across as a right bellend both in email and on the stream. I agree it just seemed like a play thing to him and the COO was the one actually keeping things going. Also amazing gesture to offer to use you contacts to try and open doors for former employees, who genuinely sounded like they had passion for their job, their industry and customers.

    Steve, I just realized this. Raffles, give away, and other such "prize related promotions" are regulated by either the FTC and/or the IRS. Artesian Builds might be in legal hot water for 1. Not reporting raffle build winners (PCs have monetary value) and 2. changing the rules mid giveaway without informing the participants first. It would be as if the Powerball or the Megamillions lottery changed ball sets (number of balls) right before or during a drawing, You can't do that legally. And states where these promotions are running will also have rules as well. I suspect that the legal and financial ramifications of this might have caught up to them, and shuttering the company may be their attempt at avoiding those obligations. They probably flew under the radar because of their size, but when this story blew up, it probably drew attention of state and/or federal regulators. Oops.

      Hoeg Law did a video about them and the difference between a raffle and a lottery. He's not their lawyer so he can't say if that they did was illegal or not but he did suggest some folks might want to talk to an attorney so make of that what you will.

      From a purely legal standpoint they are probably in hot water. The problem is I doubt anyone cares enough to pay the legal fees to sue a company over this, especially considering it’s about to disappear and there soon will be nothing left. A state might or another legal body, but probably won’t be fast enough and I’m sure that the CEO will manage to weasel out of it

      FTC yes, IRS no. IRS is strictly tax related issues as well as funding in resulting to a bill passed in congress. IRS has nothing to do with raffels, etc. except to tax the person(s) and/or companies receiving the good (or goods), as such maybe subject to being taxed based on values. From what I understand, if such item or items are above a certain value, the company must submit tax documents so consumer pays tax and consumer is aware of that.
      FTC - Federal Trade Commission - They deal many situations that has to do with B2B (Business to Business) & B2C (Business to Consumer) transactions. Basically, businesses have to follow rules as established by FTC as well as other local laws, licenses, etc. depending on what is being "traded".
      As far as prizes and things, that mainly depends on local jurisdictions. Raffles, giveaways, and other related terms may be subject to Gambling and/or Game Commissions within such locations. I'm no lawyer, but this is just based on what I have researched.

    The business license (that's basically what the "tax issue" is-they haven't kept up paying for theirs) could have been resolved in mere minutes by writing a check and filing a single form. This whole thing is a collection of continuous mistakes largely by one person who's too impressed with himself. It's like watching a train wreck set up and driven by Noah DoucheLord himself. That it basically ended the jobs of 40-50 people is truly heartbreaking. But I guess running a "giveaway" with ever-changing rules, random chance, a prize, and consideration (e.g. he gets and in fact demands something out of it), across state lines and where one of those states is California …
    To say nothing of his relationship with Intel and that whole hostage situation "apology" video, DoucheLord is in a whole pile of legal shit if someone decides they want to prosecute him for running an illegal lottery. In which he changed the rules multiple times after people had won. In California. Where they mercilessly enforce laws against those things which contain teeth. It's a good thing he didn't livestream himself doing those things or publish in writing that he has done, is doing, and intends to continue to do these things while being the hero of his own mind.
    I feel bad for the people who worked for him. But Noah DoucheLord can eat an entire bag of dicks.

      wasnt the tax issue the fact that they were reducing the taxes using a full price of the PCs despite the fact that the parts were sponsored by another company (Intel in this case).
      Another thing is also during the sweapstakes you cannot deny the rewards as long as the participants didnt broken the written rules - its a criminal offence in that state for example. You cannot also change the rules while the sweapstake is running.

I watched a good chunk of the artesian stream and was honestly disgusted. His initial “ambassador” who won literally got shit on because the following that person had wasn’t enough for Katz and it just got worse. Honestly Steve and I mean no additional disrespect to Noah but you really dodged a bullet not taking the interview.     The few clips of Noah that you included in the video make it crystal clear he had no business being in charge of anything, let alone a company. Do people really equate being sleezy with being a leader? Do other people find that kind of character trustworthy or sincere? Confidence without any self-awareness should be an immediate red flag, not something to celebrate. My hope in humanity continues to dwindle.

      That's not the issue. There are plenty of CEO's who appear to be a bit questionable. But when your company makes 3 million a year annually and you're paid well, you keep your mouth shut if it's tolerable. It's called the golden rule. He who has the gold...MAKES THE RULES. And this kid obviously had the gold. Trouble was, like many have speculated and it seemed obvious (my guess is), he was an intelligent sociopath (I estimate around the maturity level of a 14 year old) born into a wealthy family who just didn't have enough experience to keep up with, let alone handle the kind of fast growing company he was involved with. He was obviously more concerned about his own personal image (vanity) above all else which shows when he's on camera. I used to be in broadcasting and I could always tell when someone who was star struck on themselves how they behaved in front of a camera. This guy's message was LOUD AND CLEAR who the boss was, WHO had the POWER, and WHO made the rules of the contest! I've never known a CEO, young or not, that wasn't EXTREMELY reserved and careful about what they say in public. In fact, I'm surprised he made any appearance at all during that live stream. When he did and started shooting his mouth off like a schoolboy, I thought...oh boy he's gonna put his foot in his mouth! Look up some younger geeky videos of Bill Gates CEO of Microsoft back in the 80's when he was just a young man. See the difference??? He may have looked young and stupid but he ALWAYS chose his words CAREFULLY! And what he said always sounded mature and intelligent. Compare that with ArtisianBoy here and you have complete opposites! nuf said. Thanks Steve for stepping in, exposing the truth and assisting with new employment for team members thrown to the curb. I saw what Jayz did too and it was totally awesome that he just immediately counter acted the CEO's Contest switch after drawing the winners name and declaring the winner UNQUALIFIED to win said PC due to the fact that he decided to CHANGE THE RULES AFTER THE WINNER HAD ALREADY BEEN DRAWN ( which would've been a total lawsuit in and of itself by the way). Jayz channel showed a video of him counteracting that action by him driving down to MicroCenter and personally buying all the parts to make her a killer computer system and build it HIMSELF from scratch, then SHIP IT TO HER! So, in the end...she STILL got her FREE computer. NOW THAT....was a cool ending to such a sad...scam....rip off story! Thanks JAY!!!

      Not so different from the CEO, and that says to me the company was in deep trouble already and probably killed on purpose as a tax fraud plot.

    tbh, I never heard of the company, but it pretty much sounds like the "boss runs the high profile branch where he hired some of his friends while the other branch has to pay for it on minimum wage. boss of the other branch quits over it and CEO thinks he can manage" story found almost everywhere on reddit. As for the bankrupcy, it's not uncommon for stock normally used in liquidation for refunds etc. suddenly vanishes, sometimes into the warehouse of a new company from the same owner. I hope the staff that did the honest work finds new jobs in a serious company.

      When he gets out of prison. Changing the rules of a contest multiple times, across state lines, ordering all refunds cancelled and then all production cancelled too, and running an illegal lottery (chance, prize, and the demand of something in return for the contest) are all criminal offenses. Which run afoul of consumer protection laws. In California. He commited consumer protection fraud crimes in California. He's fucked.
      That's also assuming someone doesn't make a serious case that he's deliberately running a pyramid scheme, which is also illegal. MLMs skirt a fine line with legal precision and finesse. Noah DoucheLord Katz does not have those qualities. At all.

    Holy sheet, Artesian fired their employees on the 3rd paragraph of a "attn y'all" msg, treating the firings as if it was some tertiary down the list of importance.
    Artesian really does not think highly of their employees. Shame this wasn't a co-op, the employees could have fired the CEO long ago and kept their jobs.

    I spent most of this video thinking along the lines of "I wonder if Steve and Jay (due to locations) can help these people potentially get some new employment." When you mentioned gathering their info and trying to help them out I realized the true reason I love Gamers Nexus and why I continue to support and watch. Like you said, there's not much more of a story here, seem like one person had a different plan for a company that was appently doing good work in spite of his efforts. Let him keep chasing streamers and you guys can help out the people who made the company what it was and did the real work. "Thanks Steve" and the team for being a force for good. All of your work is greatly appreciated.

      Yeah i think the disaster has been half a year in the making, given COO quit in november. It probably took at least months if not years until that person could no longer take the bullshit from above.

His actions made them lose all their sponsors, lost complete public confidence, alienated their whole consumer base, and potentially, saw someone was an attorney in another state say that his actions were illegal opened a huge huge lawsuit from the government. I pretty much can say with confidence he destroyed the company in a week.

    The beauty of this whole situation is that the little streamer he dumped on so gleefully as a nothing is in no small part the domino pusher and why they're going bye bye. I hope their employees find much more rewarding employment, which admittedly shouldn't be very difficult. EDIT: Newegg is very thankful for Noah right about now.

      Actually doubt the stream had any effect on the collapse of the business, it just meant many eyes were watching this company when it unraveled.
      Even if the orders stopped coming in entirely, it was far to soon for this type of impact. The COO leaving in November was a huge red flag to the real issues behind the collapse.
      Changing the Giveaway Rules mid stream seems as if it was a symptom of the imminent collapse, and the poor business decisions that led to it, like NOT paying State taxes.
      Suspension of business Notification, for not paying the Government won't come out of the blue, CEO knew it was coming, and likely knew 3 months ago when the COO resigned.

    Idk, I think the employees got lucky long term. I think a sudden company death gives the employees some benefits. Firing a certain number of people at once, for example, forces the company to provide severance pay for all lost employees. Probably better than the company slowly leaking air through a series of small but continuous layoffs.

    I've been dealing with a true sociopath in my life for almost 10 years now. This (former) CEO displays all of the same behaviors. They lack the ability to truly sympathize with anyone they've hurt. Truly sad for his employees and customers he's screwed over. Helping his teams find new employment is amazing!

      Psychopathic traits are often found in CEOs, politicians, lawyers, ect. I see it in him as well. Bobby Kodick is one of them. I'm sorry you've had to deal with someone like that, I can't imagine what it must be like. I hope you're doing ok.

    Like you said, "Totally Recoverable". It's like being in a plane at 10,000 feet and your engine goes out. You may not make it to your destination but you still have plenty of time to look for a place to get her down safely.
